MAY 27, ]964.
The City Council convened in regular session in the Council
Chambers at 8:00 P.M. with Mayor Banker, Councilmen Norgard,
Buxton and Scotto present. Councilman Smalley was absent.
APPROVAL OF MINUTES
:
On a motion by Councilman Norgard, seconded by Councilman
Buxton, it was unanimously carried the minutes of May 20, 1964
be approved as submitted by the Clerk.
JAMES DEANE SMITH - CLAIM
FOR DAMAGES DENIED
A claim for damages by James Deane Smith in the amount of $5.95
was reviewed by the City Attorney. Claimant alleges that a
pair of pants were permanently stained when he sat on a freshly
painted park bench on which there was no sign stating the paint
was fresh.
On a motion by Councilman Buxton, seconded by Councilman Norgard,
it was unanimously carried claim for damages by James Deane
Smith in the Amount of $5.95 be denied.
WALTER TERKELSEN - CLAIM
FOR DAMAGES DENIED
A claim for damages by Mr. Walter Terkelsen in the amount of
$35,240.15 was reviewed by the City Attorney. Claimant alleges
he sustained permanent injuries when a building canopy collapsed
at 656 S. State St. on February 25, 1964.
On a motion by Councilman Scotto, seconded by Councilman Buxton,
it was unanimously carried claim for damages by Mr. Walter
Terkelsen in the amount of $35,240.15 be denied.
RES. NO. 64-54 APPOINTING
LINTON NORMAN TO PLANNING COMMISSION
On a motion by Councilman Scotto, seconded by Councilman Norgard,
it was unanimously carried Resolution No. 64-54 be adopted,
and the Mayor and Clerk be authorized to sign same, "Resolution
Appointing Member to the Planning Commission."
ORDINANCE NO. 559 REGULATING TERMS OF
MEMBERS OF COMMISSIONS AND BOARDS
INTRODUCED
Ordinance No. 559 Regulating Terms Of And Providing For Vacancies
For Absence of Members of Commissions and Boards was read in fu¥1
by the City Attorney and introduced by Councilman Buxton.
SPECIAL WARRANTS
On a motion by Councilman Buxton, seconded by. Councilman Norgard,
it was unanimously carried special warrants in the amount of
$10,907092 be approved and ordered paid.
VARIANCE APP. #64-15: ROBT. GARZlNI
FURTHER DISCUSSION RE. PROPOSED IM-
PROVEMENT OF BEACON LANE
The City Manager reported that at the Council's request he had
discussed the matter of a proposed joint City and County project
for improvement of Beacon Lane with the Board of Supervisors at
their meeting of May 26th. Action of the Board resulted in the
matter being referred to one of their committes for a report

to be made at their meeting of June 9th. It was reported by the
Manager that the project had been presented to the County with a
total cost estimate of approximately $8,000 and that the share of
the County appeared to be the cost of curb and gutter on the
south side and basing and plant mix pavement of one-half the width
of the proposed street at a total cost to them of $3,000. It was
pointed out that the moving of City-owned utilities would normally
be an obligation of the City and the distribution of the balance
of the cost was yet to be determined.
The Council, after discussion and consideration of all available
information felt that until a report from the County was received
they were not in a position to take action on the application for
variance and that even though individual opinions were expressed
favorable to the proposed development, action was deferred until
the June 10th Council meeting.
The City Manager was also instructed to contact the property owner
on the corner of Beacon Lane and Dora Street to determine his
opinion in regard to the dedication of the required 20 foot ease-
ment wih this matter also to be reported on at the June 10th
meeting.
ASSN. FOR RETARDED CHILDREN
PROPOSED LEASE OF CITY BUILDING
The Council was informed that representatives of the Ukiah Valley
Association for Retarded Children had approved the terms of the
proposed lease agreement for the City owned building at Smith
and Mason Streets and had further agreed to undertake the costs of
plumbing work required for their needs.
TREVIS D. MARSHA - RESIGNATION
FROM AIRPORT COMMISSION
The City Manager read a letter from Trevis D0 Marsha advising the
Council of his resignation from the Airport Commission to becom~
effective at the conclusion of his present term on June 30th, 1964.
REPORT OF TRAFFIC
ENGINEER COMMITTEE
The City Manager reviewed briefly the activities of Traffic Engineer
Committee and the corrections made from the decisions of that Com-
mittee. It was noted that the flow of traffic on W Standley St.
west of School Street has been improved by the chan~es made in that
area.
DIVI$10N OF HIGHWAYS REPLY RE.
ACCIDENT PROBLEM ON SOUTH HIGHWAY
The City Manager read a letter from Sam Helwer, District Manager of
the Division of Highways concerning the conditions on the south
Highway which were felt to have contributed to accidents and outlining
the corrective steps they were taking to eliminate the problem.
REPORT REGAR'DING~' PROGRESS TO
ELIMINATE SPEEDING ON NO. HIGHWAY
It was reported that no further information from the State Traffic
Engineer has been received concerning the speeding problem on No.
State Street north of the City limits. However, the City Engineer
reported that information concerning the exact City limit boundaries
had been given today to representatives of the State Highway
Patrol and that the State has issued an order for additional street
lights to be installed at selected locations in the area under study.

The Council was ~idvised that in connection with the widening
of Oak Street problems of encroachment into the street right
of way had been encountered at the following locations:
l) Steps leading to the Baptist Church - Northwest corner
Oal~. and Smith Streets.
2) Awning of the McCarthy property at the ~Northeast corner
Oak'. and Standley Streets.
3) Two stairways on the Evans property in the 200 block on
the west side of So. Oak Street.
It was pointed out that the matter had been discussed with the
City Attorney and that even though the City has incurred no
responsibility for removal of the encroachments by permitting
them to exist, the Manager recommended that the Council consider
the possibility of a moral obligation without establishing a
precedent on the basis that the church steps have been in their
present location for over 50 years, the stairways on the Evans
property for slightly less than this period of time, and the
awning was constructed approximately 12 to 14 years ago and
at that time complied with all City requirements in all respects.
On a motion by Councilman Buxton, seconded by Councilman
Norgard, it was unanimously carried the City Manager be authorized
to correct the encroachment problems in the widening of Oak
Street in regard to the Baptist Church property, the McCarthy
property and the Evans property as recommended by the City Manager
at a total estimated cost of $900.00
ADJOURNMENT
As there was no further regular business, Mayor Banker declared
the meeting adjourned, after which the Council reconvened in
closed personnel session.
