HomeMy WebLinkAboutMin 11-06-68167 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH NOVEMBER 6, 1968 The City Council convened in regular session in the Council Chambers at 8:01 P.M. with Mayor Scotto, Councilmen Henderson, Crook, Norgard, and Hill present. APPROVAL OF MINUTES On a motion by Councilman Norgard, seconded by Councilman Henderson, it was unanimously carried the minutes of the meeting of October 23, 1968 be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Hill, seconded by Councilman Norgard, it was unanimously carried Payroll Warrants #272 to #297 inclusive and #13,180 to #13,326 inclusive for the period of October 16th through October 31, 1968, be approved in the total amount of $44,540.65. SPECIAL WARRANTS Prior to the approval of the Special Warrants, the CityAManager explained that Warrant No. 5980 in the amount of $14,918 to Metro- politan Electric was a progress payment due for the l iqhting pro- ject at the Airport. Warrant #5979 in the amount of $519'60 to Northern California Power Agency was the second half of the yearly dues. On a motion by Councilman Henderson, seconded by Councilman Crook, i't was unanimously carried Special Warrants #5970 to #5983 inclusive in the total amount of $24,179.68 be approved and ordered paid. RES. NO. 69-31 AMENDING NORTHERN CALIFORNIA POWER AGENCY JOINT POWERS AGREEMENT On a motion by Councilman Norgard, seconded by Councilman Henderson, i't was unanimously carried Resolution No. 69-31 be adopted and the Mayor and Clerk be authorized to. sign same, "Resolution Of The City Council Of The City Of Ukiah Amending Northern California Power Agency Joint Powers Agreement". CITY ATTORNEY REPORTS ON APPA LEGAL SEMINAR The City Attorney reported on the recent APPA Legal Seminar he recently attended in San Francisco. The purpose of the seminar was to acquaint attorneys within the APPA with present problems of public agencies with antitrust and labor relations. The following conclusions resulted from the meeting: 1) Unionism within governmental a~encies is not new. 2) Cities can expect much more union organizing activity in the future. .3). Collective bargaining will become even more extensive in the public sector in the future. 4) Prohibition against strikes by public employees where those employees are not directly involved with health and welfare are becoming outdated. INTRODUCTION OF ORDINANCE NO. 600 AMENDING SECTIONS 7050 & 7144 OF CITY CODE (VEHICLES ON STREETS) On a motion by Councilman Norgard, seconded by Councilman Hill, it was unanimOusly carried to introduce Ordinance No. 600, "Ordinance Amending Sections 7050 and 7144 Of The Ukiah City Code", and to waive the reading of same. 168 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH NOVEMBER 6, 1968 - PAGE 2 DISCUSSION OF STORM DRAINAGE PROBLEM City Manager asked for Council determination of policy regarding drainage problems in the city. This request was prompted by the loss in the case of Proft vs. City of Ukiah which resulted in a settlement to plaintiff in the amount of $3000. A detailed report of past City action in regard to drainage problems was given by the City Manager and City Engineer followed by a lengthy Council dis- cussion. It was suggested that the drainage problems could be alleviated to some extent on a joint city-property owner participa- tion basis or with the execution of a hold harmless waiver by the involved property owners. It was agreed that this appears to be generally workable plan, but in emergency cases, action should be left to the discretion of the City Manager and City Engineer. THE MAYOR DECLARED A FIVE MINUTES RECESS AT THIS POINT - 9:30 P.M. Council determined that the above stated procedure would be followed for the immediate problems, but that a storm drainage program be worked out in detail for subsequent. Council consideration. DISCUSSION OF ANNUAL AUDIT REPORT City Manager read the letter of transmittal accompanying, the annual audit report by Fitzpatrick and Poulsen and reviewed current action taken on each recommendation as well as pointing out areas in which there was a difference of opinion and errors. The Council asked for clarification of various parts of the report by the Auditors as well as correction of the errors. DISCUSSION OF IMPROVEMENT PROGRAM FOR FIRE DEPARTMENT City Manager distributed to the Council a report containing facts to be considered in next years budget regarding an improvement pro- gram for the Fire Department. Council indicated a favorable reaction to suggestions contained therein. ACCEPTANCE OF GRANT DEED (DEDICATION OF POMEROY AVE.) On a motion by Councilman Norgard, seconded by Councilman Crook, it was unanimously carried to accept the grant deed from J. H. Pomeroy and Company, Inc. for the dedication of Pomeroy Avenue. ACCEPTANCE Of GRANT DEED ( ORCHARD AVENUE )], On a motion by Councilman Norgard, seconded by Councilman Henderson, ~t was unanimously carried to accept the grant deed from J. H. Pomeroy and Company, Inc. for a strip of land 10' in width for future widening of Orchard Avenue. APPROVAL OF RELEASE OF BALANCE OF IMPROVEMENT BOND (OAK MANOR SUBDIVISION UNIT NO. 1 City Manager reported the City Engineer's memorandum dated 10-30-68 ...... has stated the subdivider has completed all the work required in Oak Manor Subdivision Unit No. 1. These improvements have been accepted by the Council and it was recommended that the remaining portion of the bond be released as requested. On a motion by Councilman Crook secOnded by Councilman Hill, it was unanimously carried to approve the release of the bond for improve- ments in Oak Manor Subdivision Unit No.1. TAX RATES WITHIN THE CITY In compliance with recent request, the Council was furnished with the reasons for tax rates which are in effect within the City for Fire District and Mi llview County Water District. 1_69 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH NOVEMBER 6, 1968 - PAGE 3 SALES TAX MEETING City Manager requested Council representation at the sales tax meeting with other incorporated cities. Councilman Norgard and Councilman Crook will represent the Council at this meeting scheduled 11-7-68. LAFCO MEETING City Manager California C in San Franc speaker. Th man Hill, wi reported receipt of a notice from the League of ities of a Local Agency Formation Commission meeting isco on 11-21-68. Assemblyman Knox will be the guest e Council representative to this commission, Council- ll attend this meeting. COUNCILMAN CROOK Councilman Crook commented favorably regarding the following: 1) Successful working of the railroad crossing signal. 2) The "Ukiah" sign painted on the airport runway. 3) Congratulations to Mr. Ralph Rains in his recent appointment in the State Firemen'Is Association. 4) Excellent publicity given the volunteer police recently. Councilman Crook reported he was looking forward to receipt of the information requested on the swimming pool complex. Councilman Crook asked for information regarding library. This information will be available at COUNCILMAN NORGARD the proposed the next meet ing. Councilman Norgard reported a complaint from the 500 block on Henry Street regarding the schedule of the street sweeper and enforcement of two hour parking on this street.
