HomeMy WebLinkAboutMin 01-13-65MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH JANUARY ]3, ]965 The City Council convened in regular session in the Council Chambers at 8:00 P.M. with Vice Mayor Buxton, Councilmen Norgard, Scotto and Harlowe present. OATH OF OFFICE ADMINISTERED TO COUNCILHAN BRUCE D. CROOK The Oath of Office was administered by the Clerk to Councilman Bruce D. Crook, appointed by the Council to complete the unexpired term of Ernest Banker. APPROVAL OF MINUTES On a motion by Councilman Scotto, seconded it was unanimously carried the minutes of approved as submitted by the Clerk. by Councilman Harlowe, January 6, 1965 be SPECIAL WARRANTS On a motion by Councilman Scotto, seconded by Councilman Harlowe, it was unanimously carried special warrants ~n the amount of $36.,93 be approved and ordered paid. CONTINUATION OF PUBLIC HEARING RE. PROPOSED ANNEXATION 65-1 (GOBBI ST. SUBSTATION) . Continuation of public hearing on proposed Annexation No. 65-1 was declared open by Vice Mayor Buxton at 8:03 P.M. There were no persons present requesting to be heard on the matter and the public hearing was declared closed at 8:03 P.M. RES. NO 65-37 FINDING MAJORITY PROTEST NOT MADE TO PROPOSED ANNEXATION NO 65-1 On a motion by Councilman Norgar Scotto, it was unanimously carri adopted and the Mayor and Clerk "Resolution Finding That Majorit (Annexation 65-l). Proposed Ordinance No. 566, "An Ordinance Approving The Annexa- tion To The City of Ukiah of Certain Uninhabited Territory, Designated 'Annexation No. 65-1 '" was read in full by the City Attorney and introduced by Councilman Scotto. APPROVAL OF WITHDRAWAL OF FINAL MAP OF SUNRISE TERRACE SUBDIVISION Further discussion was held regarding the request of the subdividers for withdrawal of the Final Map of Sunrise Terrace Subdivision, and the refund of monies deposited with the City for completion of the required improvements. The City Attorney reviewed a memorandum from the Director of Public Works stating that he had no objection to granting the subdividiers request, but pointed out that the City has already constructed three water services and three sewer connections within the subdivision at a cost of $555 which should be deducted from any refund to be considered. This amount deducted from the deposit of $3045.72 would leave a total of $2490.72 remaining. Mr. Clay Duncan and Mr. Les Golden, were present in the Finnegan were also present. Ryan, represented by Attorney audience0 Mr. and Mrs. John John MINUTES JANUARY OF THE MEETING OF THE COUNCIL OF 13, 1965 - PAGE 2 THE CITY OF UKIAH It was the recommendation of the City Attorney that if the Final Map of the subdivision is rescinded, an agreement with the subdividers be obtained indemnifying the City against any loss or judgment resulting from any action which may be taken against it. A proposed agreement to this effect was read by the City Attorney and subsequently executed by Mr. Duncan and Mr. Ryan. On a motion by Councilman Scotto, seconded by Councilman Harlowe, it was unanimously carried the City Council rescind the approval of the Final Map of Sunrise Terrace Subdivision subject to the Indemnification Agreement as read by the City Attorney and executed by the subdividers, and the Director of Finance be authorized to refund to the subdividers the sum of $2,490.72 from the subdividers' deposit, and to apply $555 to the sewer connections and water connections as set forth in the Director of Public Works' memorandum of January 12, 1965. Under the question, Mr. John Finnegan again stated his objection to the withdrawal of the Final Map of this subdivision. APPROVAL OF FINAL MAP OF FAIRWAY OAKS SUBDIVISION, UNIT #4 At this point, Vice Mayor Buxton disqualified himself from participation in the following discussion and action, and Councilman Norgard took the Chair as Acting Mayor. The Final Map of Fairway Oaks Subdivision, Unit .#'/+ was pre- sented to the Council for approval as approved by the City Engineer's office and the Planning Commission. An "Agreement For Subdivision Improvements" executed by the subdividers was reviewed by the City Attorney. On a motion by Councilman Scotto, seconded by Councilman Harlowe, it was unanimously carried the Agreement for Subdivision improvements in Fairway Oaks Unit No. 4 be approved and the Acting Mayor and Clerk be authorized to sign same. On a motion by Councilman Scotto seconded by Councilman Crook, it was unanimously carried Resoiution' No 65-36 be adbptec' and the Acting Mayor and Clerk be authorized to sign same, "Resolution Approving Final Map of Fairway Oaks Subdivision Unit No. 4.I' On a motion by Councilman Scotto, seconded by Councilman Crook, 'it was unanimously carried the Acting Mayor and City Clerk be authorized to sign the certificate of approval of the Final Map of Fairway Oaks Subdivision, Unit #4 on behalf of the City. CLOSED PERSONNEL SESSION At this point 8:55 P.M., Vice Mayor Buxton resumed the Chair, and declared a brief recess during which the Council withdrew in closed personnel session. The meeting continued in open session at 9:02 P.M. COUNCILMAN BUXTON ELECTED MAYOR On a motion by Councilman Norgard, seconded by Councilman Scotto, i"t' was unanimously carried Councilman Ralph Buxton be elected Mayor. M~NUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH JANUARY 13, 1965 - PAGE 3 'COUNCILMAN NORGARD ELECTED VICE MAYOR On a motion by Councilman Harlowe, seconded by Councilman Crook, it was unanimously carried Councilman Sterling Norgard be elected Vice Mayor for a term of one year and three months. APPROVAL OF PURCHASE OF POLECAT DERRICK FROM EDW. R. BACON CO. The City Manager read a memorandum to the Council in which was set forth a summary of the rental payments and service charges paid to date in the lease purchase agreement for the line truck approved by the City Council in June 1964. The Council was advised that an additional consideration had been offered by the Edward Ro Bacon Co. further reducing the purchase price by the amount of interest paid to date. It was recommended that the Council authorize the City Manager to exercise the option and purchase the Pitman Model PC-lCD Cornermount Polecat Derrick at the net price of $10,880. Budget estimate for this purchase approved in the current budget is in excess of the required amount On a motion by Councilman Crook, seconded by Councilman Norgard, it was unanimously carried the Council authorize the City Manager to purchase the Pitman Model PC-lCD Cornermount Polecat Derrick at the price of $10,880. from Edward R. Bacon Co. RESULTS OF SPECIAL CENSUS A memorandum was read by the City Manager informing the Council that the results of the special census conducted by the State Department of Finance establish the City's new population figure at 10,350. An annual increase of approximately $5,500 'in revenue to the City will result from this new figure. MINUTES OF TRAFFIC ENGINEER MEETING The City Manager distributed copies of the last meeting of the Traffic Engineer Committee for the purpose of reviewing with the Council changes to be made in I'Stop" and IIyield" signs on Oak Street. A newspaper article will be published to inform the public prior to changing any of these signs. COUNCILMAN CROOK Councilman Crook expressed his appreciation for the opportunity of serving the community as a member of the City Council. COUNCILMAN SCOTTO Councilman Scotto requested a report on the progress of the proposed park acquisition project and was advised that arrangements have been made with the owner to view the property in an effort to arrive at specific boundaries. This will be accomplished as soon as weather permits. Councilman Scotto asked whether action could be taken to avoid future problems in the consideration of subdivisions as were encountered with Sunrise Terrace Subdivision, and was advised by the City Attorney that he is investigating the possibility of including a requirement by ordinance that a preliminary title report be included at the time the final map is submitted for consideration.
