OF THE MEETING OF THE COUNCIL OF THE CITY OF UKiAH
1965
The City Council convened in regular session in the Council
Chambers at 8:00 P.M. with Mayor Buxton, Councilmen Norgard,
Crook, Scotto and Harlowe present.
APPROVAL OF MINUTES

On a motion by Councilman Crook, seconded by Councilman Scotto,
it was unanimously carried the minutes of June 2, 1965 be
approved as submitted by the Clerk.
PAY ROLL WARRANTS
On a motion by Councilman Norgard, seconded by Councilman
Crook, it was unanimously carried payroll warrants for the
period of May 16th through 31, 1965 be approved in the amount
of $31,269.85.
AB 1615 - LOCAL CIGARETTE
TAX ENABLING ACT
The City Attorney reviewed proposed AB 1615 which would enable
general law cities and counties to levy a tax. of 2¢ per pack
on cigarettes a.nd to contract with the State for collection
and administration of the locally levied tax. The League of
California Cities recommends support of the measure on the
basis that it would provide a new source of revenue for most
cities. After discussion, the City Attorney was requested to
obtain additional information on the bill and report back at
the next meeting.

The proposal and recommendation for the installation of under-
ground electric distribution facilities was again brought up
by the City Manager. The matter was reviewed and additional
information presented for the purpose of indicating the trend
toward underground by both public and privately owned utilities.
It was pointed out that all cost estimates and comparisons
had been rechecked and that the maximum increase in cost
regarding the two subdivisions under discussion was $50 per

was agreed that the construction under consideration would
not establish a precedent and that an accurate financial
analysis of the sale of electricity to the residences involved
would be maintained to be used as a basis for possible future
underground extension.
On a motion by Councilman Scotto, seconded by Councilman
Norgard, it was unanimously carried City participation in
underground construction of electric distribution facilities
in the two subdivisions discussed be approved as recommended
by the City Manager.

OF FRONT SET-BACK
COUNCIL OF THE CITY OF UKIAH
Application for Variance #65-18 by William Bittenbender on
behalf of the First Presbyterian Church to permit reduction
of the front yard setbacks on property located at 514 W. Church
Street, plot plan and minutes of the Planning Commission
meeting dated May 6, 1965 were reviewed by the City Manager.
Also read were the City Engineer's memorandum dated April
30, 1965 and a letter attached to the application from Mr.
John Sweeley requesting that for a limited time the church
be exempt from complying with Section 9165(f) of the Ukiah
City Code pertaining to parking requirements.
It was recommended by the Planning Commission the variance
be granted, but as stated in a memorandum dated May 25, 1965
from Donn Weaver, Chairman of the Commission, in recommending
approval of the variance, the Commission wished to make clear
that the action taken was in regard to setbacks only and
in no way to be construed as relieving the applicant of
parking requirements as called for under the zoning ordinance.
Mssrs. William Bittenbender and William Bromley spoke on
behalf of the application and there were no written or
verbal protests to the proposed variance. Mr. Bi ttenbender
stated that al though no provision for off-street parking is
included in the current plans, the Church is negotiating with
various owners in the area to acquire property for this
purpose when it becomes available. Mr. Bromley stated that
they have been given verbal permission to use the parking lot
of the Catholic Church at any time Mass is not in session.
On a motion by Councilman Crook, seconded by Councilman Scotto,
it was unanimously carried the City AttorneY. be instructed
to prepare a resolution granting Variance#65-18 to the First
Presbyterian Church as recommended by the Planning Commission.
VARIANCE APPLICATION #65-19
DOM CRINELLA - REDUCED SETBACK

Variance Application #65-19 by Dom Crinella to permit reduc-
tion of the building set-back line along the Calvert Ct.
frontage of property located at 444 McPeak St., plot plan,
and Planning Commission minutes dated June 3, 1965 were re-
viewed by the City Manager. The City Engineer's memorandum
dated June 3, 1965 was also read which pointed out that
adjacent property on Calvert Court is al ready built upon wi th
an approximate 15 foot setback. It was the recommendation
of the Planning Commission the variance be granted.
There were no persons present in the audience requesting to
be heard on. the matter.
On a motion by Councilman Norgard, seconded by Councilman
Harlowe, it was unanimously carried the City Attorney be
instructed to prepare a resolution granting Variance No. 65-19
to Dom Crinella as recommended by the Planning Commission.
REPORT RE. PENDING LEGISLATION
The City Manager reported that he had contacted Assemblyman
Belotti to inform him of the action taken by the Council
on the 'four bills discussed at the last meeting, and in each
case he had agreed wi th the position taken by the City.

UKIAH TAXICAB CO.
REQUEST FOR RATE INCREASE
The City Manager reviewed a request by Mr. Lawrence Pacini oF
the Ukiah Taxicab Co. for a revision in rates to permit a
charge of half fare, in addition to the basic fare, for each
additional passenger in Zones 1 and 2. Mr. Pacini also
requested that there be established a new charge equal to the
package delivery charge for furnishing shopping service to
pa t rons.
Mr. Pacini was in the audience and discussed his request wi th
the Counci 1.
After discussion, the City Manager was instructed to prepare
a revised rate schedule including the requested revisions for
further consideration by the Council at the next meeting.
DIVISION OF FORESTRY; PROPOSED
REVISED LEASE OF AIRPORT PROPERTY
The City Manager advised the Council that the amended lease
form previously approved by both the City Council and local
Division of Forestry officials had been returned from the
State level with numerous revisions which he felt were unaccep-
table to the City, and recommended that the lease not be
approved in this form. The Council agreed wi th the City
Manager's proposal that he meet with Divi sion of Forestry
officials for further negotiation of the agreement for lease
of property at the Ukiah Airport.
OAK KNOLL TERRACE SUBDIVISION, UNIT #2
APPROVAL OF FINAL MAP
The Final Map of Oak Knoll Terrace Subdivision, Unit #2 was
presented for approval and a proposed standard form of
Agreement For Subdivision Improvements reviewed by the City
Attorney.

On a motion by Councilman Scotto, seconded by Councilman
Harlowe, it was unanimously carried Resolution No. 65-63
be adopted and the Mayor and Clerk be authorized to sign same,
"Resolution Approving Final Map of Oak Knoll Terrace Sub-
division, Unit No. 2, And On Condition That Subdivider Enter
Into and Perform Agreement For Subdivision Improvements.I'
SPURLOCK SUBDIVISION, UNIT #2
APPROVAL OF TENTATIVE MAP
The Tentative Map of Spurlock Subdivision, Unit #2 was presented
for approval by the Council, and the minutes of the Plan-
ning Commission meeting of June 3, 1965 read by the City
Manager. It was recommended by the Commission the map be
approved subject to the recommendations of the City Engineer
dated June 3, 1965 that lots 11 through 15 be corrected to
provide the minimum lot area required by ordinance. It was
pointed out by the City Engineer that the map submitted to the
Council had been revised in accordance with this recommendation.
On a motion by Councilman Crook, seconded by Councilman
Norgard, it was unanimously carried the Tentative Map of
Spurlock Subdivision, Unit #2 be approved as presented to
Counc i 1 .

At the request of Councilman Crook, the City Manager reported
that Congressman Clausen had contacted Chief Saulsbury following
his graduation from the F.B.I.Academy, as requested, and had
accompanied him on the flight back to California that afternoon.
COUNCILMAN SCOTTO
Councilman Scotto reported that he had accepted an invitation
to join the Economic Opportunity Council which has been incor-
porated in Mendocino County as a requirement for participation
in the President's War On Poverty Program, and presented a
proposed resolution for adoption by the Council in recognition of
that organization. It was agreed the City Attorney review the
resolution and present it for further consideration at the next
meet ing.
ADJOURNMENT
As there was no further regular business, Mayor Buxton declared
the meeting adjourned at 9:43 P.M.
