ADJOURNMENT There .being no further regular business, the Mayor declared the meeting adjourned at 11:21 p.m. to reconvene in personnel session. NO. 69-6 (TED CONNALLY ET AL) The City Manager again reviewed Variance Application No. 69-6 by Ted Connally et al to build a Jr. Department Store with frontage on South State, West Gobbi, and South Oak Streets, zoned C-1 and R-2 and Planning Commission Minutes dated April 17, 1969. He reported a revised plot plan had been received which showed a relocation of the loading zone, the original location of which was the objection expressed when considered by the Planning Commission. Planning Commission Resolution No. 69-9 recommended approval of said application with the following stipulations: l) Sidewalks, curbs and gutters to be installed by the developer. 2) The loading zone to be constructed at the south end of the building. 3) Fencing to be a chain link type and to be installed under the direction of the Building Department. Mr. Jack Cox, representing the applicant, was present in the audience and spoke in behalf of the application. There was no one present to express opposition to the granting of said application. RES. NO. 69-46 GRANTING VARIANCE TO TED CONNALLY ET AL (JR. DEPARTMENT STORE) On a motion by Councilman Crook, seconded by Councilman Scotto, 'it was unanimously carried Resolution No. 69-46 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Granting Variance To Ted Connally, Et al". FURTHER DISCUSSION OF STORM DRAINAGE PROJECTS In compliance with Council request to obtain information regarding federal funds which may be available to cities to help finance storm drainage projects, the City Engineer gave a detailed report of his meeting with the Soil Conservation Service and other investi- gations he had made. No optimism was expressed regarding a program which may be helpful since federal funding of this nature is determined on a cost benefit ratio and the City could not qualify on this basis. The City Engineer stated that possible ways to finance such projects would be by a flood control district, joint efforts of property owners, formation of local improvement district, or by tax levy. Council expressed the importance of a full Council when matters of.this nature are discussed. The City Manager was instructed to advise absent Council members what has been done to date and to continue to search for a possible solution to the problem. TAXI RATE ADJUSTMENT City Manager read a memorandum dated May 7, 1969, which had been distributed to the Council regarding recommended taxi rate adjust- ments. Said recommendation had been reviewed with and approved by the operator of the taxi company. Mr. Gus O'Farrell, Mendocino State Hospital, who had objected to the deviation in rates which in his opinion the company was charging, was present in the audience. He expressed his agree- ment to the terms set forth in the City Manager's memorandum and his appreciation to the Council for their consideration of this matter. The agreement with the taxi operator will be revised as recommended for subsequent consideration by the Council. MAYOR PRO TEM DECLARED A RECESS AT THIS POINT - 9.'17 P.M. 24O MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH MAY 7, 1969 - PAGE 3 PROPOSAL FROM UKIAH SANITARY DISPOSAL SERVICE FOR ADJUSTMENTS IN CONTRACT The City Manager read a memorandum dated May 5, 1969, which had previously been distributed regarding a request from Mr. Reuben Hohnstein, owner and operator of the Ukiah Sanitary Disposal Service. Mr. Hohnstein's request was for a five year extension of the present contract which expires December 31, 1970. Mr. Timothy W. O'Brien, Attorney for Mr. Hohnstein, was present" in the audience and spoke in regard to said proposal. He asked that the Council re-examine its bidding policy for this particular type operation and consider an ordinance amendment so that com- petitive bidding would be eliminated. This, in his opinion, would assure the highest level of service to the community. Two opinions were expressed by the Council: (1) that the City abide, by the contract until its termination and (2) that considera- tion be given to amendment of the ordinance. It was determined that th'e matter will be considered further during the summer of 1970. RECREATION & PARKS COMMISSION RECOMMENDATIONS RE SWIM PROGRAM The City Manager read that portion of the Recreation and Parks Commission minutes pertaining to the swim program. The Commission recommendations was for an increase in rates from 20¢ to 25¢ for elementary students, pool rental rates for private groups be set at $20 for the first 75 swimmers and $10 for the next 75 swimmers for a two hour period, and that the Unified School District pay a pro rata cost of their use of the pool. Action was deferred until Council had an opportunity to study the information distributed. REQUEST RE BUDGET PROJECT (DORA ST. FROM CLAY TO MILL) The City Manager read a memorandum from the City Engineer requesting a change in the budget project on Dora Street from Clay to Mill to include drainage facilities. Since this is required to properly reconstruct the street to select system standards, expenditure would qualify totally as a Gas Tax expenditure. After Council discussion, it was determined that the entire project be postponed and included as a gas tax expenditure in the coming budget for consideration at that time. REQUEST RE BUDGET PROJECT (MASON STREET) The. City Manager reported receipt of a communique from Northwestern Pacific Railroad would postpone a request that the Council consider a water main replacement between Norton Street and Smith Street at the time the budgeted work is done on Mason Street. The railroad company had been requested to install 1500' of curb and gutter along Mason Street which is owned by the railroad and indications are th~the matter is being considered by the company. Since it is advisable that this. be completed prior to street construction, it was recommended that action on this project be deferred at this time. REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR TRACTOR-LOADER City Manager reviewed the specifications for one tractor-loader and requested a trade-in of the 1932 Case tractor instead of the Ford tractor proposed in the budget and requested bid call opening at 2:00 P.M. POSTPONEMENT: TR I P TO RED BLUFF City Manager reported the schedt,led trip to Red Bluff to inspect the FAA facilities has been rescheduled to May 20th. The FAA officials and Airport Commission members have encouraged Council members to arrange to make this trip. MAYOR HENDERSON City Manager advised that Mayor 'Henderson is still hospitalized and is being transferred to U.C. Hospital, San Francisco. DOLPHIN CONCESSION AGREEMENT City Manager reported verbal approval to the revised concession agreement with the Dolphin Auxiliary has been expressed, but not executed. This matter will be brought to .the Courcil for their approval at the next meeting. CORRESPONDENCE: EMPLOYEES' ASSOCIATION City Manager reported he had distributed to the Council copies of a letter received from the Employees' Association. It was recommended that the matter be considered at the time Council discusses personnel recommendations and proper parties will be so notified. COUNCILMAN CROOK Councilman Crook referred to Council action regarding proposed work on Dom and Mason Streets and suggested that the proposed work on Dora Street be reconsidered at the next meeting. Councilman Crook inquired about the weed abatement program and was advised that all the survey work has been done and the paper work involved is under way. CITY ATTORNEYS SPRING CONFERENCE The City Attorney advised he would be attending the Spring Conference for City Attorneys next week.
