SEPTEMBER 18, 1963
The Council convened in regular session in the Council
Chambers at 8:00 P.M. with Mayor Runkel, Councilmen Wagner,
Banker and Smalley present. Councilman Buxton was absent.
ELECTION OF CITY CLERK PRO TEM
On a motion by Councilman Wagner, seconded by Councilman Banker,
Councilman Smalley was unanimously elected City Clerk Pro
Tempore.
APPROVAL OF MINUTES
On a motion by Councilman Wagner, seconded by Councilman Banker,
it was unanimously carried the minutes of September 11, 1963
be approved as corrected.
APPROVAL OF WARRANTS
On a motion by Councilman Smalley, seconded by Councilman
Wagner, i"t--was unanimously carried payroll warrants for the
period September 1 to 15, 1963 in the amount of $32,455.10
be approved and ordered paid.
On a motion by Councilman Banker, seconded by Councilman
S'mal~ey, i{' was unanimously carried general warrants in the
amount of $65,978.52 be approved and ordered paid.
POLICE OFFICERS AS WITNESSES IN CIVIL
ACTIONS; 1963 LEGISLATION RE PAYMENT
For the information of the Council, the City Attorney reported
that he had prepared a memorandum to the Chief of Police con-
cerning 1963 legislation which now permits city policemen to
receive regular pay and travel expenses for court appearances
in civil actions and requires the party subpoenaing the officer
to reimburse the city.
DISMISSAL OF PETITION IN
BANKRUPTCY PROCEEDINGS
The Council was informed by the City Attorney of suspension of
bankruptcy proceedings by the local business in arrears for
utility service, and that the referree had allowed dismissal
of the petition in favor of establishing a creditors committee
to supervise payment of the outstanding debts. Mr. Irish stated
that he had requested the City be accorded a position on the
committee and had recommended the Director of Finance be nomina-
ted to such committee.
PROPOSED ORDINANCE GOVERNING
CARNIVALS, CIRCUSES AND OTHER
AMUSEMENT ACTIVITIES
The City Attorney enquired whether the Council wished further
information regarding the proposed ordinance relating to car-
nivals, noting that changes could be made if the Council so
desired. The Council was not ready to discuss the matter furth'er
and it was suggested it be brought up at a future meeting when
the entire Council i.s present.
CITY ATTORNEY TO ATTEND
STATE BAR CONVENTION
The City Attorney informed the Council that he would be attending
the State Bar Convention in San Francisco the week of September
23rd and would therefore be absent from the next meeting of the
Counc i ].
VARIANCE APPLICATION NO. 64-2
UKIAH COMMUNITY FOURSQUARE CHURCH
1162 HELEN AVENUE

Variance Application No. 64-2 by the Ukiah Community Foursquare
Church to permit combined church and residential use of the
existing residence at 1162 Helen Avenue was reviewed. The
City Manager also reviewed the records of the public hearings
and discussion by both the Planning Commission and City Council
regarding this matter and read the recommendation adopted by the
Planning Commission on September 5th for denial of the applica-
tion.
Four homeowners of the neighborhood, represented by Attorney
Charles Bell, were present in support of previously submitted
protests to the granting of the proposed variance.
On a motion by Councilman Wagner, seconded by Councilman Smalley,
it was unanimously carried Variance #64-2 be denied to the Ukiah
Community Foursquare Church to permit combined church and resi-
dential use of the existing residence located at 1162 Helen Ave-
nue.
PUBLIC HEARING SET ON
COSTS FOR WEED ABATEMENT
On a motion by Councilman Wagner, seconded by Councilman Banker,
it was unanimously carried a public hearing on the costs for
Weed Abatement be held September 25, 1963 at 8:00 P.M.
PROPOSED ZONING ORDINANCE - STUDY
SESSION POSTPONED TO OCTOBER 2ND
It was agreed that due to the fact the City Attorney will be absent
from the meeting of September 25th, the study session on the
Proposed Zoning Ordinance be postponed until October 2nd, foll-
owing the regular meeting of the Council.
RESOLUTION NO. 64-15 APPOINTING
PALOMA R. WILLIAMS CITY CLERK FOR THE
BALANCE OF THE UNEXPIRED TERM OF
CAROLINE M. CHURCH
On a motion by Councilman Wagner, seconded by Councilman Smalley,
it was unanimously carried Resolution No. 64-!5 be adopted and the
Mayor and Clerk be authorized to sign same "Resolution Appointing
Paloma R. Wi liams City Clerk for the Balance of the Unexpired
Term of Caroline M. Church."
COUNCILMAN BANKER
Councilman Banker enquired whether resurfacing of So. Oak St.
would be complete before the rainy season starts. The Director
of Public Works explained that complete reconstruction is planned
following completion of the underground work now in progress, and
weather permitting will be accomplished before the winter season.
COUNCILMAN SMALLEY
Councilman Smalley enquired regarding the new loading zone created
in front of the old Kraft building on S. School St. and was informed
it is to replace the loading area for the Rascoe store on W. Standley
Street which will be metered for normal use.
ADJOURNMENT
As there was no further regular business, Mayor Runkel declared
the meeting adjourned at 8:35 P.M.
