HomeMy WebLinkAboutMin 08-05-64 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH AUGUST 5, 1964 The City Council convened in regular session in the Council Chambers at 8:01 P.M. wi th Mayor Banker, Councilmen Norgard, Buxton and Scotto present. Councilman Smalley was absent. APPROVAL OF MINUTES On a motion by Councilman Norgard, seconded by Councilman it was unanimously carried the minutes of July 22, 1964 be approved as submitted by the Clerk. Scotto, SPECIAL WARRANTS On a motion by Councilman Scotto, seconded by i't was unanimously carried special warrants in $12,672.54 be approved and ordered paid. Councilman Buxton, the amount of PAYROLL WARRANTS On a motion by Councilman Buxton, seconded by Councilman Norgard, it was unanimously carried payroll warrants for the period of July 16th through 31st, 1964 be approved in the amount of $34,525'24. AGREEMENT On a moti i t was un the Mayor Appo i n t i n Agreement on by Councilman Scotto, seconded by Councilman Buxton, animously carried Resolution No. 65-12 be adopted and and Clerk be authorized to sign same, "Resolution g Director of Finance as Authorized Agent Under O.A.S.D.I. ,Il PLANN OF PR 3 MIL lNG COMMISSION REQUEST FOR REVIEW OPOSED SUBDIVISIONS Wl THIN ES OF CITY LIMITS A letter was read from Donn Weaver, Chairman of the Planning Commission, suggesting a formal request be directed to the County Board of Supervisors that the City Planning Commission be given the opportunity to review all maps of proposed sub- divisions within three miles of the City limits pursuant to Section 11528 of the Business and Professions Code of California. "STEIERT" WATER RIGHT NO. STATE STREET The City Manager briefly reviewed the events leading up to the scheduled discussion of the claimed water rights normally referred to as the "Steiert" water right involving property owned by Mr. McAllister extending from State St. to Pine St. north of N. State St. and Low Gap Rd. It was explained that Mr. McAllis- ter had applied for relocation of his water service from No. Pine St. to No. State Street and had paid the $10 service connection fee. Mr. McAllister informed the City that the re- quested relocation of the point of delivery of his free water service resulted from the sale of approximately the westerly one-half of his property. The Council was advised that based MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH AUGUST 5, 1964 - PAGE 2 on the Manager's interpretation of Mr. McAllister's rights the work order had been cancelled and would remain cancelled unless he agreed to pay the current rate for all water delivered through the new service. The City Attorney reviewed the known history of the claimed water right which dates back to the early 1890' s. It was pointed out to the Council that a complete study had not yet been made and that such a study would require a minimum of one month additional time. COUNCILMAN SMALLEY ARRIVED AT THIS POINT IN THE MEETING - 8:28 P.M. Mr. Charles Mannon, representing Mr. McAllister, reviewed the position of h. is client and stressed to the Council his opinion that the City was obligated to relocate the service and con- tinUe with the delivery of free water. Following discussion by the Council, on a motion by Councilman Scotto, seconded by Councilman Norgard, it was unanimously carried the matter of the Steiert water right be tabled until the meeting of September 2nd, 1964, for further investigation by the City Manager and City Attorney. REQUEST TO CALL FOR BIDS FOR PAVING OF OAK ST.~.. C..LAY ST. TO HENRY ST. On a motion by Councilman Smalley, seconded by Councilman Buxton, it was unanimously carried specifications be approved and the City Clerk be authorized to call for 13ids for the paving of Oak Street, between Clay and Henry Streets, bids to be opened at 2:00 P.M., August 25, 1964. RES. NO. 65-13 ADOPTING ELECTRIC RATES AND SERVICE POLICIES The City Manager reviewed the various schedules contained in the Electric Rates and Service Policies, 1964, previously presented to the Council and explained the changes as they would affect both City customers and those P.G. & E. customers who will soon be on the City system. On a motion By Councilman Scotto, seconded by Councilman Buxton, it''was unanimously carried Resolution No. 65-13 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Adopting Electric Rates and Service Policies." DEDICATION OF WlLLITS AIRPORT The City Manager reported that an invitation has been extended to members of the Council to attend the dedication of the new Willits airport on September 12th and 13th. REPORT ON NO. BAY DIV. LEAGUE OF CALIFORNIA CITIES MEETING AT EUREKA Councilman Scotto distributed copies of a written report of the meeting of the Executive Committee, North Bay Division, League of California Cities held in Eureka on July 25th, and pointed out that the subject~ underground installation of electric facilities was discussed further, with no action taken by the Committee on this matter.
