HomeMy WebLinkAboutMin 12-04-63MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH DECEMBER 4, 1963 The Council convened in regular session in the Council Chambers at 8..OO P.M. wi th Mayor Runkel, Councilmen Buxton, Banker and Smalley present. Councilman Wagner was absent. APPROVAL OF MINUTES On a motion by Councilman Banker, seconded by Councilman Smalley, it was unanimously carried the minutes of November 27, 1963 be approved as submitted by the Clerk. APPROVAL OF PAYROLL WARRANTS On a motion by Councilman Banker, seconded by Councilman Buxton, it was unanimously carried payroll warrants for the period of November 16th through 30th, 1963 be approved in the amount of $31,161.23. APPROVAL OF SPECIAL WARRANTS On-a motion by Councilman Smalley, seconded by Councilman Banker, it was unanimously carried special warrants in the amount of. $7,O64.40 be approved and ordered paid. LEAGUE OF CALIF. CITIES REQUEST COUNCIL SUPPORT OF PROPOSED LEGISLATION - HR 5845 The City Attorney informed the Council that the League of California Cities has requested the Counci's support of HR 5845, a measure pending before the Federal Congress which would allow commercial banks to deal in revenue bonds. COUNCILMAN WAGNER ARRIVED AT THIS POINT IN THE MEETING - 8:07 P.M. After some discussion the Council agreed to defer action on this request until further information can be obtained on the possible effects of such legislation. JOE H. MAYFIELD - GRANT AND DEDICATION OF PUBLIC UTILITY EASEMENT; OWNERS AGREEMENT TO MAINTAIN PRIVATE ROADWAY The City Attorney reviewed a Grant and Dedication of Public Utility Easement by Joe H. Mayfield and Diane K. Mayfield and requested Council approval of an Owners Agreement To Maintain Private Roadways between the Mayfields and the City. Mr, Irish also informed the Council that at the request of the other owners using this road, another agreement is being prepared setting forth a definite proration of costs for maintenance of the right of way which will supercede the first agreement. On a motion by Councilman Wagner, seconded by Councilman Banker',' it was unanimously carried the City enter into an agreement with Joe H. Mayfield and Diane K. Mayfield for maintenance of a private roadway, and the Mayor and Clerk be authorized to sign same, "Owners Agreement to Maintain Private Roadway.'l DISCUSSION REGARDING LIABILITY INSURANCE The City Manager informed the Council that he had been advised by the local agent for the'City's liability insurance that the carrier desires to be relieved of all obligation effecting midnight, December 31st, 1963 instead of January l, 1966. The local insurance representative has been working for approxi- mately one month in an effort to find'a company which was agree- able to carrying the primary coverage and has determined there would be no problem in placing the excess coverage up to the existing $1,O00,OOO limits. The Council was advised that the MINUTES OF THE MEETING OF THE COUNCIL OF THE CiTY OF UKIAH DECEMBER 4, 1963 - PAGE 2 servicing agent had located only one company which was agreeable to carrying the primary coverage under any conditions and this shortage of interest was a direct result of major catastrophes such as those that occurred in Reno and Indian- apolis. The only basis on which any company would accept the primary coverage would be conditions on the Company being awarded all other City liability insurance and would be limited to limits of $25,000/$25,0OO/$25,OOO with all excess from $25,000 to $1,OOO,OO0 being covered by some other company. The estimated annual cost for the primary coverage under this type of program would be an initial premium of $35,O00 with a deposit in escrow of an additional $17,500 and a premium for excess coverage of approximately $15,OOO. The premium deposited plus the amount in escrow would be the maximum total premium per year with a possible downward adjustment of the $35,000 premium in case of one year of good experience. One other program which was discussed was the possibility of the City guaranteeing full payment and full handling of any claims up to $50,OOO for the liability connected with the gas system alone. The excess from $50,000 to $1,OOO,OOO for the gas system alone would be approximately $12,OOO with all other liability insurance for City operations remaining on a basis similar to what is presently in effect at a total estimated annual combined cost of approximately $30,000 to $35,000 with the possibility of the City paying claims up to $50,000 eash. Inasmuch as the figures presented were estimates only and there was some confusion as to the types of insurance available, the City Manager was instructed to obtain more factual in- formation and to report to the Council, if possible, at the next meeting. SPECIAL CENSUS The City Manager advised the Council that in an attempt to qualify for increases in various tax allocations, he would recommend that a special census be conducted at this time. Mr. Cash explained this can be obtained either through the Department of Commerce, Bureau of Census at a cost of $2,200, or the State Department of Finance for a cost of $220. According to Mr. Cash the results obtained by the latter agency would not affect the official Federal census, but would be sufficient for the City's purpose and could be conducted in a shorter period of time. On a motion by Councilman Smalley, seconded by Councilman 'B"U'×ton, it was unanimously carried the City Manager be authorized to engage the services of the State Department of Finance to conduct a special census. COUNCILMAN BANKER Councilman Banker commented on the need for street repair where the railroad crosses Brush St. and was informed that since this is not within the City limits the problem has been referred to the Northwestern Pacific Railroad Co.
