JUNE 7, 1967
The C i ty Counc i 1 convened i n regu 1 ar sess ion i n the Counc i 1 Chambers
at 8:09 P.M. with Mayor Norgard, Councilmen Scotto, Henderson, and
Harlowe present. Councilman Crook was absent.
APPROVAL OF MINUTES
On a motion by Councilman Scotto, seconded by Councilman Harlowe it
was unanimously carried the minutes of May 24, 1967 be approved as
corrected and the minutes of the adjourned meeting of May 31, 1967
be approved as submitted by the clerk.
PAYROLL WARRANTS
On a motion by Councilman Henderson, seconded by Councilman Harlowe
it was unanimously carried Payroll Warrants #8225 to //'8347 inclusive,
for the period of May 16, 1967 through May 31, 1967 be approved in
the amount of $35,817.63.
SPECIAL WARRANTS
On a motion by Councilman Scotto, seconded by Councilman Henderson
Tt was unanimously carried Special Warrants //3486 to #3493 inclusive,
in the amount of $21,744.76 be approved and ordered paid.
FURTHER REPORT ON WESTERN
PIPE CASES SETTLEMENT
The City Attorney reviewed the settlement of Western Pipe Cases
wherein the City will receive monies on overcharges for pipe pur-
chased from various companies over the past several years. It is
estimated that the recovery will be around $11,O00 on account of the
1957 pipe purchases in construction with the Sanitation District.
The City Attorney reported the Attorney General's office had for-
warded certain documents relating to the proposed settlement which
they ask be acted upon by the Council. These documents, two reso-
lutions and a Covenant Not To Sue, were reviewed by the City Attorney/

On a motion by Councilman Scotto, seconded by Councilman Henderson
it was unanimously carried Resolution No. 67-44 be adopted and the
Mayor and Clerk be authorized to sign same, "Resolution (Or Equivalent
Document)".

COVENANT NOT TO SUE -
WESTERN PIPE CASES SETTLEMENT
On a motion by Councilman Scotto, seconded by Councilman Henderson
it was unanimously carried the Mayor and Clerk be authorized to
sign "Covenant Not To Sue" regarding the Western Pipe Cases Settle-
ment.

HCALLISTER V. CITY
WATER RIGHTS CASES
The City Attorney reported the decision from the court on the
McAllister v. City water rights cases was totally adverse to the
Cityls position. He stated there were areas in which there was
misunderstanding on the part of the court and requested permission
to file objections to the findings. Council agreed.
.FURTHER REPORT ON SIDEWALK
REPAIRS & CONSTRUCTION PROGRAMS
The City Attorney reported further on proposed procedure for
correcting sidewalk deficiencies and requiring construction of
new sidewalks, curb and gutter. He referred to memoranda pre-
viously prepared setting forth procedures under which these
corrections may be made and to a memorandum regarding the
1911 Act in so far as it could be used in this case. Since
this was determined to be a long range policy the Council re-
quested copies of the memoranda mailed to each Councilman so the
matter could be reviewed before consideration for formal action.
RESO. NO. 67-45 GRANTING
VARIANCE TO JACK COLLENBERG
On a motion by Councilman Harlowe seconded b_~ Councilman Scotto
it was unanimously carried Resolu~:ion No. 67=5 be adopted and the
Mayor and Clerk be authorized to sign same, "Resolution Granting
Variance to Jack Collenberg".
FURTHER REPORT RE
BURNED BUILDING
The City Attorney reported no word has been heard from the property
owner who was notified to take proper steps to eliminate the hazard
his burned out property has created. In searching for further steps
to take in this regard, the City Attorney reported on a procedure
used successfully by the City of Stockton and explained the general
mechanics of this procedure for Council consideration. The Council
was in general agreement with the overall program and instructed
the City Attorney to obtain their current experience on this program
and report back to the Council.
DISCUSSION RE BUREAU OF RECLAMATION -
P.G. & E. PROPOSED CONTRACT
The City Attorney reviewed Senate Joint Resolution No. 35 regarding
Bureau of Reclamation - Pacific Gas and Electric Company proposed
contract which could exclude Ukiah from the "wheeling areaI' for the
next forty years. Inclusion in the "wheeling areaI' permits cities
to receive surplus public power from Central Valley project at
slightly over half the price presently paid by the City. The City
has for a number of years expressed interest in obtaining inclusion
within the Pacific Gas and Electric Company "wheeling area" and has
been advised that such inclusion might be possible when the current
Bureau of Reclamation - Pacific Gas and Electric Company contract
was reviewed, however, the final contract document as proposed has
not been made public.
On a motion by Councilman Henderson, seconded by Councilman Harlowe
it was unanimously carried the City Attorney be directed to forward
a letter to legislators advising of the possible effect upon the City
of the Bureau of Reclamation proposed contract with Pacific Gas and
Electric Company and to urge their support of SJR No. 35 asking the
President and Congress to delay such contract until it can be fully
and publicly reviewed.
On a motion by Councilman Henderson, seconded by Councilman Harlowe
it was unanimously carried the City staff examine the possibilities
of getting the City into the "wheeling area".

REQUEST TO CALL FOR BIDS FOR
PETROLEUM PRODUCTS REQUIREMENTS
On a motion by Councilman Scotto, seconded by Councilman Henderson
it was unanimously carried the Clerk be authorized to call for bids
for petroleum products requirement through June, 1968, bids to be
received prior to 2:00 P.M., June 27, 1967.

USS ION OF CURRENT INFORMATION
I TY-COUNTY SALES TAX FORMULA
The City Manager reported attending the scheduled meeting with the
County Administrator to formulate a basis for further discussion
with the Board of Supervisors regarding sales tax. The City Manager
distributed a report which the County Administrator had submitted
to the Board for their consideration. On the basis of this report,
the Board of Supervisors formally proposed a 88-12 split to the cities
in Mendocino County. This proposal was in the form of a letter to
the Council which letter was read by the Ci'ty Manager. The Council
agreed this report would be reviewed and the matter placed on the
June lb, th agenda. Receipt of said letter from Board of Supervisors
will be acknowledged.
PETTY CASH EXPENSE
The City Manager explained the problems that exist in the petty
cash expenditure statin9 that a better control can be worked out
which will be contained in a written recommendation for Council
consideration.
PERSONNEL RECOMMENDATIONS

to review the recommendations for discussion in approximately
weeks.
The City Manager distributed to the Council the Personnel Recommenda-
tions regardin9 salary and posi.tion adjustments for the coming year
and read in full said recommendations. In makin9 the report, the
City Manager reported substantial assistance was received from the
efforts of City Departments, City Employees' Association, Civil
Service Board and all agencies contacted. Mr. George Dunning,
Chairman of the Civil Service Board was present in the audience

SPURLOCK SUBDIVISION UNIT NO. 2
ACCEPTANCE OF IMPROVEMENTS
A memorandum from the City Engineer dated June 7, 1967 was read' by
the City Manager advisin9 that all required improvements have been
completed in Spurlock Subdivision Unit No. 2 and recommended acceptance
of the improvements on behalf of the City by the Council.
On a motion by Councilman Scotto, seconded by Councilman Henderson
it was unanimously carried the City Council accept the improvements
as complete in Spurlock Subdivision Unit No. 2.
POSTPONEMENT OF PERSONNEL SESSION
RE COMMISSION AND BOARD APPOINTMENTS
The Council agreed to wait for a full Council for consideration of
Commission and Board appointments.

ADJOURNMENT
As there was no further regular business, Mayor Norgard declared the
meeting adjourned at 10:28 P.M. to meet again Wednesday, June 14,
1967.
