JANUARY 11 ~ 1967
The City Council convenedin regular session in the Council
Chambers at 8:00 P.M. with Mayor Norgard, Councilmen Scotto,
Henderson, and Harlowe present. Councilman Crook was absent.
APPROVAL OF MINUTES
On a motion by Councilman Scotto, seconded by Councilman
Harlowe, it was unanimously carried the minutes of January 4,
1967 be approved as submitted by the Clerk.
PUBLIC HEARING - ZONE CHANGE
APPL I CAT I ON NO. 67- 7
HUMBLE OIL & REFINING CO.
Public hearing was declared open ~ the Mayor at 8:03 P.M.
on Zone Change Application No. 67 by Humble Oil and Refining
Company for rezoning of property located on the North side of
East Gobbi Street between Orchard Avenue and Freeway from R-3
to C-1 zone. Affidavit of Publication of the required legal
notice of the hearing was placed on file. The Planning Commission
Resolution No. 67-12 recommending denial of this application was
also reviewed.
The City Attorney reported that during the Planning Commission
hearing it was determined that the zone change request was in
excess of what is reasonably required by applicant and applicant
proposed to amend his application by requesting a variance. This
request did not reach the Public Works Department until after
the public hearing had been scheduled and advertised, and in the
opinion of the City Attorney, cannot be construed as an amendment
at this time.
Mr. Dan McCurry, 676 Orchard Avenue and Mr. Ted McCarthy, 684
Orchard ~venue were present and spoke, in opposition to granting --
the proposed zone change. Mr. McCurry presented a letter which
stated reasons for their opposition to the granting of the pro-
posed zone change accompanied by a petition signed by protestants.
There was no one present in favor of granting the proposed zone
change, and the public hearing was declared closed at 8:l0 P.M.
On a motion by Ccuncilman Scotto, seconded by Councilman Harlowe,
it was unanimously carried Zone Change Application No. 67-7 be
denied as recommended by the Planning Commission.
LOCAL AGENCY FORMATION
COMMISSIONS BULLETINS
The City Attorney reported that he had received a report on a
statewide survey of the Local Agency Formation Commissions for
1966 and distributed copies of this informational bulletin to
the counci 1.

EQUIPMENT FOR WATER COLLECTOR
The City Manager recommended that the award of the bid for the
pumping equipment for the water collector system be delayed one ......
week to complete technical comparisons for compliance with the
spec i ficat ions. ,

week to complete technical comparisons for compliance with the

VAR lANCE APPLICATION NO. 67-8
ZETTA AUSTIN
Variance Application No. 67-8 by Zetta Austin to permit the
keeping of ambulatory patients in a residence at 1350 South
Helen Avenue, and Planning Commission minutes dated December 15,
1966 and January 5, 1967 were reviewed by the City Manager. The
Planning Commission Resolution No. 67-13 recommending denial of
the proposed variance was also reviewed by the City Manager.
There was no one present on behalf of the application.
On a motion by Councilman Scotto, seconded by Councilman Harlowe,
it was unanimously carried the City Attorne~ be instructed to
prepare a resolution denying Variance No. 6 -8 as recommended by
the Planning Commission.
NOTICE OF COMPLETION OF
CONSTRUCTION OF WATER COLLECTOR
The City Manager read a memorandum from the City Engineer dated
January 11, 1967 stating that the Ranney Method Western Corpora-
tion has completed the work of constructing the water collector
and the added work of the pump and building foundations and that
all work was performed according to contract plans and specifica-
tions. It was recommended that the work be accepted as complete
and the Clerk be authorized to file the required Notice of
Completion.
On a motion by Councilman Henderson, seconded by Councilman
Scotto, it was unanimously carried construction of the water
collector and the added work of the pump and building founda-
tions be accepted as complete and the Clerk be authorized to
file the required Notice of Completion.
SPECIAL WARRANTS
On a motion by Councilman Scotto, seconded by Councilman
Henderson, 'it was unanimously carried special warrants #2870
and #2871 inclusive, in the total amount of $6,963.76 be
approved and ordered paid.
COUNCILMAN SCOTTO
Councilman Scotto asked if an ex officio member of a Commission
ever votes to break a tie and was advised that the ex officio
member does not vote.
COUNCILMAN HENDERSON
Councilman Henderson asked if there was to be representation
from the Council at the Congress for Community Progress on
February 8th. This is the date of a regular Council meet.ing
so permission was granted to Councilman Henderson to attend
this meeting.
COUNCILMAN HARLOWE
Councilman Harlowe asked the status of the master plan for
the airport property and was advised that the study which was
to be made has not been received.

ADJOURNMENT
As there was no further regular business, Mayor Norgard
declared the meeting adjourned at 8:52 P.M. after which
the Council reconvened in Executive Session.
