Councilmen Henderson and Hill were absent. COUNCILMAN NORGARD CITY CLERK' PRO' TEMPORE On a motion by Councilman Crook, seconded by Councilman Norgard, i't 'was unanimously carried Councilman Norgard be elected City Clerk pro tempore in the absence of the City Clerk. DISCUSSION OF PRELIMINARY 1968-69 PROPOSED BUDGET Budget was reviewed from the Expenditures through the Director of Finance account. Councilmen Henderson and Hill were absent. APPROVAL OF MINUTES On a motion by Councilman Crook, seconded by Councilma Norgard, was unanimously carried the minutes of the meeting of August 7, and the adjourned regular meeting of August 12' 1968 be approved submitted by the Clerk. SPECIAL WARRANTS it 1968, On a motion b/Councilman Norgard, seconded by_ Council Crook, it was unanimOusly carried Special Warrants #5567 in the amount of $2,695.00 be approved and ordered paid. PRESENTATION OF SCHEDULE RE ANNEXATION PROCEDURE A schedule regarding annexation procedure was reviewed by the City Attorney. He answered various questions directed to him by the Council concerning the different aspects of the procedures, after which Council determined to commence annexation proceedings of territory designated as Annexation No. 68-1 and No. 68-2. RES. NO. 69-14 GIVING CONSENT TO COMMENCE ANNEXATION PROCEEDINGS (ANNEXATION NO. 68-1 AND 68-2) On a motion by Councilman Norgard, seconded by Councilman Crook, it was unanimously carried Resolution No. 69-14 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Giving Consent to Commencement Of Proceedings To Annex Territories Desig- nated As Annexation No' 68-1 and No. 68-2" _ RES. CITY ATTORNEY REPORTS RE PROPOSED LEGISLATION The C i ty Governor fol lowing Attorney reported the Legislature was adjourned by Acting HUgh Burns, contrary to some doubts. He reported on the bills: SB1228 - A Measure Amending The Public Employer-EmPloyee Relations A'~t - requires that representatives of public agencies meet and confer "in good faith" with representatives of recognized employee organizations. There is no requirement in the bill that agree- ment must be reached. Decrease Unemploy~.ent: Increase Retirement Benefits - The Governor is expected to sign bills designed to aid the "hare-core" unemployed to find jobs. There are six bills comprising the 'lpackage'l and a report of the following were given by the City Attorney. AB 109 - Provides loans for for business development in poverty areas. ~- Provides incentives for banks to participate in such programs. !.29 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH AUGUST 14, 1968 - PAGE 2 AB1046- provides technical help to small businessmen who locate in disadvantaged urban areas. AB1966 - provides a tax incentive for job training. RES. NO. 69-16 COMMENDING CITY MANAGER On a motion by Councilman Crook, seconded by_ Councilman Norgard, it was unanimously carried Resolution No. 69-16 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Commending City Manager Of The City Of Ukiah". CONSIDERATION OF TENTATIVE MAP OAK MANOR SUBDIVISION UNIT 1-D The Tentative Map of Oak Manor Subdivision No. 1-D was presented for approval by the Council and the minutes of the Planning Commission meeting of August 1, 1968 and memorandum from the City Engineer dated August 8, 1968 were read by the City Manager. It was recommended by the Commission the map be approved as recommended by the City Engineer. Mr. Ed Carpenter, representing the Subdivider, was present in the audience and stated that all necessary corrections made by the Planning Commission had been complied with. Various aspects relative to the tentative map such as the subdivider's plan for fencing, plantings and their proposed location, required curb and gutter, and the cul de sac were discussed. On a motion by Councilman Norgard, seconded by Councilman Crook, it was unanimously carried to defer action for two weeks regarding the Tentative Map of Oak Manor Subdivision Unit No. 1-D. VARIANCE APPLICATION NO. 68-21 WILLIAM R. PUSER Variance Application No. 68-21 for reduction of setback from 20' to 5' at 494 Mendocino Drive' plot plan, and pictures of applicant's propert.y were reviewed by the Council. City Manager mad Planning Commission minutes dated July 22, 1968 and read a memorandum from' the City Engineer dated July 18, 1968, both recommending denial. Applicant was present in the audience and stated reasons which, in his opinion, warranted favorable consideration by the Council. Applicant presented statements from three surrounding property owners stating that in their opinion, the granting of this variance would in no way be detrimental to the area and requested that variance be granted. The aforementioned statements were made a part of the file. On a motion by Councilman Norgard, seconded by Councilman Crook, it was unanimously carried Variance Application No. 68-21 by William R. Puser' be denied as recommended by the Planning Commission. ZONE CHANGE APPLICATION NO. 68-1 (POMEROY-NIPPER) Action by the Planning Commission regarding Zone Change Application No. 69-1 by Pomeroy-Nipper to establish R2 instead of R1 zone at the Northeast corner of Perkins and Oak Manor Drive was reviewed by the City Manager as follows: 1) Plot plan and Planning Commission minutes dated 7-22-68. 2) City Engineer's memorandum dated 7- 18-68 recommending favorable consideration 3) Findings of Fact and recommendation for approval. On a motion by Councilman Norgard, seconded by Councilman Crook, it was unanimously carried a public hearing be held on Zone Change Application No. 69-1 on September 4, 1968 at 8:00 P.M. or as soon thereafter as same may be heard. 130 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH AUGUST 14~ 1968 - PAGE 3 APPROVAL OF LEASE - UKIAH VALLEY TRAP CLUB The proposed lease of a portion of the Old Sewer Farm as trap and skeet shooting range for the Ukiah Valley Trap Club was read in full by the City Manager. On a motion by Councilman Crook, seconded by Councilman Norgard, it was unanimously carried.the lease with the Ukiah Valley Trap Club be approved and the Mayor and Clerk be authorized to sign same. The City Manager will arrange for placement of signs on the fence and coverage of manholes on the property. REQUEST FOR USE OF HOUSE TRAILER AS RESIDENCE DENIED The City Manager read a letter dated August 2, 1968 from John E. Dodds requesting permission to place a house trailer on his property at 468 Mendocino Drive. City Manager cited Council action taken previously on a similar request by Glen H. Burger, 201E. Gobbi. Current pictures of the property were distributed which showed the unsatisfactory condition resulting from granting this request. The City Manager recommended that this property owner be notified to terminate the use of the trailer within 90 days and deny the request made by John E. Dodds. Mr. Dodds was present in the audience and stated reasons which, in his opinion, justified the request. On a motion by Councilman Crook, seconded by Councilman Norgard, it was unanimously carried that the request by Jonn E. Dodds to use a mouse trailer as a residence be denied. TERMINATION OF USE OF HOUSE TRAILER AS RESIDENCE - GLEN H. BURGER~. 20.1 .E.....G. OBBI .... On a motion by Councilman Norgard, seconded by Councilman Crook, it was unanimously carried to direct the City Manager and the City Attorney to terminate, as soon as practical, the use of the house trailer as a residence located at 201 E. Gobbi. FIRE AND POLICE DEPARTMENTS COMMENDED BY F.A.A. City Manager read a letter dated August 7, 1968 in which the Fire Chief and Police Chief were commended for the manner in which each department's personnel handled the situation at the time of the recent airplane crash in the city. PRESENTATION TO THE LOCAL OBSERVATORY. The City Manager reported that the Mayor had presented the Japanese bells to Mr. L. S. Caouette of the local Observatory on behalf of the Mayor of Mizusawa Japan. Mizusawa is the International Head- quarters of the five observatory system. TWELFTH DISTRICT FA IR The City Manager reported Councilman Hill had expressed regret for not being able to be present at the Council meeting and asked that the Council be reminded to be present at the Fairgrounds tomorrow night at 6:00 P.M. for the opening of the 1968 Twelfth District Fair. 131 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH AUGUST 14, 1968 - PAGE 4 COUNCILMAN CROOK Councilman Crook suggested that a.night be set in the budget hearings for discussions with the Librarian and Library Trustees as well as the Police Department request. The Attorney representing the Police Department will be heard at 7:30 P.M. Tuesday, August 30, 1968. The matters pertaining to the Library will be heard at 8:00 P.M., the same date. Council also agreed to meet in adjourned session Friday, August 16, 1968 at 7:30 P.M.
