NOVEMBER 6, 1963 . . . ~ .........
The City Council convened in regular session in the Council
Chambers at 8:00 P.M. wi th Mayor Runkel, Councilmen Wagner,
Banker, and Smalley present. Councilman Buxton was absent.
APPROVAL OF PAYROLL WARRANTS
On a motion by Councilman Banker, seconded by Councilman Wagner,
it was unanimously carried Payroll Warrants for the period of
October 15th to 31st, 1963 be approved in the amount of
$32,006.16.
APPROVAL OF SPECIAL WARRANTS
On a motion by Councilman Wagner, seconded by Councilman
smalley', it was unanimously carried Special Warrants in the
amount of $13,812.67 be approved and ordered paid.
APPROVAL OF MINUTES
On a motion by Councilman Wagner, seconded by Councilman
Banker.., i"t Was unanimously carried the minutes of October 23,
1963 be approved as submitted by the Clerk.
PUBLIC HEARING RE. COSTS OF
WEED ABATEMENT IN 1963
Public hearing was declared open by the Mayor at 8:03 P.M.
on the costs for the weed abatement program during 1963. As
there were no persons present requesting to be heard on the
matter the public hearing was declared closed at 8:06 P.M.
RESOLUTION NO. 64-21 CONFIRMING REPORT
OF DIRECTOR OF PUBLIC WORKS REGARDING WEED
ABATEMENT CHARGES
On a motion by Councilman Smalley, seconded by Councilman
Wagner, it was unanimously carried Resolution No. 64-21 be
adopted and the Mayor and Clerk be authorized to sign same
"Resolution Confirming Report of Director of Public Works
Regarding Weed Abatement Charges."
RES. NO. 64-22 VACATING PORTION OF
UNNAMED ALLEY SO. OF RUDDOCK AVE. AND
BETWEEN OAK AND SCHOOL STREETS
Public hearing was declared open by the Mayor at 8:07 P.M.
regarding the proposed abandonment of the unnamed alley lying
south of Ruddock Avenue and between Oak and School Streets.-
Affidavit of Posting by the Director of Public Works was filed
with the Clerk. There were no persons present re_questing to
be heard. Public hearing was declared closed at 8.. 10 P.M.
On a motion by Councilman Smalley, seconded by Councilman
Banker, it was unanimously carried Resolution No. 64-22 be
adopted and the Mayor and Clerk be authorized to sign same
"Resolution Vacating Portion of Unnamed Alley South of Ruddock
Avenue and Between Oak and School Streets."
AWARD OF BID FOR DISTRIBUTION TRANSFORMERS
TO PHILLIPS & EDWARDS ELECTRIC COMPANY
Tabulation of bids received for the furnishing of 14 distribution
transformers was reviewed as follows:

The City Manager informed the Council that Phillips & Edwards
Electric Co. had contacted the City by telephone after the b~
opening to advise that their bid had been submitted in error
since the prices quoted by their supplier had included the
15% allowable discount and that they, "Phillips & Edwards"
had allowed a second 15% discount on the bid form. They first
notified us that they were withdrawing their bid but when
advised that this would probably result in formal action
against them by the City they stated that if the bid were
awarded to them they would make a decision at the time their
signature became necessary.
In spite of the statements of the low bidder, the City Manager
recommended that the award be made to Phillips & Edwards Electric
Co. as having presented the lowest responSible bi'd.
On a motion by Councilman Wagner, seconded by Councilman Banker,
it was unanimously carried bid for the furnishing of 14 distri-
bution transformers in the amount of $3,980.65 be awarded to
Phillips and Edwards Electric Company.
VARIANCE APPLICATION NO. 64-6
LEONA C. MYERS - CHURCH SERVICES IN
RESIDENCE AT llO0 W. STANDLEY ST.
Application for Variance No. 64-6 by Leona C. Myers to permit
the conduct of church services in the existing residence at
1100 W. Standley St., plot plan and the minutes of the Planning
Commission meeting held October 17, 1963 were reviewed by the
City Manager. It was the recommendation of the Planning Com-
mission that the variance be denied.
There were no persons present on behalf of the application,
and there were no written or verbal protests to the proposed
var i ance.
On a motion by Councilman Banker, seconded by Councilman
Wagner, it was unanimously carried Variance No. 64-6 be denied
to Leona C. Myers to permit the conduct of church services in
the existing residence at 11OO W. Standley Street.
VARIANCE APPLICATION #64-7
DR. ROY.M. SWAIN - PROFESSIONAL
OFFICE AT ~/~ SO. DORA STREET
Application for variance #64-7 by Dr. Roy M. Swain to permit
use of the existing residence at 716 So. Dora St. for a profes-
sional office in the practice of optometry, plot plan and minutes
of the Planning Commission meeting held October 17, 1963 were
reviewed by the City Manager. It was the recommendation of the
Planning Commission that the variance be granted.
Dr. Swain was present on behalf of the application, and there
were no written or verbal protests to granting the proposed
variance.
On a motion by Councilman Smalley, seconded by Councilman Wagner,
it was unanimously carried the City Attorney be instructed to
prepare a resolution granting Variance #64-7 to Dr. Roy M. Swain
to permit use of the existing residence at 716 S. Dora St. for a
professional office in the practice of optometry.

VARIANCE APP. NO. 64-8
JOE H. MAYFIELD, CONSTRUCT
DWELLING ON UNDEDICATED ST.
W. EXTENSION OF COCHRANE AVE.
Variance Application No. 64-8 by Joe H. Mayfield to permit
construction of a single family residence on an undedicated
street known as the westward extension of Cochrane Ave., plot
plan and the minutes of the Planning Commission meeting held
October 17, 1963 were reviewed by the City Manager. It was
the recommendation of the Planning Commission that the variance
be granted subject to the following conditions:
1) That sewer and water lines be constructed by applicant
as suggested by the Building Inspector; and
2) That a minimum of 20 feet be maintained by the applicant
for access to the property in accordance with the
requirements of Sec. 10.52 of Ordinance No. 533
(Subdivision Ordinance).
Mr. Mayfield was present on behalf of the application and there
were no written or verbal protests to granting the proposed
var i ance.
The City Attorney questioned the applicability of the variance
procedure which has been used to this point and requested that
he be given another week to determine the correct procedure
for this type of situation.
Each member of the Council gave their general approval to the
City Attorney using the appropriate procedure to grant the
applicant the right to construct the proposed residence in
general conformance with the recommendation of the Planning
Commiss ion.
REQUEST TO CALL FOR BIDS FOR
ELECTRIC METER TESTING EQUIPMENT
On a motion by Councilman Smalley, seconded by Councilman
Wagner, i"t was unanimously carried the Clerk be authorized to
call for bids for the furnishing of electric meter testing
equipment as per specifications submitted, bids to be opened
at 2:00 P.M., November 26, 1963.
APPROVED REQUEST FOR EXTENSION
OF EMPLOYEE SICK TIME
A request for extension of sick leave by Ernest Hatton, Fire
Engineer, who is off-duty as a result of an on the job injury
was reviewed by the City Manager. It was the recommendation
of the City Manager the request be granted.
On a motion by Councilman Banker, seconded by Councilman Smalley,
it was unanimously carried an extension of sick leave be granted
to Ernest Hatton until November 30, 1963.
The policy of extending sick leave beyond the amount normally
earned under any conditions was discussed and the City Manager
was instructed to review the entire sick leave policy and to
bring the matter back for Council discussion at an early date.
APPROVED CHAMBER OF COMMERCE
REQUEST RE. CHRISTMAS
DECORATING PROGRAM
A request by the Chamber of Commerce to begin the Christmas
decorating program a week before Thanksgiving was approved
by the Council.

The Council gave approval to a request by the Junior Chamber of
Commerce for permission to hold their annual Seat Belt Clinic
on Seminary Avenue November 16th and 17th or 23rd and 24th,
depending on weather conditions.

ASSOC. REQUEST CONCERNING

DISTRESSED AREA
A letter from the Mendocino County Contractors' Association
was read by the City Manager which requested that efforts be
made by the City to have the "Distressed Area" classification
assigned by the Federal Government to Mendocino County removed.
In discussing this request, the Council generally agreed that
due to certain benefits derived from this classification no
action should be taken'on this request without thorough in-
vestigation.
JOINT MEETING WiTH PLANNING COMMISSION
POSTPONED UNTIL NOVEMBER 15, 1963
The City Manager informed the Council that the joint meeting
with the Planning Commission to discuss the Proposed Zoning
Ordinance originally scheduled for November 7th has been
postponed until November 15th at 8:00 P.M. in order that
Fred Barber, Planning Consultant, can be in attendance.
POLICY RE. REPAIR OF DAMAGED
SIDEWALKS DISCUSSED
The City Manager informed the Council that a project to repair
damaged sidewalks is under consideration by the Engineering
Department for this winter and pointed out that approximately
$2,OO0 was included in the budget to cover the portion which
is considered to be City responsibility. It was pointed out
that much of the damage in residential areas is due to trees
whose roots have lifted the sidewalks.
The Council was requested to establish a polity concerning the
responsibility of the City and owners in connection with
repair of sidewalks and it was generally felt damage which
results from trees in the street right of way should be
repaired by the City, and that the owners should be responsible
for any damage from trees on private property.

Councilman Wagner enquired as to the status of the street
renumbering project along Helen Avenue. The City Manager
requested that he be allowed an additional week before
presenting the program to the Council.

Councilman Banker requested the City Attorney to prepare
an opinion regarding the possibility of bringing action be-
fore the Public Utilities Commission to obtain natural gas
in this area. The City Attorney agreed to prepare the re-
quested opinion.

COUNCILMAN RUNKEL
Councilman Runkel enquired as to why the Davis property
adjacent to the City limits on North State Street cannot be
annexed to the City and was informed that the owner does not
desire to have the property annexed. It was also pointed out
that the property is not an I'island" within the city, due to
the fact that the State Highway fronting it is not within
the City limits.
ADJOURNMENT
As there was no further regular business, the meeting was
declared adjourned at 9:41 P.M.
