DISCUSSION OF STORM DRAINAGE
PROBLEM
City Manager asked for Council determination of policy regarding
drainage problems in the city. This request was prompted by the
loss in the case of Proft vs. City of Ukiah which resulted in a
settlement to plaintiff in the amount of $3000. A detailed report
of past City action in regard to drainage problems was given by the
City Manager and City Engineer followed by a lengthy Council dis-
cussion. It was suggested that the drainage problems could be
alleviated to some extent on a joint city-property owner participa-
tion basis or with the execution of a hold harmless waiver by the
involved property owners. It was agreed that this appears to be
generally workable plan, but in emergency cases, action should be
left to the discretion of the City Manager and City Engineer.
