HomeMy WebLinkAboutMin 11-15-63MINUTES OF THE JOINT ADJOURNED MEETING OF THE COUNCIL AND THE PLANNING COMMISSION OF THE CITY OF UKIAH - NOVEMBER 15, 1963 The joint adjourned meeting of the Council and the Planning Commission was called to order by Vice Mayor Banker at 7:45 P.M. with Councilmen Wagner and Buxton present. Councilmen Runkel and Smalley were absent. Members of the Planning Commission present were Chairman Russell Clarke, Donn Weaver, Jack Simpson, E. J. Bean, Walter George and A. S. Kruth, City Engineer. Mr. Fred Barber, Planning Consultant was also present. CITY CLERK TO RECORD MINUTES FOR CITY COUNCIL AND PLANNING COMMISSION Members of the City Council and Planning Commission agreed that the City Clerk act both as Clerk of the Council and as recording secretary for the Planning Commission, and that any minutes taken will be joint minutes of each body. STUDY SESSION REGARDING PROPOSED ZONING ORDINANCE For the purpose of this meeting the topics of discussion were confined to the protests which were formally made at the public hearings held in regard to the Proposed-Zoning Ordinance. All details of each individual protest were discussed at length with the opinion of the City Council, Planning Commission and Planning Consultant being considered in each case. Following are the principal points of discussion' l) Orchard Villac~e area. The areas discussed were the south- east corner of Orchard Ave., and E. P~rkins St. which is proposed to be zoned C-N (Neighborhood Commercial) and the northeast corner of Orchard Ave. and E. Gobbi St. which is proposed to be zoned R-3. The problems of development of an area of this type were reviewed with the opinions of all parties being considered and it appeared to be~generally agreed that the already developed R-1 area on the west side of Orchard Ave. had placed a reasonable protest against anything other than residential development being permitted on the east side of Orchard Ave., with any proposed commercial development to be either eliminated or confined to the property nearer the freeway. It was specifically pointed out that there were reasonable objections, in this case, to the types of land uses allowed in both the C-N and the R-3 zones. 2) The possible shortage of R-2 (Multiple Dwelling) area generally west of State Street was discussed and the majority of opinions expressed appeared to be favorable to taking any reasonable corrective steps as amendments after adoption of the ordinance. 3) The Joe Foutz property at E. Perkins and Warren Dr. was discussed with it being pointed out that Mr. Foutz felt that an error had been made in the zoning presently in effect which con- flicted with his understanding of the zoning which was approved by the Council with the adoption of his subdivision map. It was pointed out that a commercial zone on the southeast corner of this inter- section would permit a far greater scope of activities than what Mr. Foutz proposed to use the land for, and the possibility of cor- recting his problem by the variance procedure or later zone change was discussed. COUNCILMAN SMALLEY ARRIVED AT 8:06 P.M. MINUTES OF THF JOINT ADJOURNED MEETING OF THE CO~JNCIL AND. THE PLANNING COMMISSION OF THE CITY OF UKIAH - NOVEMBER 15~ 1963 - PAGE 2 4) The area on the southwest corner of Washington Ave. and S. State St. was discussed in detail in relation to the following points' I a) The proposed R-3 zoning on the rear of the property would tend to restrict the property more than the restrictions presently in effect. b) The R-3 zone proposed would tend to be beneficial in serving as a buffer between presently developed R-1 property on Cresta Dr. and Highway Commercial activities. c) The proposed zoning might tend to restrict the saleability of the entire parcel of land. d) R-3 use of th9 rear of this parcel might conflict with existing development to the north and south. 5) The reason for zoning City owned property in a manner which appears to conflict with the Cityls use of the property was dis- cussed in detail and it was determined that since the ordinance specifically excludes the City from zoning requirements, that the intent is to zone City-owned property in harmony with surrounding privately owned property. This type of zoning would be effective only in cases where City land was disposed of for private use. 6) Mr. Barber brought up the fact that he had received a letter rom the Pacific Telephone and Telegraph Co. in which they requested certain inclusions be in the ordinance pertaining specific- ally to operation of their telephone system. He generally expressed the feeling that while he was agreeable to the proposal made by them, there were many other methods by which the requirements of the Telephone Co. could be met. The Chairman of the Planning Commission requested that if after further discussion by the Council the Ordinance and Zoning Map were referred back to the Planning Commission, that the City Council be specific in its recommendations for any changes which they wish to have considered further by the Commission. It was generally agreed that this.would be the procedure. The Mayor Pro Tem commended the Planning Commission and public for the quality and volume of work which has been accomplished to date and expressed the thanks of the City Council for the cooperation which has existed from both the Commission and public throughout the 2-1/2 years of preparation of the plan. It was specifically pointed out that in relation to the extent of the plan developed by the efforts of the Planning Commission, the small number of protests indicated the soundness of the bases used in its preparation.
