HomeMy WebLinkAboutMin 09-23-64MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH SEPTEMBER 23, 1964 The City Council convened in regular session in the Council Chambers at 8:00 P.M. with Mayor Banker, Councilmen Norgard, Buxton and Scotto present. Councilman Smalley was absent. APPROVAL OF PAYROLL WARRANTS On a motion by Councilman Buxton, seconded by Councilman Scotto, it was unanimously carried payroll warrants for the period of September 1st through 15th, 1964 be approved in the amount of $34,239.24. APPROVAL OF MINUTES On a motion by Councilman Norgard, seconded by Councilman Buxton, it was unanimously carried the minutes of September 16, 1964 be approved as submitted by the Clerk. ORDINANCE NO. 563 INTRODUCED CODIFYING AND ADOPTING BY REFERENCE PORTIONS OF ORDINANCES NOS. 209 (EXCAVATIONS IN STREETS), 313 (GUTTER BRIDGES)~ 392½ (JUNK DEALERS)~ ETC. Proposed Ordinance No. 563 was read in full by the City Attorney and introduced by Councilman Buxton "Codifyino and Adopting by Reference Portions of Ordinances Nos. 209~'Excava- tions in Streets), 313 (Gutter Brid~es), 392½ (Junk Dealers); Retitling Sections 9500 Through 9505 Inclusive As 'Article 1 - Construction' of Chapter 3, Division 9, Ukiah City Code; amending Section 421 City Code ~) Adoption by Reference Of Section 4 Of Ordinance No. 3 ; Repealing Portions Of Ordinances Nos. 209, 313, 346, and 392½ Which Are Not Incor- porated By Reference As Parts Of The Ukiah City Code." On a motion, by Councilman Norgard, seconded by Councilman Scotto, it was unanimously carried a public hearing be held on Ordinance No. 563 on October 21, 1964 at 8:00 P.M., or as soon thereafter as the same may be heard. RES. NO. 65-15 GRANTING VARIANCE TO ARTHUR W. & FRANCES TREADWAY On a motion by Councilman Scotto, seconded by Councilman Norgard, it was unanimously carried Resolution No. 65-15 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Grant.ing Variance to Arthur W. and Frances T r eadway." RES. NO. 65-16 GRANTING VARIANCE TO WM. M. VEST~ M.D. In connection wi th Variance Application No. 65-3, a revised site plan was presented for examination by the Council showing the location of the proposed building and parking facilities as approved by the City Engineer. On a motion by Councilman Buxton, seconded by Councilman Scotto, it was unanimously carried Resolution No. 65-16 be approved and the Mayor and Clerk be authorized to sign same, "Resolution Granting Variance to William M. Vest, M.D." RES. NO. 65-17 GRANTING VARIANCE TO LARK IN YOUNCE On a motion by Councilman Norgard, seconded by Councilman Buxton, it was unanimously carried Resolution No. 65-17 be approved and the Mayor and Clerk be au thorized to sign same, I'Resolution Granting Variance to Larkin Younce." MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH SEPTEMBER 23, 1964 - PAGE 2 SCHEDULE FOR TRANSFER OF P.G. & E. FACILITIES The City Manger informed the Council that they would be advised within the next day or two of the schedule of events planned in connection with transfer of P.G. & E. electric facilities to the City's distribution system. RES. NO. 65-18 APPROVING SELECT SYSTEM OF CITY STREETS On a motion by Councilman Scotto, seconded by Councilman Buxton, it was carried by the following roll call vote that Resolution No. 65-18 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Approving and Directing Filing of Report and Map of Select System of City Streets." AYES: Councilmen Norgard, Buxton, Scotto and Mayor Banker. NOES: None. ABSENT: Councilman Smalley. RES. NO. 65-19 ESTABLISHING POLICY REQUIRING DEPOSIT OF PUBLICATION COSTS BY PERSON REQUESTING ABANDONMENT OF A PUBLIC STREET OR EASEMENT On a motion by Councilman Norgard, seconded by Councilman Scotto, i'"t' was carried by the following roll call vote that Resolution No. 65-19 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Establishing Policy of Requiring Deposit of Publication Costs By Person Requesting Abandonment Of A Public Street or Easement." AYES: Councilmen Norgard, Buxton, Scotto and Mayor Banker. NOES: None. ABSENT: Councilman Smalley. STANNARD & COMPANY~ ENGINEERS The City Manager reported that Mr. Stannard of Stannard and Company, Engineers, will be in Ukiah next Wednesday and wi-ll attend the Council meeting for discussion regarding their proposal concerning natural gas and to answer any questions which the Council may have. REPORT ON PROGRESS REGARDING P.G. & E. PROPOSAL FOR NATURAL GAS The City Manger reported on progress to date regarding~ the anticipated proposal from P.G. & E. regarding natural gas for the Ukiah area. It was pointed out that the resolution prepared by P.G. & E. in which it was suggested by P.G. & E. that the Council definitely state that public necessity and convenience required the sale of the City's gas system, was not worded in an acceptable manner and a redraft had been prepared for return to P.G. & E. The proposed resolution, in the City Manager's opinion, would commit the City to a future program with the necessary facts on which to establish a position. The resolution, even if adopted, would not affect any P.G. & E. proposal to the City, but would merely serve as a basis for P.G. & E. to begin acquiring rights of way for construction of a proposed gas line. MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH SEPTEMBER 23, 1964 - PAGE 3 REPORT REGARDING RAILROAD CROSSING AT ALLEY NORTH OF CLARA AVE. Mayor Banker reported that Northwestern Pacific Railroad Co. has been contacted again regarding the City's request that a crossing be constructed at the alley north of Clara Ave., and that although nothing specific has been accomplished as yet, the Railroad's representative agreed to continue study of the matter. FURTHER DISCUSSION REGARDING OFF- STREET PARKING Mayor Banker gave a report concerning a proposal from a local realtor for sale of three parcels of property of a block in the downtown area. Mayor Banker stated that he had personally contacted the three remaining property owners and that a possible sale exists on two parcels, with a life estate program for the third parcel. The matter was discussed generally by the Council and, since no objection was made to the general program, it was announced that further investigation would be made involving more accurate estimates for finan- cing the project and a report would be made at a later meeting. COUNCILMAN NORGARD PROPOSED RESOLUTION OPPOSING PROPOSITION #14 Councilman Norgard reported that an organization had been formed in the community for the purpose of encouraging a "No" vote on Proposition #14 and suggested the Council give consideration to going on record as opposing the proposition. The Council also heard from Mr. Robert Bell, s.pokesman for the organization opposing the proposition, urging the Council to adopt a resolution to this effect. The position of the Council on this and other initiative measures was discussed extensively, both pro and con. No decision was reached but the Mayor suggested that the ' group represented by Mr. Bell prepare and present a resolu- tion clarifying the action they wished the Council to consider taking. LAKE-MENDOCINO CO. PEAR GROWERS ASSN. BARBECUE On behalf of the Lake-Mendocino Counties Pear Growers Associa- tion, Councilman Norgard extended an invitation to all members of the Council to attend a barbecue at the Fairgrounds on September 24th at 7:00 P.M. COUNCILMAN SCOTTO NEW CITY PARK PROJECT Councilman Scotto inquired as to what progress was being made toward developing'a new City Park and was informed that this is included among those projects for which the feasibility of bond issues are being studied. FIRE HAZARD - WEST OF CITY Councilman Scotto asked whether the area west of the City could be control burned in order to eliminate the present fire hazard. The City Manager agreed to contact Bill Mann of the Division of Forestry to determine the status of the program developed three years ago for progressive widening of the fire trail in the foothills west of the City.
