HomeMy WebLinkAboutMin 08-11-65MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH AUGUST 11, 1965 The City Council convened in regular session in the Council Chambers at 8:02 P.M. with Mayor Buxton, Councilmen Norgard, Crook, Scotto and Harlowe present. APPROVAL OF MINUTES On a motion by Councilman Crook, seconded by Councilman Scotto, it was unanimously carried the minutes of August 4, 1965 be approved as submitted by the Deputy Clerk. NO. 66-9 FI NDING THAT MAJORITY PROTEST HAS NOT BEEN MADE "ANNEXATION NO. 65-2 (WAUGH LANE)" On a motion by Councilman Norgard, seconded by Councilman Harlowe, it was unanimously carried Resolution No. 66-9 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Finding That Majority Protest Has Not Been Made 'Annexation No. 65-2 (Waugh Lane)'" ORDINANCE NO. 570 APPROVING ANNEXATION NO. 65-2 INTRODUCED Ordinance No. 570 "An Ordinance Approving The Annexation To The City of Ukiah of Certain Uninhabited Territory, Designated 'Annexation No. 65-2 (Waugh Lane)'" was read in full by the City Attorney and introduced by Councilman Scotto. PETITION PROTESTING LANDIS MORGAN TRUCKING OPERATION AT 147 CLARA AVE. The City Manager read a petition signed by residents of the Clara, Mason and Norton Streets area protestinq the disturbance caused by the Landis Morgan trucking firm at 1~7 Clara St. Mr. Cash pointed out the firm operates in a C-2 zone under Use Permit #4-61 granted by the Planning Commission on September 15, 1960. It was recommended the Council hear statements from the audience and consider referral of the petition to the Planning Commission for reconsideration since the matter falls within its jurisdiction at this point. MINUTES OF THE HEETING OF THE COUNCIL OF THE CITY OF UKIAH AUGUST Il, 1965 - PAGE 2 Objections to the noise, fumes, dust and light produced by the trucking operation, and to extensive use of street parking for the trucks were heard from the following persons in the audience: Mr. Fidel Royval, 225 Norton St. Mr. Leo Foster, 226 Norton St. Mrs. Jensen, 139 Clara Ave. Mr. Ted Hamilton, 215 Norton St. Mr. Merle Morgan, 14~ Clara Ave. Mr. Raymond Jacob, 222 Norton St. Mr. Jose Miguel Ibarra, 122 Clara Ave. Discussion followed, and the procedures for referring the matter to the Planning Commission were reviewed by the City Attorney. Mr. Royval agreed to serve as spokesman for the group to receive notification of the Planning Commission's disposition of the matter if the petition is referred directly for its consideration. On a motion by Councilman Norgard, seconded by Councilman Scotto, it was unanimously carried the petition relative to the Landis Morgan trucking operation be referred to the Planning Commission for action, and that Mr. Royval be notified by the Secretary of the Commission of the date and time the matter will be considered. Councilman Crook pointed out that the City should have assurance that adequate liability insurance is being carried by the tenant to protect the City in case of any incident which would involve insurance. On a motion by Councilman Crook, seconded by Councilman Norgard, it was unanimously carried the City enter into a one year lease with the Ukiah Valley Association for Retarded Children at the existing rate of $75.00 per month, provided that sufficient insurance to protect the City from liability is maintained by the tenant, and that they be notified at the end of one year the City does not desire to renew the lease or continue occupancy of the building. RES. NO. 66-8 FOR LEASE OF C COURSE PURPOSE APPROVING LEASE FORM OUNTY PROPERTY FOR GOLF St etc. Further discussion was held by the Council regarding the proposed lease of 55 acres of County property for expansion of the golf course and the draft of the lease reviewed by the City Attorney. Mr. Henry DeCoss of the Royal Motel enquired for what purpose the Council intended to utilize the proceeds of the Hotel-Motel Room Occupancy tax, and stated that during the first month it was effective he collected a total of $294.88 in tax. The .general opinion of the Council was in opposition to the comm~ttment of present or future funds to the project, until a complete study has been made of any proposed financing program. It was also requested that this position be clearly publicized to eliminate detrimental effects from rumors to the contrary. AYES: Councilman Norgard, Crook, Scotto, Harlowe and Mayor Buxton. NOES: None. ABSENT: None. ADJOURNMENT As there was no further regular business, Mayor Buxton declared the meeting adjourned at 9:42 P.M., after which the Council reconvened for continued study of the budget. MAYOR-- ....
