HomeMy WebLinkAboutMin 06-12-63816 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH JUNE 12, 1963 The City Council convened in regular session in the Council Chambers at 8:00 P.M. with Mayor Runkel, Councilmen Wagner and Sma lley present. Counc|lmen Buxton and Banker were absent. APPROVAL OF MINUTES: On a motion by Councilman Wagner, seconded by Councilman SmalTey, .... i~ was unanimously carried the minutes of June 5, 1963 be approved as submitted by the Clerk. RES. NO. 63 -58 GRANTING VARIANCE TO MR. & MRS. G. WESLEY CALDWELL: COUNCILMAN BUXTON ARRIVED AT THIS POINT IN THE MEETING - 8:02 P.M. On a motion by Councilman Wagner, seconded by Councilman Smalley, i~ was unanimously carried Res. No. 63-58 be adopted and the Mayor and Clerk be authorized to sign same 'lResolut- ion Granting Variance to Mr. & Mrs. G. Wesley Caldwell" to permit encroachment of carport roof into sideyard at 1080 Maple Street. REPORT ON POSSIBLE ACTION IN C.A.B. PROCEEDING: A memorandum from the City Attorney dated June 12, 1963 was read in which he stated that under the CAB rules a petition for review of the Examiner's decision is possible in the discretion of the Board upon the following grounds: l) a finding of a material fact is erroneous; 2) a necessary legal conclusion is without governing precedent or is a departure from or contrary to law, Board rules, or precedent; 3) a substantial and important question of law, policy or discretion is involved; or 4) a prejudicial procedural error has occurred. In the opinion of the City Attorney each of the foregoing grounds is present and would warrant granting of a petition for review. However, in light of the Board's unsympathetic attitude towards the problems of air service to smaller communities it is extremely doubtful that such review would be accorded, much less a different decision be made. The Council concurred with the City Attorney's recommendation that this matter be pursued no further. A.B. 2827 DEFINING AREAS OF CONFLICT V. NO CONFLICT BETWEEN LOCAL ORDINANCES AND STATE LAW: The City Attorney reported receipt of a letter from Assembly- man Frank P. Belotti to the effect that A.B. 2827 failed to be reported out of the Assembly Criminal Procedure Committee where it was set for hearing on May 31st. Therefore, it will receive no further action at this Session of the Legislature. PROPOSED ORDINANCE GOVERNING THE SAFETY OF PRIVATE SWIMMING POOLS: Copies of a proposed ordinance governing the safety of private swimming pools were distributed by the City Attorney for Council consideration. The Council was advised the accounting firm of Fitzpatrick & Poulsen, C.P.A. has requested it be given consideration to conduct the annual audit of City Records for a period of three years at the rate of $1,250 per year. The City Manager noted that the only local auditing firm qualified under C.P.A. regulations to conduct the audit, is not interested due to its present work load. The City Manager was directed to proceed with the preparation of a new contract with Fitzpatrick & Poulsen, C.P.A. for a term of three years at a fee of $1,250 per year to perform the audit as set forth in the audit specifications. EXPIRATION OF TERMS - MEMBERS OF CITY COMMISSIONS AND BOARDS: Members of the Council were provided copies of the list of members of City Commissions and Boards whose terms will expire June 30, 1963. AGREEMENT WITH CHAMBER OF COMMERCE: The Council was advised that copies of the agreement extend- ing Chamber of Commerce agreement for promotional and advertising activities for one year (1963-64) has been sub- mitted to the Board and Manager for consideration. CONSIDERATION OF TENTATIVE MAP OF OAK KNOLL TERRACE SUBDIVISION: Action to consider acceptance of the tentative map of Oak Knool Terrace Subdivision was deferred at the request of the subdivider who could not be present at this meeting. PEDESTRIAN SAFETY CITATION FOR NO PEDESTRIAN FATALITIES IN 1962: The City Manager announced that the City of Ukiah has received a Pedestrian Safety Citation in the 24th Annual AAA Pedestrian Program Appraisal for not having a single pedestrian fatality during the year of 1962, and also meeting certain other minimum program requirements. This is the third consecu- tive year the City of Ukiah has received this award. APPROVAL OF WARRANTS: On a motion by Councilman Smalley, seconded by Councilman Buxton, it w~s-Unanimously carried special warrants in the amount of $375.00 be approved and ordered paid. REQUEST TO CALL FOR BIDS FOR 2 OIL CIRCUIT RECLOSERS AND 1 OUTDOOR 12 KV SUBSTATION STRUCTURE: On a motion by Councilman Wagner, seconded by Councilman Sma lley, it was unanimously carried the City Clerk be authorized to call for bids for 2 Oil Circuit Reclosers and 1 Outdoor 12 KV Sub- station Structure as,per specifications, bids to be opened at 2:00 P.M. June 25,19~3.
