HomeMy WebLinkAboutMin 05-01-63MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH MAY 1, 1963 The City Council convened in regular session in the Council Chambers at 8:OO P.M. wi th Mayor Runkel, Councilmen Wagner, Banker and Smalley present. Councilman Buxton~was.absent. APPROVAL OF MINUTES: On a motion by Councilman Wagner, seconded by Councilman Banker, it was unanimously carried the minutes of April 24, 1963 be approved as submitted by the Clerk. RES. NO. 63-42 Granting VARIANCE TO JOHN E. & MARGARET E. NELSON - 612-W. SMITH: On a motion by Councilman Wagner, seconded by Councilman Smalley' it was unanimously carried Res. No. 63-42 be approved granting variance to John E. & Margaret Nelson to permit construction of a seven foot fence and service building at 612 W. Smith Street and the Mayor and Clerk be authorized to sign same. REPORT ON 1963 LEGISLATION: The City Attorney reported the legislature is now entering its final stages of session. The deadline for submitting bills was April 26th and thus far he has received approximately 4,000 bills. Most of the bills on which he has had word from the League are at the same general status as in the past. A pro or con stand should be taken by the Council on any of these bills within the next· two or three weeks. VERIFIED CLAIM FOR DAMAGES - $150,000 MRS. CORAL WARDELL - 612 S. OAK STREET: The Council was advised that a second claim for damages was filed April 26, 1963 by the attorneys for Mrs. Coral Wardell, 612 S. Oak Street with exactly the same wording and for the same amount as the original claim except that it is a verified claim. On a motion by Councilman Smalley, seconded by Councilman Wagner, it was unanimously carried verified claim for damages in the amount of $150,O00 by Mrs. Coral Wardell, 612 S. Oak Street be denied. P.U.C. REQUEST RE CITY PARTICIPATION IN COST OF GRADE CROSSING SIGNALS AT ~;ROSSING NO. 5-114.O PERKINS ST. (APP.#45168): A letter dated April 25, 1963 from the Public Utilities Commission was read requesting the City consider participation in the cost of installing automatic grade crossing signals at N.W.P.R.R. crossing No. 5-114.0, Perkins Street as it appears that addit- ional vehicular traffic will be diverted over the railraod grade crossing due to the freeway. It was the City Manager's recommendation that he reply to P.U.C. to the effect that the City is not in a position to contribute financially to the project under question and further- more that any increase of traffic at the Perkins Street cross- ing would be the result of freeway construction and a State responsibility rather than that of the City. Councilman Smalley made a motion the City Manager be instructed to reply to the communication from the Public Utilities Commiss- ion in accordance with his recommendation. The motion was wi thdrawn. The Council concurred with the City Manager's recommendation that he reply to the communication from the Public Utilities Commission as outlined above. PUBLIC HEARING ON PROPOSED ADOPTION OF ORD. #553 AND #554 RELATING TO TRAFFIC: Public Hearing on the proposed adoption of Ordinances No. 553 and No. 554 relating to traffic was opened at 8:23 P.M. The City Attorney noted that at the time of introduction the reading of these ordinances was waived. There were no persons present requesting to be heard. On a motion by Councilman Wagner, seconded by Councilman Smalley,-i~ was unanimously carried Ord. #553 be adopted and the Mayor and Clerk be authorized to sign same "An Ordinance Adopting by Reference in Code Form as Chapter 1 of Division 8 Ukiah City Code the Uniform Traffic Ordinance, 1960 Edition, Published by the League of California Cities as Modified Here- in, Providing for Penalties for the Violation Thereof, and Repealing Ordinance No. 506 and All Conflicting Ordinances". On a motion by Councilman Smalley, seconded by Councilman Banker, it was unanimously carried Ord. #554 be adopted and the Mayor and Clerk be authorized to sign same "An Ordinance Codifying and Adopting by Reference the Following Ordinances and Portions of Ordinances Together with Such Amendments thereto as are Here- inafter S~ecified, in Code Form to be Included in Division 8 of the Ukiah City Code: Ordinance No. 388 Relating.to Parking Meter Zones as Amended by Ord. No. 524 and By Section 2 of This Ordinance; Ord. No. 496 Relating to Off-Street Parking; Ord. No. 468 Relating to Parking Meter Permits; Ord. No. 542 Relat- ing to Bicycles, Herein Renumbered as Chapter 5; Enacting Certain New Provisions in Division 8 of the Ukiah City Code Consisting of Chapter 6 Entitled "Angle Parking'l; and Repeal- ing Portions of Ordinances Adopted by Reference and Not Included Herein". RES. 63-43 TRAFFIC RES. DESIGNATING CERTAIN STREETS OR PORTIONS OF STREETS AS RAILROAD STOPS: On a motion by Councilman Wagner, seconded by Councilman Smalley, it was unanimously carried the reading of Res. 63-43 be waived, it be adopted and the Mayor and Clerk be authorized to sign same 'lTraffic Resolution Designating Certain Streets or Portions of Streets as Railroad Stops". RES. 63-44; 63-45; 63-46; 63-47; 63-48; 63-49; 63-50; 63-5t; 63-52 and 63-53, TRAFFIC RESOLUTIONS: On a motion by Councilman Smalley, seconded by Councilman Wagner, [t--was unanimously carried the reading of the following resolutions be waived, they be adopted and the Mayor and Clerk be authorized to sign same: Res. 63-44 "Traffic Resolution Designating Certain Streets or Portions of Streets as Stop Intersections". Res. 63-45 "Traffic Resolution Designating Certain Streets or Portions of Streets as Restricted Night Parking". Res. 63-46 "Traffic Resolution Designating Certain Streets or Portions of Streets as Diagonal Parking Zones". Res. 63-47 "Traffic Resolution Designating Certain Streets or Portions of Streets as Streets Intersecting Through Streets". Res. 63-49 - "Traffic Resolution Designating Certain Streets or Portions of Streets as Parking Prohibited at all Times". Res 63-50 "Traffic Resolution Desiclnating Certain Streets or Por~:ions of Streets as Restricted D~y Parking" Res. 63-51 "Traffic Resolution Designating Certain Streets or Portions of Streets as Two-Hour Parking". Res. 63-52 "Traffic Resolution Designating Certain Streets or Portions of Streets as One-Hour Parking". Res. 63-53 "Traffic Resolution Designating Certain Streets or Portions of Streets as Twenty-four Minute Parking". VAR. APPLICATION 63-14 - MRS. MAURINE EDDY 656 ORCHARD AVENUE: Variance Application #63-14 by Mrs. Maurine Eddy, 656 Orchard Avenue to permit construction of an addition to existing school to accommodate a kindergarten class, plot plan and the minutes of the meeting of the Planning Commission held April 18, 1963 recommending variance be granted, were reviewed by the City Manager. Mrs. Eddy was present on behalf of the application and there were no written or verbal.protests to the granting of the pro- posed variance. On a motion by Councilman Smalley, seconded by Councilman Wagner, it~was unanimously carried the City Attorney be instructed to prepare a resolution granting Variance #63-14 to Mrs. Maurine Eddy to permit construction of an addition to the existing school at 656 Orchard Avenue as set forth in the plot plan, subject to the condition that construction be completed within one year from date of granting this variance. VAR. APPLICATION 63-15 R. S. PALMER 719 VICHY HILLS DRIVE: Variance application #63-15 by Mr. R. S. Palmer to permit R-2 use of existing R-1 property for the purpose of constructing a multiple dwel-ling on property located on Hope Street between Standley and Perkins Street, plot plan and the minutes of the meeting of the Planning Commission held April 18, 1963 recommend- ing variance be denied, were reviewed by the City Manager. The Planning Commission recommended denial on the following bas i s: 1. That the location of the R-2 districts established in the Proposed Zoning Ordinance should be maintained, and 2. That the Proposed Zoning Ordinance provides sufficient new area zones for R-2 use to allow necessary expansion of multiple dwelling development. Mr. Palmer was present in behalf of the application and there were no written or verbal protests to the granting of the proposed variance. On a motion by Councilman Banker, seconded by Councilman Wagner, it was unanimously carried Variance Application #63-~15 by R. S. Palmer be denied in accordance with the recommendation of the Planning Commission as outlined above. 8O5 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH MAY 1, 1963 - Page 4. PROCLAMATION OF '"RODEO WEEK" MAY 13-19, 1963: Mayor Runkel proclaimed the week of May 13 through 19, 1963 "Rodeo Week". NO. 63-54 OPPOSING CURTAILMENT OF RAILROAD SERVICE BETWEEN WlLLITS AND EUREKA BY N.W.P.R.R.: On a motion by Councilman Wagner, seconded ~y. Councilman Smalley, it was unanimously carried Res. #6 54 be adopted and the Mayor and Clerk be authorized to sign same "Resolut- ion Opposing Curtailment of Railroad Service Between Willits and Eureka". APPROVAL OF WARRANTS: On a motion by Councilman Banker, seconded by Councilman Smalley, it was unanimously carried special warrants in the amount of $299.40 be approved and ordered paid. COUNCILMAN SMALLEY: Mr. Smalley inquired if the Police Department is checking the operators of motor scooters for driver's licenses and was informed this is being done. COUNCILMAN BANKER: Mr. Banker suggested the City Manager direct a letter to Donald Scotto congratulating him on his new position with the County as Welfare Investigator and expressing appreciation for service rendered during employment with the City.
