HomeMy WebLinkAboutMin 12-08-65MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH DECEMBER 8, 1965 The City Council convened in regular session in the Council Chambers at 8:O1 P.M. with Mayor Buxton, Councilmen Norgard, Scotto and Harlowe present. Councilman Crook was absent. APPROVAL OF MINUTES On a motion by Councilman Norgard, seconded by Councilman Scotto, it was unanimously carried the minutes of December 1, 1965 be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Scotto, seconded by Councilman Harlowe, it was unanimously carried Payroll Warrants in the amount of $32,865.71 be approved for the period of November 16th through 3Oth, 1965. SPECIAL WARRANTS On a motion by Councilman Norgard, seconded by Councilman Scotto, it was unanimously carried Special Warrants in the amount of $9,371. 07 be approved and ordered paid. PUBLIC HEARING ON PROPOSED PARKING DISTRICT NO. 1 Public hearing was declared open by Mayor Buxton at 8:03 P.M. for hearing objections to the formation of or inclusion within proposed Parking District No. 1. Affidavit of Publication of Resolution No. 66-22 giving notice of the hearing, and the Clerk's affidavit that a copy of said resolution was mailed to each property owner within the proposed district was placed on file. It was reported that one protest to the formation of the district or inclusion therein was filed by Tom W. Poulos and Kal iope Poulos. Such protest was read in full by the City Attorney. Mr. John E. Nelson, Attorney for the protestants, addressed the Council to express further protest on behalf of his clients. Testimony of A. S. Kruth, Director of Public Works and City Engineer, that the properties which were the subject of protest will benefit from the parking lots to be provided by the proposed district was taken. Mr. Don E. Hesseltine, representing H & H Furniture Co. spoke in favor of the proposed district. It was _reported that the total assessed value of the district is $2,909,~O0 and determined that the value of the Poulos property did not comprise more than 50% of the total. Councilman Scotto reported that Mr. Herman Runkel had requested him to convey his protest to inclusion of his property on Mason St. within the district. However, no formal protest in accordance with the State Streets and Highways Code was filed by Mr. Runkel. As there were no other persons requesting to be heard on the matter, the public hearing was declared closed at 8:21 P.M. On a motion by Councilman Scotto, seconded by Councilman Harlowe, it was unanimously carried that the City Council finds and determines that the protest of Tom W. Poulos, et ux to inclusion in Parking Dis£rict No.I has been heard and considered, and such protest is hereby overruled and denied. 1.82 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH DECEMBER 8, 1965 - PAGE 2 On a motion by Councilman Scotto, seconded by Councilman Harlowe, it was unanimously carried the City Council find and determine that all, each and every protest and objection to the formation of Parking District No. 1 has been heard and considered, and that all of such protests and objections are hereby overruled and denied. ORD. NO. 574 INCLUDING CITY PARKING LOT IN PROPOSED PARKING DISTRICT On a motion by Councilman Harlowe, seconded by Councilman Scotto, it was carried by the following roll call vote Ordinance No. 574 be adopted and the Mayor and Clerk be authorized to sign same, "Ordinance Declaring And Agreeing That City Lands Within Proposed Parking District and Being Used For Public Off-Street Parking Shall be Held, Used And Treated The Same As The Parking Places To Be Acquired Within The Proposed Parking District With The Proceeds Of Bonds To Be Issued And Sold." AYES: Councilmen Norgard, Scotto, Harlowe and Mayor Buxton. NOES: None. ABSENT; Councilman Crook. ORD. NO. 576A DECLARING PARKING DISTRICT NO. 1 FORMED Proposed Ordinance No. 576A declaring formation of Parking District No. 1 was read in full by the City Attorney. On a motion by Councilman Norgard, seconded by Councilman Scotto, it was carried by the following roll call vote Ordinance No. 576A be adopted and the Mayor and Clerk be authorized to sign same, 'lOrdinance Declaring Parking District No. 1 Of The City of Ukiah Formed and Describing the Acquisitions And Improvements To Be Made Therein, To Take Effect Immediately." AYES: Councilman Norgard, Sco to, Harlowe and Mayor Buxton. NO E S: None. ABSENT: Councilman Crook. RES. NO. 66-27 AUTHORIZING EXERCISE OF OPTION AGREEMENTS ACQUIRING PROPERTY FOR PARKING PURPOSES AND AUTHORIZING TRANSFER FROM GENERAL FUNDS~ e. tc. On a motion by Councilman Scotto, seconded by COuncilman Harlowe, it was carried by the following roll call vote Resolution No. 66-27 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Authorizing Exercise Of Option Agreements Acquiring Property For Parking Purposes Of Parking District No. 1; Authoriz- ing Transfer From General Fund; And Authorizing Issuance Of Warrants.'l AYES: Councilmen Norgard, Scotto, Harlowe and Mayor Buxton. NOES: None. ABSENT: Councilman Crook. O. J. LE BARON CLAIM FOR DAMAGES DENIED ,The City Attorney reviewed a claim filed by O. J. LeBaron for damages in the amount of $4,380 alleged to have occurred to his airplane during taxiing maneuvers at the Municipal Airport on September 11, 1965. It was recommended the Claim be denied. On a motion by Councilman Harlowe, seconded by Councilman Norgard, it was unanimously carried the Claim of O. J. LeBaron in the amount of $4,380 be denied. MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH DECEMBER 8, 1965 - PAGE 3 The City Attorney reported that payment in the amount of $1,686.87 had been received from Transport Indemnity Co. representing the satisfaction of judgment in the case of City vs. Callison Truck Lines. FURTHER DISCUSSION OF PROPOSED GARBAGE CONTRACT POSTPONED The City Manager reported that minor differences of opinion have developed regarding the proposed contract for refuse collection and disposal and that the Attorney for Ukiah Refuse Service had requested postponement of further discussions for one week. HEALTH FACILITIES PLANNING MEETING The City Manager advised the Council that another meeting of the Health Facilities Planning Group had been held on Monday of this week and stated that he felt the City should continue to be represented at these meetings. CIVIL DEFENSE MEETING The City Manager reported on a meeting held Monday evening for the purpose of bringing all Civil Defense information up to date and reactivating the organization within the County. NORTHWESTERN PACIFIC RAILROAD CO. HEARINGS RE. WlLLITS-EUREKA PASSENGER SERVICE It was reported that hearings would be held in Willits, December 9th and lOth regarding discontinuance of passenger service between Willits and Eureka by Northwestern Pacific Railroad Co. The Council took no action relative to being represented at these hearings. SIERRA PACIFIC AIRLINES PROPOSED SERVICE TO UKIAH The City Manager reported that a special meeting of the Airport Commission will be held next Tuesday night to consider the request of Sierra Pacific Airlines for a permit to provide airlines service to the Ukiah Municipal Airport. The Commission's recommendation will be submitted to the Council for consideration at next week's meeting. PUBLIC LAW 875 - REFUND FOR REPAIR OF FLOOD DAMAGE The Council was advised that repairs of the flOod damage occurring during last winter's storms is complete and that forms have been prepared applying for a refund in the amount of $38,952.48 of the $41,O00.OO approved for the work under Public Law 875. REPORT RE. NEGOTIATIONS FOR PURCHASE OF POLICE CARS The City Manager reported that ne.gotiations for purchase of the three replacement police cars is ~n progress and that a recom- mendation should be ready for consideration at the next meeting of the Council. MAYOR CONGRATULATES PUBLIC WORKS DEPT. FOR GOBBI ST. IMPROVEMENTS Mayor Buxton expressed his congratulations and appreciation to the Public Works Department for the recent resurfacing of E. Gobbi Street. The City Engineer stated that additional work in the shoulder areas will be done as soon as the weather improves. MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH DECEMBER 8~ 1965 - PAGE 4 COUNCILMAN SCOTTO Councilman Scotto asked whether the recent action of the Federal Reserve Board increasing interest rates would affect the sale of bonds for the Parking District. Mr. Cash stated that it was the opinion of one local banker that it would not; however, no definite determination has yet been made on this point. COMPLAINT RE. BURNING AT CITY DISPOSAL AREA Mr. James Salzman of 215 Wildwood Drive expressed a complaint against burning of rubbish at the City Disposal Area and asked whether such burning could be eliminated inview of the smoke and odor produced in the Deerwood Park Subdivision area. Mr. Cash pointed out that the burning of leaves in the valley area as' well as'Masonite's operation perhaps could be producing some of the smoke complained of at this time of year. Mr. Salzman was also informed that under the proposed contract for garbage service burning at the dump will be at the discretion of the City Engineer, and that when objectionable conditions occur the City would like to be made aware of them. ADJOURNMENT As there was no further regular business, Mayor Buxton declared the meeting adjourned at 9:10 P.M. ATTEST:
