HomeMy WebLinkAboutMin 10-06-65MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH OCTOBER 6, 1965 The City Council convened in regular session in the Council Chambers at 8:02 P.M. with Mayor Buxton, Councilmen Norgard, Crook, Scotto and Harlowe present. APPROVAL OF MINUTES On a motion by Councilman Norgard, seconded by Councilman Harlowe, it was unanimously carried the minutes of September 22, 1965 be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Scotto, seconded by Councilman Harlowe, it was unanimously carried payroll warrants for the period of September 16th through 3Oth, 1965 be approved in the amount of $32,306.51. SPEC IAL WARRANTS On a motion by Councilman Harlowe, seconded by Councilman Crook, it was unanimously carried special warrants in the amount of $15,286.60 be approved and ordered paid. JOSEPH B. GALLAND - CLAIM DENIED The City Attorney reviewed a claim in the amount of $500.00 filed by Joseph B. Galland on September 27, 1965 for injuries alleged to have resulted on July 27, 1965 from a fall at the corner of Bush and Standley Streets. The City Attorney explained that reconstruction of Standley St. was in progr~s at the time, and it would appear the contractor for the work would be involved. It was recommended the claim be denied. On a motion by Councilman Norgard, seconded by Councilman Crook, it was unanimously carried the claim of Joseph B. Gallandin the amount of $500 be denied. LITIGATION REPORT The City Attorney reported that court decisions involving two pending civil cases in which the City was a party (City vs. Fones and City vs. Callison Truck Lines) had been received and both of these decisions were in the City's favor. The City Attorney briefly reviewed the history of the Fones case and reported that the District Court of Appeals has affirmed the judgment of the trial court to the effect that Mr. Fones is not entitled to reinstate- ment and is entitled to only a limited amount of back salary, although he will be entitled to some retirement benefits under the State Employees' Retirement System. The decision in the case of the City vs. Callison Truck Lines was for a judgment in favor of the City in the amount of $1,675.87 which represents the value of the motor which was destroyed by the trucking company while it was in transport to Arcata for repa i rs. It was also reported that neither of these decisions are final and when they become final a further report will be made to the Counc i 1. PROPOSED CONSTRUCTION OF FREEWAY PEDESTRIAN The City Manager City, School and Division of Highways officials, the State has indicated willingness to construct a freeway pedestrian crossing to serve Oak Manor School from the West side of the freeway at an estimated cost of $70,000 provided all necessary construction and maintenance outside the State right of way is assumed by an agency or agencies other than the State. A proposal that the School District accept responsibility for construction of the reported that as a result of meetings held between walkway and adequate fencing to protect the private property through which it will pass will be presented at the next meeting of the Board of Trustees. It was the opinion of the City Manager maintenance of that portion outside the State right of way could properly be assumed by the City as a public thoroughfare. REPORT AND RECOMMENDATION RE. GARBAGE COLLECTION AND DISPOSAL The City Manager submitted a detailed report regarding garbage collection and disposal which had been requested by the Council. The report contained a summary of the total operation and a recommendation for correcting deficiencies by City operation on a modernized basis. He stated, in summary, that he was generally opposed to the City's consideration of entering into any type of service which could be handled by private industry. He also stated he would be favorable to attempting to develop some contract agreement.which would give the assurance that an acceptable level of service would be given to the public and an acceptable level of income to the private contractor. COUNCIL APPROVES CONTINUATION OF DRAINAGE CHANNEL CLEARANCE The City Manager brought up the question of channel clearance scheduled to begin on Gibson Creek through Orchard Village Subdivision area and pointed out that a policy decision was required prior to beginning the work regarding the handling of damaged privately owned structures and yards bordering the creek. The City Attorney reviewed the legal opinion which had been presented to the Council and pointed out that there was no liability on the part of the City regarding the private properties. CORRESPONDENCE - NORTHWESTERN PACIFIC RAILROAD CO. The City Manager reviewed a letter from Northwestern Pacific Railroad Co. confirming an earlier telephone conversation with him and setting the dates for hearing its application to terminate passenger service between Will its and Eureka. LEAGUE OF CALIF. CITIES CONFERENCE OCTOBER lOth to 13th The City Manager reported that all reservations for the League of California Cities Conference in San Francisco have been made. 1.54 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH OCTOBER 6, 1965 - PAGE 4 DISCUSSION OF PROPOSED CHAMBER OF COMMERCE PROGRAM POSTPONED The Council was informed that at the request of the Chamber of Commerce, discussion of its proposed program for the 1965-66 fiscal year was postponed for two weeks. COUNCILMAN CROOK Councilman Crook requested a progress report on the water system development project. The City Manager reviewed the findings of the testing to this point and stated that all indications show the quality of the proposed well at the site chosen to be as it was initially estimated. COUNCILMAN SCOTTO Councilman Scotto questioned the contents of the Airport Commission minutes of September 21, 1965 regarding hangar construction and was informed that a report had been made to the Chairman of the Commission which had apparently not reached the Commission. Councilman Harlowe brought up that several members of the Council had problems of runway damaged by heavy fire quiring resurfacing.
