HomeMy WebLinkAboutMin 11-30-67MINUTES OF THE ADJOURNED REGULAR MEETING OF THE COUNCIL OF THE CITY OF UKIAH NOVEMBER 30, 1967 The City Council convened in adjourned Regular Session in the Council Chambers at 8:05 P.M. wi th Vice-Mayor Scotto, Councilmen Crook and Harlowe present. Mayor Norgard and Councilman Henderson were absent. APPROVAL OF MINUTES On a motion by Councilman Crook, seconded by Councilman Harlowe, it was unanimously carried the minutes of November 22, 1967 be approved as submitted by the Clerk. SPECIAL WARRANT On a motion by Councilman Crook, seconded by Councilman Harlowe, it was unanimously carried Special Warrant #4282 for November 30, 1967 in the amount of $617.62 be approved and ordered paid. ORDINANCE NO. 596 PROPERTY TRANSFER TAX The City Attorney read the ordinance establishing a property transfer tax, "An Ordinance Imposing A Documentary Stamp Tax on Each Deed, Instrument or Writing By Which Land, Tenements Or Realty Sold Within The City of Ukiah Is Granted, Assigned, Transferred Or Otherwise Conveyed To Or Vested In The Purchaser Or Purchasers Or Any Other Person Or Persons," as directed by the Council. Among those present in the audience and speaking in opposition to the adoption of said ordinance were the following: Jack Cox, President Mendocino County Board of Realtors Leatha O'lLaughlin, Vice President, Mendocino County Board of Rea 1 tors Norma Lessee, Real Estate Board Secretary Bob Levy, 502 Walnut Avenue Linton Norman, 404 East lick Mike Williams, Vice President, American Title and Trust Leonard Nix The City Attorney explained that as the Federal tax lapsed December 31, the Cities and Counties were given the option to pick it up. The tax had already been levied by the County Board of Supervisors. Upon adoption by the City we would receive a credit on the County Stamp on property sold within the City of 55 cents of the $1.10 levied on the thousand. The Stamps would be purchased through the County Recorder, affixed to document and then canceled. The ptoestants in general felt there was insufficient notice given to public, that given being improperly worded~ rising real estate transfer costs hinder sales; it is inequitable to impose tax only on those transferring property; and the high cost of collecting tax may offset revenue from it. The City Manager and the Vice Mayor stated that, in their opinions, coverage had been good, and the agenda is generally well-advertised over radio and in the press. It was conceded by protestants their action should have been started at the County level. On a motion by Councilman Crook, seconded by Councilman Harlowe, it was carried by the following roll call vote Ordinance No. 596 be adopted and the Mayor and Clerk be authorized to sign same, "An Ordinance Imposing /~ Documentary Stamp Tax On Each Deed, Instrument Or Writing By Which Land, Tenements, Or Realty Sold Within The City Of Ukiah Is Granted, Assigned, Transferred Or Otherwise Conveyed To Or Vested In The Purchaser Or Purchasers Or Any Other Person Or Persons." ABSENT: Councilman Henderson and Mayor Norgard 9 MINUTES OF THE ADJOURNED REGULAR MEETING OF THE COUNCIL OF THE CITY OF UKIAH NOVEMBER 30, 1967 - PAGE 2 COUNCIL RECESSES At this point, 9:45 P.M., the Vice-Mayor declared a brief recess, after which the Council reconvened at 9:55 P.M. RES. NO. 68-24 SUPPORTING ISSUANCE 200TH ANNIVERSARY COMMEMORATIVE STAMP On a motion by Councilman Crook, seconded by Councilman Harlowe, it was carried by the following roll call vote Resolution No. 68-24 be adopted and the Mayor and Clerk be authorized to sign same, "Reso- lution of the City of Ukiah, California, Supporting Issuance of California 200th Anniversary Commemorative Stamp." AYES: Councilmen Crook and Harlowe and Vice-Mayor Scotto NOES: none ABSENT: Councilman Henderson and Mayor Norgard. RES. NO. 68-25 GRANTING VARIANCE APPL. 68-3 (ALBERT F. NIDEROST) On a motion by Councilman Harlowe, seconded by Councilman Crook, it was unanimously carried Resolution No. 68-25 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Granting Variance Application No. 68-3 (Albert F. Niderost)." RES. NO. 68-26 GRANTING VARIANCE APPL. 68-7 (MABEL RENFRO) was unanimously carried Resolution No' 68-26 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Granting Variance Application No. 68-7 (Mavel Renfro).'l RES. NO. 68-27 GRANTING VARIANCE APPL. 68-8 (MENDOCINO LAKE SAVINGS AND LOAN ASSOC. On a motion by Councilman Harlowe, seconded by Councilman Crook, it was unanimously carried Resolution No. 68-8 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Granting Variance Application No. 68-8 (Mendocino Lake Savings and Loan Association)." REQUEST DELAY - BID CALL (.4) POLICE CARS The City Manager requested approval of delay in bid call on four police cars set for December 5, 1967. On a motion by Councilman Harlowe, seconded by Councilman Crook, it was unanimously carried to extend date of bid call on four police cars from December5, 1967 to December 12, 1967, bids to be received prior to 2:00 P.M. on that date. REQUEST TO COVER DOWNTOWN PARKING METERS The City Manager presented a request from the Downtown Merchant's .,Association to cover downtown parking meters with plastic bags for one week, paying to the City the average revenue received during a comparable time. Discussion followed concerning enforcement of the 1-hour limits, responsibility for maintaining the bags, malicious mischief, and weather damage, as well as a possible stipulation that agreement be negated if conditions are not strictly followed. SALES TAX REPORT The City Manager reported that he hoped to have a full Sales Tax Report for review at the next session. COUNCILMAN CROOK Councilman Crook noted that traffic movement on School Street is more fluid since completion of new parking lots. Councilman Crook asked status of Greyhound lot monies. The City Engineer answered that he had been advised by State Highway Department employees to wait until new procedures are in effect to transfer Gas Tax monies. WlLSEY & HAM ELECTRIC SYSTEM REPORT The City Manager advised that Mr. Heidrick would be unable to arrive until December 8 at the earliest. On suggestion from Councilman Harlowe, it was decided the Council would meet with the City Engineer and the Electrical Distribution Engineer to study and discuss the report December 4, 1967 at 7:30 P.M. ADJOURNMENT As there was no further regular business, Vice-Mayor Scotto declared the meeting adjourned at 10:25 P.M. after which the Council reconvened in an Executive Session.
