Councilmen Wagner and Buxton were absent. APPROVAL OF MINUTES: On a motion by Councilman Smalley, seconded by Councilman Banker, it was unanimously carried the minutes of May 22, be approved as submitted by the Clerk. 1963 APPROVAL OF WARRANTS: On a motion by CouncJ 1man Smalley, seconded by Councilman Banker, it was unanimously carried Payroll Warrants for the period May 15 to 31, !963 be approved in the amount of $28,O89.10 and ordered paid. On a motion by Councilman Banker, seconded by Councilman Smalley, it was unanimously carried special warrants in the amount of $7,813.79 be approved and ordered paid. APPROVAL OF PROJECT AND AUTHORIZATION TO FILE NOTICE OF COMPLETION ON NORTON & MAIN STS. - ABSCO PAVING INC. On a mo it was project by the file th tion by Councilman Banker, seconded by Councilman Sma]ley, unanimously carried the Norton & Main Street pavin9 by Absco Paving Co., Inc. be accepted as recommended Director of Public Works and the Clerk be authorized to e necessary Notice of Completion. PUBLIC HEARING - 1963 WEED ABATEMENT PROGRAM: Public hearing on weed and rubbish abatement for 1963 was declared open by Mayor Runkel at 8:05 P.M. The City Attorney filed with the Clerk a description of the properties certified to by the Assessor of Mendocino County 9ivin9 the names and addresses of owners. The City Attorney also filed with the Clerk the Affidavit of Mailin9 and the Affidavit of Posting by the Director of Public Works. Certificate withdrawing properties which, accordin9 to the Di rector of Public Works have satisfactorily been cleared of weeds and rubbish, was fi led wi th the Clerk. There were no persons ,present properties described in Res, certified to by the Di rector requesting to be heard regarding No. 63-56 ]ess the properties of Public Works. COUNCILMAN WAGNER ARRIVED AT THIS POINT IN THE HEETING - 8:08 P.M. RES. NO. 63-57 ORDERING DI RECTOR OF PUBLIC WORKS TO PROCEED WITH THE ABATEMENT OF WEEDS AND RUI3BLE: On a motion by Councilman Smalley, seconded by Counci!man Wagner, it was unanimously carried Res. 63-57 be adopted and the Mayor and Clerk be authorized to si9n same "Resolution Orderin9 Di rector of Public Works to Proceed wi th the Abatement of Weeds and Rubble:,". On a motion by Councilman Wagner, seconded by Councilman Banker, it was unanimously carried Ord. #55S be adopted and the Mayor and Clerk be authorized to sign same: "An Ordinance Repeaiin9 Certain Chapters of Division 3 of the Ukiah City Code Consisting of Chapter ] Entitled "Uniform Building Code", Chapter 2 Entitled "Uniform Electrical Code" and Chapter 3 Entitled "Uniform Plumbing Code" and Enacting New Chapters Consisting of Chapter 1 Entitled "Uniform Building Code", Chapter 2 Entitled "Uniform Housing Code" and Chapter 3 Entitled "National Electrical Code", and Chapter 5 Entitled "Uniform Plumbing Code", all of Which Said Codes Are Hereby Adopted by Reference in Code Form, and Providing for Penalties For the Violation Thereof; Renumberin9 Chapter 4 "Signs, Awnin9s and Similar Projections~' as Chapter 6: Renumberin9 Chapter 5 Advertising Displays Adjacent to Landscaped Freeways as Chapter 7; and Renumberin9 Chapt.er 6 "Buildin9 Hei9hts Near Airport" as Chapter 8." REPORT ON C.A.B. DECISION RE PACIFIC AIR LINES: Examiner Wrenn, Chief Examiner for C.A.B. has rendered an adverse decision in the City vs. Pacific Air Lines, however, according to the City Attorney his decision is subject to discretionary reviewin9 by the C.A.B. Board which is comprised of 5 members. I t may, on peti ti on, review the decision of the Examiner or do so on its own motion. The City has until June 17th to file a petition for review. The City Attorney was not prepared to submit a recommendation to the Council at this time and this matter will be placed on the agenda for the next regular meetin9. REPORT ON GRIFFIN VS. BOARD OF SUPERVISORS MONTEREY COUNTY RE SUPERVISORIAL REDISTRICTING: The City Attorney reported that the case of Griffin vs. Board of Supervisors, Monterey County at the present time is a Petition for Writ of Mandate in the Supreme Court and the Board of Supervisors has filed an Answer and Return and the Petitioner has filed a demur to that. The Supreme Court has taken no action as yet, however, any further action will be reported to the Counci ! . REPORT ON The S.B. 1963 LEGISLATION: City Attorney reported on the following legislation: 344- Gas Tax for City Streets and County Roads. This Bill is very close to adoption. SCA - A.B. 18 - 1% Telephone Tax in Lieu of Franchise Fee is dead. 3025 - State Water Quality Control Program might stand some chance for adoption. This Bill would give the State Regional Water Control Agency control over the quality of water as we!! as the pollution aspects. 2015, A.B. 2017 and A.B. 20!8 - Annexation Measures have been approved in the Assembly and took as though they stand a good chance to pass. 314 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH JUNE 5, ~963 - PAGE CITY EMPLOYEES' CODE OF ETHICS Ii~ RECOGNITION OF PUBLIC EMPLOYEES' WEEK: Don Richardson, President of the City Employees' Association read and presented to the Mayor the City Employees' Code of Ethics Tn recognition of Public Employees' Weel<. VARIANCE APPLICATION NC. 63-17 G. WESLEY CALDWELL, MAPLE STREET: App1 i ca ti on No. 63- 17 by Mr. & Mrs. G. Wes 1 ey Ca 1 dwel 1 to permit reduction of the required sideyard from a mirlirnum of twenty Feet to a minimum of fourteen feet on property located at 1080 Maple Avenue, was reviewed along with the plot plan and minutes of the Plann;n9 Commission meeting of May !6, !963 recommending the variance be 9ranted, subject to the condition that a distance of 10 feet be maintainc-~d between the roof overhang and the property line along Fairway Avenue. Mr. Caldwell was present on behalf of the application and there were no written or verbal protests to the proposed va r i a nce. On a motTon by Counci !man Banker, seconded by Councilman Smalley, it was unanimously carried the City Attorney be instructed to prepare a resolution granting Variance 63-17 subject to the condition set forth by the Planning Commission as outlined above. REQUEST TO WAIVE CALL FOR BID FOR LEGAL ADVERTISEMENTS - 1963-6L,~: On the basis there is only one newspaper wi thin the City qualified to bid on legal advertisements and the publisher is agreeable to continuing this service at the same rates as for the previous year, it was the City Manager's recommendation bid ca!! be waived for 1963-~L~ requirements. On a motion by Councilman Buxton, seconded by Councilman Smalley, it was unanimously carried bid call for legal advertisements published in 1963-64 be waived as recommended by the City Manager and the Ukiah Daily Journal continue this service for the same rates as charged !ast year. AGREEMENT WITH CALIF. STATE PERSONNEL BOARD COOPERATIVE SERVICES APPROVED: On a motion by Councilman Wagner, seconded by Councilman Buxton, it was unanimously carried agreement with the California State Personnel Board Cooperative Services to provide Civil Service testing material be renewed, term of agreement to continue until terminated by either party upon written notice, and the Mayor and Clerk be authorized to sign same. AMBULANCE SERVICE CONTRACT Z IMMERMAN'S MORTUARY: The Council concurred wi th the City Manager's recommendation that he negotiate with Zimmerman's Mortuary regarding renewal of their five year contract for ambulance service and report this matter at the next regular meetin9. on REQUEST TO CALL FOR BIDS FOR PROPANE GAS REQUIREMENTS DEFERRED: The City Manager requested that re~.est propane gas requi rements for 1963- be to call for bids for deferred. 315 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH JUNE 5, !967, - PAGE 4 RESULT OF WATER ANALYSIS BY BROWN & CALDWELL: A report was made on a routine water analysis which set forth the fact that no water problems exist. In addition it was reported that, as a result of comments which have been made, a pesticide analysis was requested which very clearly pointed out that no pesticides are contained in the City of Ukiah water supply. COUNCILMAN BUXTON: Councilman Buxton proposed that consideration be given to amendin9 the ordinance governin9 council meetings to al low two evenin9 meetings and two afternoon meetings per month. Mr. Buxton inqui red about plans for the annual employees' barbecue which will tal<e, place in the latter part of July. Plans have not yet been formalized. COUNCILMAN BANKER: On inquiry regarding payment for the year pins for Library employees, Mr. Banker was informed that the pins had been ordered and paid for by the City. COUNCILMAN SMALLEY: Mr. Smalley reminded the City Manager that the date for the League meeting in Eureka should be established and the City Clerk in Eurel<a notified of same.
