HomeMy WebLinkAboutMin 11-20-63370 MINUTES OF THE MEETING OF THE COUNCIL~OF THE CITY OF'UKIAH N_OVEMBER 20, 1963 The City Council convened in regular session in the Council Chambers at 8:00 P.M. with Mayor Runkel, Councilmen Wagner, Buxton, Banker and Smalley present. APPROVAL OF MINUTES On a motion by Councilman Wagner, seconded by Councilman Smalley, it was unanimously carried the minutes of November 13, 1963 and the adjourned meeting cf November 15, 1963 be approved as sub- mitted by the Clerk. APPROVAL OF PAYROLL WARRANTS On a motion by Councilman Buxton, seconded by Councilman Wagner, it was unanimously carried Payroll Warrants for the period of November 1st through 15th, 1963 be approved in the amount of $31,214.33. APPROVAL OF GENERAL WARRANTS On a motion by Councilman Banker, seconded by Councilman Smalley, it was unanimously carried General Warrants in the amount of $79,574.04 be approved and ordered paid. RES. NO. 64-24 FINDING THAT MAJORITY PROTEST HAS NOT BEEN MADE (ANNEXATION 64-1). On a motion by Councilman Smalley, seconded by Councilman Wagner, it was unanimously carried Resolution No. 64-24 be adopted and the Mayor and Clerk be authorized to sign same "Resolution Finding that Majority Protest Has Not Been Made (Annexation 64-1).': ORDINANCE NO. 557 APPROVING ANNEXATION NO. 64-1 - INTRODUCED Ordinance No. 557, "An Ordinance Approving the Annexation of Certain Uninhabited Territory, Designated 'Annexation 64-1' To The City of Ukiah" was read in full by the City Attorney and introduced by Councilman Wagner. LITIGATION FILED AGAINST CITY BY WALTER LEMMERZ (WHITE COTTAGE CAFE) The City Atto:rney advised the Council tLat litt, gation has been filed against the City by ~Valter Lemmerze for damages from an alleged low voltage situation at the White Cottage Cafe. Mr. Irish noted that a claim previously submitted by Mr. Lemmerz was rejected by the Council. According to the City Attorney the Electric Department has checked into the matter thoroughly and finds no merit to the claim. COUNCIL APPROVES PLAN FOR SUPERVISORIAL REDISTRICTING The City Attorney gave a report on the proposed supervisorial redistricting plan. After explanation of the plan to the Council, 'the Council was in unanimous agreement that the plan was an equit- able one and should be presented to the Board of Supervisors as the City's proposed plan for redistricting. NO. 64-25 URGING BOARD OF SUPERVISORS TO CONSIDER REDISTRICTING OF SUPERVISORIAL DISTRICTS AT NOV. 26th MEETING On a motion by Councilman Smalley, seconded by Councilman Buxton, it was carried by the following roll call vote that Resolution No. 64-25 be approved and the Mayor and Clerk authorized to sign same "Resolution Urging Board of Supervisors to Consider Redistric- ting of Supervisorial Districts At November 26th Meeting." AYES: Councilmen Wagner, Buxton, Banker, Smalley and Runkel. NOES: None ABSENT: None. On a motion by Councilman Wagner, seconded by Councilman Banker, it was unanimously carried the City Manager and City Attorney be instructed to present the City's proposed plan for supervisorial redistricting to the Board of Supervisors and urge that they give it serious consideration. COUNCILMAN SMALLEY WAS EXCUSED AT THIS POINT IN THE MEETING - 8:50 P.M. PROPOSED INCREASE IN ~AXICAB RATES APPROVED. The City Manager read a letter from Mr. Lawrence Pacini, operator of the Ukiah Taxicab Company, requesting Council approval of an overall 20% increase in taxicab rates. Mr. Cash distributed copies of a proposed rate schedule for points lying outside the City zoned areas for Council review. It was pointed out that no increase in rates has been granted since 1958. Mr. Pacini was present and also requested the Council approve an additional charge of I0¢ for each zone crossed in its entirety while making a delivery. This proposal was discussed at length but the Council generally agreed that due to the method by which the rates are computed within the zoned area this additional charge is not justified. On a motion by Councilman Banker, seconded by Councilman Buxton, it was. unanimously carried the City Council adopt the proposed taxicab rate schedule with the correction that cruising time or waiting time be on a per hour basis, and that these rates are in the approximate amount of a 20% increase. PROPOSED ZONING ORDINANCE RETURNED TO PLANNING COMMISSION FOR RECONSIDERATION At this point Mayor Runkel turned the remainder of the meeting over to Vice Mayor Banker. Individual members of the Council expressed the following opinions concerning areas of the Zoning Map which produced objections during public hearings on the ordinance: Councilman Buxton: l) The Antoni property at the southwest corner of Washington and S. State St. should remain all in one zone comparable to the present C-1 zone. 2) In the Orchard Village area, agreed with adjacent residents opposed to the C-N district at Orchard and E. Perkins to the extent that if the working includes drive-in restaurants or bars, such working of this section should be changed. If it is the general 376 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH NOVEMBER 20, 1963 - PAGE 3 proposal of commercial development at this location which concerns the residents, he would like to see development similar to the Montgomery Village shopping area in Santa Rosa. If the Planning Commission and residents feel it i's feasible to have a residential buffer zone along Orchard Ave. and a commercial zone adjacent to the freeway, he would agree. 3) Agreed with objections to trailer parks within the R-3 zone at Orchard and E. Gobbi Street. 4) If the Joe Foutz property at Warren Dr. and E. Perkins St. is zoned C-N as requested by the owner, he would see no objection to C-N zoning at the southwest corner of Perkins and Orchard Ave. Councilman Buxton also expressed the desire to go on record as commending the Planning Commission for the fact that in view of the magnitude of the project of preparing this ordinance, there have been only two areas which have been questioned. Councilman Wagner: l) Regarding intersections at E. Perkins St. and Orchard Ave., and E. Gobbi St. and Orchard Ave., he felt that as a minimum there should be a buffer strip of either R-1 or R-2 along the east side of Orchard Avenue. 2) The Anotni property at Washington and S. State St. should remain zoned in its entirety under the proposed ordinance as C-2. 3) That use of the Foutz property according to the'owner's present plan can be handled under the variance procedure. Councilman Banker.. l) Believed reasoning valid as far as the Orchard Village residents desire for a residential buffer zone along Orchard Ave. between E. Gobbi St. and E. Perkins St. is concerned. 2) The Antoni property should remain in a zone equivalent to its present zone. 3) Regarding Foutz property at Warren Dr. and E. Perkins St., he felt that in his opinion we are dealing with land use and not the plans of an individual property owner, and that in view of all of the points which had been discussed, the pro- posal to utilize this area for commercial purposes should be done by application for a zone variance at the time specific development'is under consideration. On a motion by Councilman Buxton, seconded by Councilman Wagner, it was unanimously carried the Proposed Zoning Ordinance and Zoning Map be returned to the Planning Commission and that'the Planning Commission be instructed to reconsider the same so as to change the zoning districts at the following locations in general conformance with the views of the Council set out above: l) Corner of E. Perkins St. and Orchard Ave. shown as C-N. 2) The corner of E. Gobbi and Orchard Ave. shown as R-3. 3) The Antoni property at the southwest corner of Washington and S. State Streets. Upon request, Mr. Phillip Lowell was recognized to inform the Council that the residents of Orchard Village regarded the pro- posal of a buffer zone along Orchard Ave. only as a compromise to their general objection to any commercial zoning in the vicinity of the freeway in this area. REFUSE TO SIGN CONTRACT FOR FUR- NISHING DISTRIBUTION TRANSFORMERS AS BID The City Manager reported that he had received a telephone call from a representative of the Phillips and Edwards Electric Co. advising the'City that we would receive a letter formally refusing to sign the contract for the furnishing of transformers as bid. The company's representative stated that the letter would be received by personal delivery on Thursday, November 21st. On the basis of the information received it was recommended that a bid call be approved by the Council on the same specifications as previously used for opening on December 10, 1963 at 2:00 P.M. After an explanation of the legal position of the City by the City Attorney, the following action was taken. APPROVAL OF SPECIFICATIONS AND AUTHORIZATION TO CALL FOR BIDS 14 DISTRIBUTION TRANSFORMERS FOR On a motion by Councilman Wagner, seconded by Councilman Runkel, it was unanimously carried the City Clerk be authorized to call for bids for the furnishing of 14 distribution transformers of various sizes according to the specifications used in the previous bid call, bids to be opened December 10, 1963 at 2:00 P.M.
