Councilman Buxton was absent. APPROVAL OF MINUTES On a motion by Councilman Norgard, seconded by Scotto, it was unanimously carried the minutes 1964 be approved aS submitted by theClerk. Buxton On a motion by Councilman Scotto, seconded by Councilman Norgard, it was unanimously carried Resolution No. 64-50 be adopted with the inclusion of the name of Ralph I. Buxton, and the Hayor and Clerk be authorized to sign same, "Resolution Appointing Ralph I . Buxton Alternate Di rector of Ukiah Valley Sanitation District." MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH MAY 6, 1964. - PAGE 2 PROPOSED SUPPLEMENTAL AGREEMENT; NO. BAY COOPERATIVE LIBRARY SYSTEM The City Attorney distributed for the Council's information an opinion which he had prepared relative to the proposed execution by the City of the North Bay Cooperative Library System Supplemental Agreement. It was the City Attorney's opinion that under the present ci rcumstances execution by the Council would be improper because several other members of the system had caused their executions to be done by other than the governing boards of their agencies. The City Attorney stated that he had discussed this with Mr. John Klein, City Attorney of Santa Rosa who is acting as counsel for the System, and that Mr. Klein stated there was a possibility that other members who had not signed by their governing boards would be asked to do so prior to the next meeting of the Council. It was the City Attorney's recommendation that further action on the proposed contract be postponed for one week and that if all, or substantially all of the members had ratified the contract by their governing bodies he would have no objection to the execution by the City Council of the proposed ag reemen t. On a motion by Councilman Smalley, seconded by Councilman Norgard, it was unanimously carried action relative to the proposed North Bay Cooperative Library System Supplemental Agreement be postponed until the next regular meeting of the Council . PETITION REGARDING SPEEDING ON NO. STATE ST. REVIEWED A petition signed by 55 residents and property owners requesting an investigation of speeding on No. State Street north of the City l imi ts was presented and read by the City Manager. Mr. Cash recommended that since the City had al ready contacted the State regarding this problem, and that the area involved is outside the City limits, the petition be forwarded to the State wi th a copy to the County Board of Supervisors. The City Engineer reported that a channel ization study has just been completed by the State, and that further studies in the area will be made before they will be ready to make a report on the problem. Mr. Kruth also stated that it was the opinion of the State Traffic Engineer that adequate signing and close policing of the area would be the only effective way to reduce the speeding. On a motion by Councilman Smalley, seconded by Counci 1man Scotto, it was unanimously carried the City Manager be instructed~ to transmit copies of the petition entitled "Request for More Adequate Traffic Control, North State Street, at Freeway Ramp and Southerly" to the State Division of Highways and the County Board of Supervisors. REPORT ON MEETING WI TH P.G. & E. RE. NATURAL GAS The Council was advised that at the meeting held last week with officials of Pacific Gas & Electric Co. relative to develop- ment of natural gas it was agreed by both parties concerned that the following steps must be taken before theCouncil can evaluate any proposal regarding the project. l) Inventory and appraisal of City Gas system and plant, to be done jointly by City and P.G. & E. 2) Some formal action by the Council in the very near future which would indicate to P.G. & E. the City's agree- ment to sell the gas system to them if specific requirements of the City are complied with. The City Attorney and P.G. & E.'s Attorney wi l l attempt to arrive at a wording of a resolution for consideration by the Council which would not commit the City in case the requirements are not met and would protect the City's posi ti on. MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH MA~. 6, 1964 - PAGE 3 FURTHER DISCUSSION REGARDING ANTON STADIUM CONCESSION The City Manager reported that since the last discussion regarding operation of the concession at Anton Stadium, he had been contacted by two college students who are interested in operating the concession during the summer months only. At this point, Mayor Banker asked that the record show that Councilman Norgard had disqualified himself from discussion on this matter due to a conflict of interest resulting from his membership on the High School Board of Trustees. In discussion, it was agreed opera ti on of the concession the only action which can be indication of the Council's present contract on June 30, that since there is a contract for in existence at the present time, taken at this time would be an intentions upon expiration of the 1964. On a motion by Councilman Buxton, seconded by Councilman Smalley, it was unanimously carried the City Manager be authorized to call for informal proposals for the furnishing of concession services at Giorno Park and Anton Stadium on an annual basis. LETTER REGARDING ALASKAN EARTHQUAKE The City Manager read a let League of California Cities letter from the City Manage City Manager of San Leandro economic assistance in seve ter from Howard Gardner of the which accompanied a copy of a r of Fairbanks, Alaska to the urging publici ty of the need for ral Alaskan communities following the recent earthquake disaster. All members of the Council felt that the letters should be referred to all local news media for the desi red publicity and the City Manager agreed to have copies of the letters made for this purpose. It was reported City Attorney had checked the proposals and found points which would require further investigation. It was the recommendation of the City Manager that further information should be obtained before a decision is made on this proposal, and that other activities to bring natural gas to the area in which the City is involved should not be delayed by these proposals. On a motion by Councilman Norgard, seconded by Councilman Smalley, it was unanimously carried the City Manager and City Attorney be instructed to further investigate the proposal of James F. Whitehorn relative to natural gas and report to the Council at a later meeting. VARIANCE APPLICATION NO. 64-14 A. P. MATHEWS - DEER-PROOF FENCE AT 906 NO. OAK STREET Variance Application No. 64-14 by A. P. Mathews, plot plan and minutes of the Planning Commission meeting held Apri 1 16, 1964 were reviewed by the City Manager. The proposed variance would permit construction of a deer-proof fence on property located at 906 N. Oak Street. It was the recommendation MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH MAY 6, 1964 - PAGE 4 of the Planning Commission that the variance be granted according to the following specifications: 'lthe height of said fence, exclusive of the barbed wi re extension at the top, to be 8 feet on the west si de of the property, the remainder of the fence to be 6 feet, as outlined on the accompanying plot plan." Mr. Mathews was present on behalf ofthe application, and there were no written or verbal protests to the proposed variance. On a motion by Councilman Buxton, seconded by Councilman Smalley, it was unanimously carried the City Attorney be instructed to prepare a resolution granting Variance No. 64-1~+ to A. P. Mathews as recommended by the Planning Commission and subject to all standard conditions. SHELL OIL CO. - CANCELLATION OF PRESENT L IQU. ID PROPANE CONTRACT AGREEMENT The City Manager read a letter from Shell Oil Company advi sing that they were exercising their option to cancel the present one year contract agreement for furnishing the City's Liquid Propane requirements. The expiration date will be June 30, 1964 and prior to that time a Shell represen.tative will con- tact the City Manager to negotiate a basis for a new contract. The City Manager also reported having contacted two other suppliers with whom there is possibility of the City coming under their corporate insurance program for a slight net savings in combined cost for gas and insurance as compared to what is now being paid. After discussion, it was decided the bid call for the 1964-65 fiscal year Liquid Propane requirements contain an alternate proposal which, in general, would be a combination of Liquid Propane and Liability insurance for all of the City's gas plant and system operation. SALES TAX RECEIPTS FISCAL YEAR TO DATE The City Manager reported that Sales Tax receipts for the fiscal year to date have been $192,189.00 compared to a total of $165,727.00 for the same period last year. If the present trend continues it is expected that the total for the enti re year will exceed that of 1962-63 by approximately 10%. LETTER FROM F.A.A. REGARDING DRAG RACING ON AIRPORT The City Manager read a letter from the Federal Aviation Agency to the Airport Commission relative to auto racing events on the Airport. Following is the position of the F.A.A. as stated in the letter: "l. It is the determination of the FAA that the closure of any airport for non-aeronautical activities such as auto racing is inconsistent wi th the conditions of the AP-4 Agreements under the DLAND Program of 1938 - 4~+ and the Grant Agreement Contracts under the Federal Aid Airports Programs of 1946-6~+. 2. The sanctioning of auto racing of the type you indi- cated in your letter of April 29th, would be considered as a default in the contractual agreements now in effect between the City and the U.S." MINUTES OF THE MEETING OF MAY 6, 1964 - PAGE 5 THE COUNCIL OF THE CITY OF UKIAH LETTER FROM DIRECTOR OF CIVIL DEFENSE REGARDING NEAR WARNING SYSTEM The City Manager reviewed a letter from the Director of Civil Defense relative to the NEAR warning system advising the City that no action on the part of any uti l ity would be required and that there would be additional tests during the summer of this year. ASSOC REQUE AT SM I ATION FOR RETARDED CHILDREN ST FOR LEASE OF CITY BUILDING I TH & MASON STS. On behalf of the Association for Retarded Children, Mr. R.~ymond Hudson requested the Council consider leasing the Ci ty-owned building at Smith and Mason Streets for operation of a thrift shop type business sponsored by the Association. Mr. Hudson was instructed to contact the City Manager, City Attorney and Di rector of Public Works for assistance in preparing a formal proposal for the Council's considera- tion. COUNCILMAN NORGARD COUNC FROST WARNING SERVICE: Councilman Norgard brought up the need for a weather representative in the area to warn the farmers during the frost season. Although the Board of Supervisors have budgeted the requi red matching funds, no action has been taken by the local representative in Congress on the request submitted by the Farm Advisor for this service. All members of the Council agreed the service should be provided in the area. On a motion by Councilman Norgard, seconded by Councilman Buxton, it was unanimously carried the City Manager be instructed to write letters to our Congressman and Senator stating the position of the City on the frost warning system. I LMAN SCOTTO Councilman Scotto commented on the congestion created on W. Standley Street at School St. by the traffic moving from the Savings Bank parking lot and drive-in banking area, and suggested that perhaps removal of the parking meters by the Rascoe store may relieve the si tutation. The City Manager pointed out that a meeting of the Traffic Engineer Committee is to be held this Friday and this problem had been scheduled for consideration at that time.
