HomeMy WebLinkAboutMin 11-13-63MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH NOVEMBER .!3~ !963 The City Council convened in regular session in the Council Chambers at 8'02 P.M. with Mayor Runkel, Councilmen Wagner and Smalley present. Councilmen Buxton and Banker were absent. APPROVAL OF MINUTES On a motion by Councilman Smalley, seconded by Councilman Wagner, it was unanimously carried the minutes of November 6, 1963 be approved as submitted by the Clerk. PUBLIC HEARING RE. PROPOSED ANNEXATION NO. 64-1 (COOPER ANNEXATION)... Public hearing was declared open by Mayor Runkel at 8:04 P.M. on proposed Annexation No. 64-1. The City Attorney placed on file the required affidavits of publication and the inspection of the records of the Mendocino County Recorder as to the number of registered voters who reside within the territory proposed to be annexed. As there was no one present requesting to be heard on the matter, public hearing was declared closed at 8:07 P.M. On a motion by Councilman Smalley, seconded by Councilman Wagner, it was unanimously carried the City Attorney be authorized to prepare the necessary ordinance approving Annexation No. 64-1 to the City of Ukiah. ADOPTION OF POLICY REGARDING RESPONSIBILITY FOR SIDEWALK MAINTENANCE The City Attorney distributed and reviewed a memorandum to the Council dated November 8, 1963 outlining the procedures for en- forcing the construction of sidewalks and curbs. Copies of previous memoranda to the Council dated April 27, 1962 and to the City Manager dated December 4, 1959 were also reviewed. COUNCILMAN BUXTON ARRIVED AT THIS POINT IN THE MEETING - 8'.15 P.M. The Council discussed in detail the responsibility for payment for the repair of defective sidewalks as well as the need for construc- tion of sidewalk where none now exists. On a motion by Councilman Wagner, seconded by Coundilman Smalley, it was unanimously carried the City Council adopt a policy on sidewalk repair that the City stand the cost where damage pri- marily results from some action of the City or City operation, or the growth of trees within the City right of way, and that the property owner shall be responsible for other conditions existing, including wear and tear or damage to the sidewalk from other reasons. RESOLUTION NO. 64-23 GRANTING VARIANCE TO DR. ROY M. SWAIN On a motion by Councilman Smalley, seconded by Councilman Wagner, it was unanimously carried Resolution No. 64-23 be adopted and the Mayor and Clerk be authorized to sign same "Resolution Granting Variance to Dr. Roy M. Swain." COUNCILMAN BANKER ARRIVED AT THIS POINT IN THE MEETING - 8:52 P.M. 373 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH NOVEMBER 1~, 1963 - PAGE 2 CITY ATTORNEY REPORTS ON DISPOSITION OF VARIANCE APPLICATION NO. 6z~-8 JOE H. MAYFIELD The City Attorney advised the Council that it was his deter- mination Ordinance No. 523 provided the correct procedure for permitting construction on a site not fronting upon a public street. Mr. Irish further stated that an Owners Agreement To Maintain Private Roadways and a Grand and Dedica- tion of a Public Utility Easement have been prepared and given to Mr. Mayfield to obtain the required signatures, after which the Agreement will be presented for Council approval. AUTHORIZED CALL FOR BI DS FOR ONE REPLACEMENT STATION WAGON On a motion by Councilman Buxton, seconded by Councilman Smalley, it was unanimously carried the Clerk be authorized to call for bids for the furnishing of one replacement station wagon, bids to be opened at 2:00 P.M., December 3, 1963. APPROVED RENUMBERING OF STREET ADDRESSES ALONG HELEN AVENUE The City Manager explained the fact that the renumbering of S. Helen Avenue had reached the point where a determination was required by the Council regarding the procedure to be followed. The City Attorney explained that while public hearings were not required, there was a provision in the law which provides that the Planning Commission handle a situation of this type by study, public hearings and recommendation to the City Council. It was also explained by the City Manager that the recommendation made regarding this particular area did not constitute a change in the City's basic numbering system but merely a correction of misnumbering which had occurred over a many year period. After discussion, it was moved by Councilman Buxton, seconded by Councilman Wagner, and unanimously carried the City Manager and City Attorney be instructed to proceed with the renumbering of South Helen Avenue as proposed. PROPOSED SITE FOR NEW FI RE HOUSE The City Manager distributed for Council review sketches of a parcel of land on S. Main Street which is being proposed as a site for construction of the fire house. Mr. Cast stated the location has been discussed with the Board of Fire Underwriters and that it meets with their approval. A specific proposal will be presented to the Council at the next meeting. COUNCILMAN BUXTON Councilman Buxton enquired as to the date on which the joint meeting with the Planninc Commission to discuss the Proposed Zoning Ordinance will be held and was informed that this meeting will be adjourned to November 15th at 7:30 P.M. for this .purpose. COUNCILMAN BANKER Councilman Banker asked the City Attorney if the material concerning the possibility of bringing natural gas to the area is being gathered and was informed by Mr. Irish that he is in the process of preparing the requested opinion. MINUTES OF THE MEETING CF THE COUNCIL OF THE CITY OF UKIAH NOVEMBER 13~ 1963 - PAGE 3 The City Manager reported that he and the City Attorney attended a meeting of the County Board of Supervisors at which the subject of Supervisorial Redistricting was discussed and that the Board deferred their decision as to whether or not redistricting will be adopted until December 17th. Mr. Cash stated that a recommenda- tion concerning redistricting in the Ukiah area is being prepared by his office and will be presented for Council approval at the next meeting.
