Banker and Smalley present.
APPROVAL OF MINUTES
On a motion by Councilman Smalley, seconded by Councilman
Wagner, it was unanimously carried the minutes of September
25, 1963 be approved as submitted by theClerk.

On a motion by Councilman Banker, seconded by Councilman Smalley
it was carried by the following roll call vote that Resolution
No. 64-18 be approved and the Mayor and Clerk be authorized to
sign same I'Resolution Declaring That Proceedings Have Been
Initiated By The Council of the City of Ukiah To Annex To Said
City Certain Uninhabited Territory Described Herein and
Designated "Annexation No. 64-1," and Giving Notice of the
Proposed Annexation."

PROPOSED FREE LIBRARY SYSTEM
FOR UNINCORPORATED AREAS IN COUNTY
For the information of the Council, the City Attorney reported
that at their last meeting the County Board of Supervisors adop-
ted an ordinance calling for the question of whether or not to
establish a county free library to be presented to the voters at
the next primary election. Although the ordinance as adopted by
the Board of Supervisors excludes all incorporated areas of the
County, the law recognizes that City residents are also residents
of the county and specifically permits them to vote in such an
election.
SUPERVISORIAL REDISTRICTING
CONSIDERED BY BOARD OF SUPERVISORS
The City Attorney reported that the Board of Supervisors also
considered the matter of supervisorial redistricting and continued
further discussion on the problem until November 12th.
The City Manager mentioned to the Council the extreme importance
of the equity among the different Supervisorial Districts and
suggested that, in the best interest of the citizens of the
City, a detailed study be made of the boundaries of any proposed
changes of districts and that the Council consider making a firm
recommendation to the Board of Supervisors regarding any changes
that might affect the City of Ukiah. After discussion the Council
agreed that the investigation and report should be made as
recommended.

REPORT ON CONVENTION
OF STATE BAR ASSOCIATION
The City Attorney reported briefly on the convention of the
State Bar Association and commented that many matters of extreme
importance to city governments had been considered.
VAR. APPLICATION #-64-4, ALFRED NICOLAISEN
DENTAL LABORATORY, 343 JONES ST.
Variance Application #64-4 by Alfred Nicolaisen to permit operation
of a dental laboratory on property located in an R-1 zone at
343 Jones St., plot plan and minutes of the Planning Commission
meeting held September 19, 1963 were reviewed by the City Manager.
it was the recommendation of the Planning Commission the variance
be granted according to the application and attached plot plan,
subject to the following conditions:
1)
That sidewalks be constructed by applicant along the
Jones Street and Dora Street frontages; and
2)
That additional off-street parking be provided in
conjunction with any expansion of the business.
Mr. Nicolaisen was present on behalf of the application and there
were no written or verbal protests to the granting of the variance.
Mr. Nicolaisen informed the Council that he provides delivery
service and there would therefore be no customer traffic in
connection with this business.
It was observed by the Council that the property is proposed to
remain zoned R-1 under the revised Zoning Ordinance.
On a motion by Councilman Wagner, seconded by Councilman Buxton,
it was unanimously carried the City Atto[ney be instructed to
prepare a resolution granting Variance #64-4 to Alfred Nicolaisen
as recommended by the Planning Commission and subject to the
condition that the variance granted be confined to the area
designated as "Dental Lab" on the plot plan submitted with the
application.

REDUCED SET-BACK - 711 S. DORA ST.
Variance Application #64-5 by Dr. William Vest to permit reduction
of the required 20 foot set-back to a minimum of 12 feet along the
Hill St. frontage of property located at 711S. Dora St., plot
plan and minutes of the Planning Commission meeting held September
19, 1963 were reviewed by the City Manager. The Planning
Commission recommended the variance be granted subject to the
condition the variance apply only to the proposed building as
shown on the plot plan accompanying the application.
There was no one present on behalf of the application, and there
were no written or verbal protests to the 9rantin9 of the variance.
On a motion by Councilman Buxton, seconded by Councilman Smalley,
it was unanimously carried the City Attorney be instructed to
prepare a resolution granting Variance #64-5 to Dr. William Vest
containing the conditions established by the Planning Commission
and general conditions.

TRANSPORTATION AND PUBLIC UTILITIES
AIRPORT FINANCING - OCT. 1L~TH
The City Manager informed the Council of a meeting to be held
October 14th in Redding of the Joint Legislative Committee on
Transportation and Public .Utilities regarding airport financing.

Mr. Cash explained that the objective of the committee is to
evaluate the deficiencies on municipal and county owned airports
toward developing a State program for financing airport im-
provements.
The Council concurred with the City Manager's recommendation that
the City of Ul<iah be represented at this meeting.
REQUEST TO CALL FOR BIDS FOR
CEMENT MORTAR LINING OF
STEEL WATER MAINS
On a motion by Councilman Smalley, seconded by Councilman Bux-
1Dn, it was unanimously carried theClerk be authorized to call
-For bids for the cement mortar lining of steel water mains as
per specifications submitted, bids to be opened at 2:00 P.M.,
October 15, 1963.

-o~ AUDIT REPORT:
Copies of the 1962-63 Audit Report were distributed for Council
·
review. The City Manager indicated his report concerning the
Audit would be presented to the Council next week.
PROPOSED ZONING ORDINANCE
The City Maneger announced that this was the time at which the
Council had decided to hold a study discussion of the facts
and information accumulated regarding the proposed Zoning Or-
dinance. Certain members of the audience indicated that they
wished to be heard on the merits of the ordinance. The City
Attorney advised the Council that since it was not a public hearing,
in his opinion it would be unwise for the Council to allow
informal evidence to be presented which might jeopardize the ,~
ordinance, if adopted, and suggested that if members of the
public desired to be heard further on the proposed ordinance,
the Council achieve this by setting a public hearing at a future
date with due notice.
The Council discussed the possible courses of action and after
considerable discussion it was moved by Councilman Wagner the City
Council return the Proposed Zoning Ordinance to the Planning
Commission with the recommendation that the area zoned C-N at
the intersection of E. Perkins St. and Orchard Ave. be changed
to an R-1 Zone, and that the parcel at the southwest corner of
Washington and So. State St. be zoned C.-2 in its entirety,
rather than partly R-3 and partly C-2. The motion died for lack
of a second.
After further discussion several members of the Council indicated
that they wished to hear additional testimony from the public and
to discuss the matter informally with members of the Planning
Commission prior to attempting to arrive at any decision.
On a motion by Councilman Banker, seconded by Councilman Smalley,
it was carried by the following roll call vote that 8:00 P.M.,
October 16, 1963 be established as a further public hearing for
the purpose of hearing additional public comments on the proposed
Zoning Ordinance.
