MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH
DECEMBER 17, 1969
The City Council convened in regular session in the Council Chambers at
8:00 p.m. with Mayor Henderson, Councilmen Scotto, Crook, Norgard, and
Hill present.
APPROVAL OF MINUTES
On a motion by Councilman Norgard, seconded by Councilman Scotto, it was
unanimously carried the minutes of the meeting of December 10, 1969, be
approved as submitted by the Clerk.
SPECIAL WARRANTS
On a motion by Councilman Crook, seconded by Councilman Scotto, it was
unanimously carried Special Warrants #1247 to #1358 inclusive in the
total amount of $73,314.79 be approved and ordered paid.
REQUEST FROM LEGAL SERVICES FOUNDATION
FOR IN-KIND CONTRIBUTIONS
The City Attorney read a letter dated December 11, 1969, from the Legal
Services Foundation of Mendocino County requesting that the City parti-
cipate in "in-kind contributions" to the foundation. Council tabled
the matter until a later date.
CITY ATTORNEY REPORTS
RE LEGISLATION
The City Attorney reported on legislation contained in current Sacramento
Newsletters:
Speaking of Taxes: Two major property tax relief proposals considered at
last week's joint hearing of the Senate & Assembly Revenue and Tax Committees.
could force the State to increase personal income taxes by 85%, or sales &
use taxes by 65%, according to State Finance Director Caspar Weinberger.
He said he was "strongly opposed to both issues" . . the initiative being
proposed by the California Teachers Assn. and the County Supervisors
Assn. and the County Supervisors Assn. of California; & Assem. Joe
Gonsalves' proposal to alter the State Constitution.
Board of Equalization recommendations included: Authorize counties to
collect property taxes in 4 or more installments; end restrictions on
review of property tax appeals taken to superior courts; subject public
lands leased to private users to full taxation; simplify administration
of the 1% local sales & use tax and eliminate special exemptibns for
utilities and carriers; provide more quity in the truck transporation
tax or eliminate it; eliminate.preferred treatment for insurance com-
panies; and end the inequity between diesel & gasoline use by raising
diesel fuel 2¢ a gallon because it is 50% more efficient.
Dos Rios Alternatives: Controversy over the Department of Water Resources'
plans for the Eel River is expected to erupt again following Water Re-
sources Director William Gianelli's report on alternatives to the proposed
Dos Rios high dam urged by the U.S. Corps of Engineers. Gov. Reagan had
halted planning on the Dos Rios project in May after he found it would flood
Round Valley in Mendocino County and force 350 Indians to be evacuated, and
called for a review of "all alternatives". Gianelli reported on 16 possible
alternatives and recommended consideration for 6 of them, all 6 calling for
at least a small dam at the Dos Rios site. Each of the 6 would provide a
minimum of 900,000 acre-feet of water annually at the Sacramento-Sa Joaquin
Delta. The 6 principal alternatives are divided into 30 basic plans and
2 routings: 1) A small Dos Rios Dam and reservoir which would not flood
Round Valley; 2) a medium sized Dos Rios Dam and reservoir with auxiliary
features to protect Round Valley and the Indian Reservations; & 3) Yellow
Jacket Dam and reservoir on the lower Eel River and a Dos Rios Dam. The
2 routings were an easterly diversion with holdover storage in Glenn
County; and a southerly routing via Clear Lake, with holdover storage in
Cache Creek.

REPORT OF STATUS OF
CLAIMS FOR DAMAGES
The City Attorney reported that three of the nine claims for damages
which had been filed with the City prior to November 14, 1969, had
been settled. They are:

APPROVAL OF COUNTY-CITIES
JOINT PLANNING COUNCIL AGREEMENT
The City Manager read in full the proposed "Agreement For Formation Of
A Mendocino County-Cities Joint Planning Council". Section 5 of said
agreement in which differences of opinion had been expressed, was
changed to the satisfaction of the City Manager and the County.
On a motion by Councilman Hill, seconded by Councilman Scotto, it was
unanimously carried to approve "Agreement For Formation Of A Mendocino
County-Cities Joint Planning Council" and the Mayor and Clerk be
authorized to sign same.
JOINT ANIMAL CONTROL PROGRAM
The City Manager read a letter from the County Administrator dated
December 15, 1969, which requested a delay in the proposed joint
City-County Dog Control Program to July 1970 or January 1971.
DISCUSSION WITH COUNTY ADMINISTRATOR
RE CITY-COUNTY LIBRARY OPERATION
City Manager distributed to the Council copies of a letter from the
County Administrator dated December 16, 1969, regarding the Board of
Supervisor's action proposingtwo plans to continue operation of the
City-County Library operation after June 30, 1969. A report regarding
library recommendations from the League of Women's Voters was also
distributed to the Council.
Mr. Albert P. Beltrami, County Administrator was present in the audience
and spoke with regard to the proposed continuance of the joint facility.
He stated that the two areas in which there appears to be a difference
of opinion is the County's requirament for a State certificated librarian
and the County's desire for representation on the Library Board of Trustees.
The City Attorney reviewed a memorandum dated December 17, 1969, which had
been distributed to the Council giving a legal opinion regarding possible
composition of the Library Board in the event the City and County enter
into a new agreement for joint library services.
Councilman Crook gave the following points for consideration:
1) Accept, with thanks, the County's salary offer for a certificated
Librarian. However, if a certificated librarian is not available,
a qualified librarian will be hired so there will be no disruption
of the agreement.
2) Continue with the Library Board as is. There is no objection to the
advisory com~nittee attending all Library Board meetings.
3) County should pay cash for its share of cost of the building and
land with provision for reimbursement in case of dissolution.

4. Appoint a commi~ee consisting of City Manager, City Librarian, and
one Library Board member together with the County Administrator and
andy other person appointed by the Board of Supervisors to prepare
an agreement to submit to the Council by January 7, 1970 so there
will be no interruption of our construction schedule.
Mr. Bob Axt, representing the Architect, was present in the audience to
report that the plans in accordance with Council action last week could
be held up upon instruction from the Council.
Councilman Hill made a motion to rescind former Council action regarding
size of the library. After discussion and in view of the statement made
by Mr. Axt, Councilman Hill withdrew his motion.
On a motion by Councilman Scotto, seconded by Councilman Crook, it was
unanimously carried to indicate to the Board of Supervisors Council
willingness to discuss a joint agreement through a committee consisting
of the City Manager, City Librarian, member of the Library Board of
Trustees, with committee recommendations to be presented to the Council
no later than January 7, 1970 and in the interim the Architect be in-
structed to hold work in abeyance until further notice.
Mr. Axt asked Council permission to submit to the County the proposed
plans and cost breakdown of the proposed library building. The Council
determined this to be confidential information to be distributed only
by the City.
REPORT OF ACHIEVEMENTS OF POLICE OFFICERS
City Manager reported that every officer of the Ukiah Police Department
has qualified for and has been awarded Commission certificates. The
following certificates were awarded by the Commission on Peace Officer
Standards and Training:

In addition to the above awards, Chief Donn Saulsbury, Sergeant R.-W.
Borecky and Patrolman L. E. Maxson hold Advanced Certificates from POST.
City Manager also reported the Police Chief has received a final grade
of A+ and a Certificate of Completion of the Municipal Police Administra-
tion Course conducted by the International City Managers Association
through Michigan State University.
On a motion by Councilman Crook, seconded by Councilman Hill, it was
unanimously carried to commend the Police Department for their achieve-
ment in the state sponsored certification program.
AWARD OF BIDS FOR OPERATION OF
CONCESSION STANDS (C.L. SWINNEY)
City Manager reviewed the bids received for operation of the concession
stands at Giorno Park and the Municipal Swimming Pool as follows and
recommended the award be made to the only qualifying bidder, C. L. Swinney.
Lack of a signature disqualified the other bid.
Mrs. Ruth Beals - 7~% of the gross receipts
Mr. C. L. Swinney, representative of Peoples Temple Disciples of Christ
Deonomination of Christian Churches - 5% of the gross
receipts.

On a motion by Councilman Norgard, seconded by Councilman Crook, it was
unanimously carried the bid for operation of the concession stands at
the Municipal Swimming Pool and Giorno Park be awarded to C. L. Swinney,
representative of People Temple Disciples of Christ Denomination of
Christian Churches.
MAYOR HENDERSON DECLARED A RECESS AT THIS POINT IN THE MEETING - 9'13 P.M.
AUDIT REPORT
City Manager distributed to the Council the annual audit report submitted
by Touche, Ross, Bailey and Smart and read the letter of transmittal which
accompanied the report. Each point contained therein was discussed by the
Council. The Council will give the report further study.
REQUEST AND AUTHORIZATION TO CALL FOR
BIDS FOR TRUCK CAB & CHASSIS
City Manager reviewed specifications for a 1970 truck cab and chassis
and recommended that the bid specify an alternate with a trade-in of a
1960 Studebaker chassis only. It was recommended the bids be received
prior to 2:00 p.m. January 14, 1970.
On a motion by Councilman Norgard, seconded by Councilman Hill, it was
unanimously carried the Clerk be authorized to call for bids for one
1970 truck cabn and chassis with an alternate trade-in of a 1960 Stude-
baker chassis only, bids to be received prior to 2:00 p.m. January 14,
1970.
BEACON ACCESS RENTAL
City Manager reported an increase in the rental rate has been imposed on
those who use the access road to the beacon. Said increase is from $100
to $720 per year. The City Manager recommended authorization to prepare
an agreement for one year duration and the Council determine during this
period of time the importance of this access at the increased rate.
On a motion by Councilman Crook, seconded by Councilman Hill, it was
unanimously carried to authorize the preparation of an agreement as
specified for use of the access road to the beacon and subsequent con-
sideration by the Council.
COVENANTS OF AP-4 AGREEMENT
WITH C.A.A. TERMINATED
The City Manager reported we have been advised by the Federal Aviation
Administration that the covenants of the AP-4 Agreement with the Civil
Aeronautics Administration were terminated November 21, 1969. The City
entered into said agreement with the Civil Aeronautics Administration
for construction of the Ukiah Municipal Airport November 21, 1941. As
successor to the C.A.A., the F.A.A. has determined that the intent and
purpose of the AP-4/DLAND Program has been accomplished.
PERKINS STREET RAILROAD
CROSSING SIGNALS
City Manager reported receipt of a notice from the Public Utilities
Commission advising the City will receive our payment January 1970 of
the proportionate share of the signals in the Perkins Street Railroad
Crossing.
COUNCILMAN SCOTTO
Councilman Scotto complimented the Fire Department on their excellent
and effective fire prevention program.

COUNCIIA[AN CROOK
Councilman Crook reported that at the recent firemen's dinner, thr&e
received special recognition for 25 years service as volunteer firemen.
1) Herman Runkel, 2) Walter Hoenig, 3) Lawrence Samsoe.
Councilman Crook suggested that a letter of thanks be sent to Senator
Collier for the time spent with the Council recently.
COUNCILMAN HILL.
Councilman Hill asked what could be done about the fire hazard which
exists in some of the buildings in the area of the recent large fire.
City Manager explained what has been done in the past and stated he
will check into the matter further.
Councilman Hill also complimented the Fire Department on the excellent
job they performed at the time of the recent three alarm fire.
CHRISTMAS GREETINGS FROM COUNCII.
Each member of the Council extended to all City employees a Merry
Christmas and a Happy New Year.
ADJOURNMENT
There being no further regular business, Mayor Henderson declared the
meeting adjourned at 10:10 p.m.
