HomeMy WebLinkAboutMin 04-08-70 3c2 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH APRIL 81 1970 The City Council convened in regular session in the Council Chambers at 8:00 p.m. with Mayor Henderson, Councilmen Scotto, Crook, Norgard and Hill present. APPROVAL OF MINUTES On a motion by Councilman Hill, seconded by Councilman Scotto, it was unanimously carried the minutes of the meeting of March 25, 1970 be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Norgard, seconded by Councilman Crook, it was unanimously carried Library Payroll Warrants #1105 to #1127 inclusive and City Payroll Warrants #1556 to #1689 inclusive for the period of March 16 through March 31, 1970 be approved in the total amount of $47,425.50. SPECIAL WARRANTS On a motion by Councilman Hill, seconded by Councilman Scotto, it was unanimously carried Special Warrants #1782 to #1789 inclusive, dated April 1, 1970 in the total amount of $2,211.36 and Special Warrants #1790 to #1795 inclusive, dated April 8, 1970 in the total amount of $19,002.52 be approved and ordered paid. CITY ATTORNEY REPORTS 1970 LEGISLATION Disclosure of Assets. Supreme Court Decision: The Supreme Court in its decision in the Carmel case held the 1969 Unruh Law unconstitutional. The City Attorney referred Council to his memorandum of April 7, 1970. Binding Arbitration. Policemen and Firemen. A.B. 98 (Warren) : This bill has not yet been set for hearing by the Assembly Committee on Labor Rela- tions. The bill would require compulsory arbitration of disputes over salaries, pensions and fringe benefits for policemen and firemen. The League of California Cities opposes this bill They feel that the ultimate control of government must remain with the public, and to delegate to any individual or group of arbitrators who are not responsible to the public control over 80% of the operating budget would be more intolerable than a strike. Policemen and Firemen. Retirement at Age 50. Mandatory. S.B. 601 (Short) Provides for retirement of police and firemen at 50 yrs. at 2% of com- pensation for each year of service. Percentages increase for ages over 50. Mandatory retirement at age 60. This bill is opposed by the League of California Cities. Police Salaries SB 695 (Dill) : Provides that cities and counties must pay incremental payments to policement on a monthly basis at an annual rate of $900 to policement holding a basic certificate; $1800 for intermediate certificate; $2400 for advanced certificate. Also provides for schedules of work and a minimum of 80 hours of paid training every two years. A declaration of intent to appropriate funds is included, but no funds are appropriated and additional salaries would be paid by cities regardless. Policemen and Firemen, Retirement, Restoration of Earnings Test AB 984 (Barnes) Would restore provisions for adjustment of industrial disability retirement allowances for safety members to reflect subsequent earnings of the retired _ ._. employee. This bill is scheduled for hearing by Assembly Committee on Public Employment and Retirement on April 13. It is supported by the League of California Cities. t ,3 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH APRIL 8, 1970 - PAGE 2 AB 1145 (Bagley & Hayes) : Would require that "Prior to holding any executive session the legislative body shall announce the reason for and the subject of each meeting. It is not yet set for hearing. S.B. (Mills et al.) : Deletes 45-55 split for state highway construction funds between north and south. Allocation would be made by State Highway Commission but would not change minimum district guarantees. In a surprise action, the Senate Committee on Transportation approved this bill. ACA 38 (Foran) : Would allow money to be used for governmentally owned transit system and pollution control. Now pending before the Assembly Committee on Elections and Constitutional Amendments. An accompanying bill, A.B. 729 would permit action by a City Council in determining the use of tax funds. ACA 8 (Biddle) : Would free 25% of funds for purposes "related to trans- portation". SCA 18(Mills) : Would permit up to 1/2 of funds for use for building rapid transit upon approval of local voters. On a motion by Councilman Crook, seconded by Councilman Norgard, it was unanimously carried the City Manager be instructed to express opposition to AB 98, SB 601 and SB 695 and support for AB 984. APPROVAL OF VARIANCE APPLICATION NO. 70-8 _(Mabel and Charles Renfro) Council considered this application at their meeting of March 25, 1970 and had referred it back to the Planning Commission for further study. The application was further considered at the Planning Commission meetin of April 2, 1970. The City Manager read the minutes of this meeting and also the memorandum from the Director of Public Works, dated April 2, 1970 in which he outlined his interview with James Moloughney, Social Service Worker with the County of Mendocino Welfare Department. The remaining questions were answered to the Council's satisfaction. On a motion by Councilman Crook, seconded by Councilman Scotto, it was unanimously carried to instruct the City Attorney to prepare a resolution granting variance Application No. 70-8 as recommended by the Planning Commission. VARIANCE APPLICATION NO. 70-9 (Albert F. Niderost) Variance Application No. 70-9 by Albert F. Niderost to permit construction of medical offices on parcel located on the northeast corner of Beacon Lane and So. Dora Street, zoned R-1. Plot plan and minutes of the Planning Commission, dated April 2, 1970, were reviewed by the City Manager. Plan- ning Commission Resolution No. 70-12 recommending the granting of the variance subject to the following special conditions was reviewed by the City Manager: 1. Standard Conditions 1 through 9. 2. Curbs, gutters and sidewalks be installed on the Dora Street frontage. 3. At least a minimum 20' setback be provided to all structures from the south property line (Beacon Lane) . 4. Applicant must provide off street parking to comply with the City of Ukiah Code with the parking area paved with Asphaltic Concrete Paving. Driveways and parking area to meet the approval of the City Engineer. 5. Drainage plan to be approved by the City Engineer. There were no written or verbal protests to the granting of the proposed variance. Albert Niderost was present on behalf of the application. On a motion by Councilman Norgard, seconded by Councilman Crook, it was unanimously carried the City Attorney be instructed to prepare a resolution granting Variance No. 70-9 to Albert F. Niderost as recommended by the Planning Commission. 384 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH APRIL 8, 1970 - PAGE 3 AIRPORT COMMISSION (Additional Hangars) A letter from the Ukiah Airport Commission, signed by Chairman R. H. Sarber, was read to the Council requesting its consideration of building a set of ten open hangars immediately. A. S. Kruth reviewed an aerial map of the airport pointing out the present "T" hangars and the location of the recommended hangars. It was acknowledged that the additional hangars are needed; however, the Council discussed the necessity of having a General Plan for the airport before any any permanent improvements can be made. Mayor Henderson requested the City Engineer to attend the next Airport Commission meeting to offer assistance and to discuss the formulation of a General Plan for the Ukiah Airport and report back to Council. RECREATION AND PARKS COMMISSION A memorandum from the Director of Recreation & Parks was read by the City Manager which stated that at their regular scheduled meeting on March 31, 1970, the Recreation and Parks Commission discussed and reviewed the question of closing the Pro Shop for one day per week. Following their discussion, Chairman Newell Rawles recommended that the Pro Shop, as well as the Ukiah Municipal Golf Course, should be kept open seven days per week; the Commission concurred. The City Manager also reported that he had discussed the matter with the Golf Pro who had stated the opinion that closing any day during playable weather would be a mistake. HERMANSON PROPERTY FOR FUTURE PARK SITE City Manager read a letter from the Recreation Commission recommending a new attempt at acquisition of the Hermanson Property for park purposes. After discussion, the City Manager was directed to ask the Commission Chairman to investigate further as to the actual availability of the property. Council also suggested a greater need on the east side of the City, and requested that the Commission consider the desirability of a park in the vicinity of Oak Manor Subdivision or the old Sewage Treatment Plant. RESOLUTION NO. 70-23 SUPPORTING GOVERNOR REAGAN'S 1970 SUMMER JOB CAMPAIGN FOR YOUTH On a motion by Councilman Norgard, seconded by Councilman Scotto, it was unani- mously carried Resolution No. 70-23 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution of the City Council of the City of Ukiah Supporting Governor Reagan' s 1970 Summer Job Campaign for Youth". MENDOCINO STATE HOSPITAL Hospital Administrator, Gus O'Farrell, and Wallace German of C.S.E.A. were present to request that a letter be sent to Governor Reagan outlining the tremendous value the State Hospital is to the people of California because of its excellent programs and services for the handicapped and the vital need to retain the hospital and its staff so that patients will not go without proper and adequate care. On a motion by Councilman Scotto, seconded by Councilman Norgard, the City Manager was directed to write a letter to Governor Reagan in support of the retention of Mendocino State Hospital.. The motion was unanimously carried. COUNCILMAN NORGARD Requested the Department of Public Works to review the present zoning map to see if changes were needed at this time. COUNCILMAN HILL Councilman Hill reminded the Council of The Firemens Dinner, April 11, 1970 and the need to respond to the invitations before that time. 38 ,E MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH APRIL 8, 1970 - PAGE 4 COUNCILMAN CROOK Councilman Crook raised the question of whether there would be adequate lighting if the softball field is moved to the High School property. He also mentioned the possibility that perhaps two lighted softball parks were needed. Councilman Crook recommended painting of the firehouse in conjunction with the present construction work. This will be investigated. Councilman Crook inquired into the status of the development of Vinewood Park. It was reported that the Engineering Department is proceeding with sprinkler system design and the City Council will be asked to approve specific improvement plans possibly by next week. The Councilman pointed out that the Lions Club and other Service organizations are anxious to proceed with their promised work projects. COUNCILMAN SCOTTO Councilman Scotto asked when the matter of the possibility of parallel parking on School Street would be before the Council and was advised in approximately two weeks. CITY MANAGER The City Manager reported that there will be a demonstration of gas fired vehicles on the parking lot of Mercer Building on April 13, 1970. Mr. Cash announced an Open House of Spanish Mountain Television on April 10, 1970 from 6:30 - 9:00 p.m. at their offices on Main Street. City Manager reminded the City Council of the Chamber of Commerce dinner on Friday, April 17, 1970 in the Masonite Room of the Palace Hotel to honor present and future Council members and staff. ADJOUNRMENT As there was no further regular business, Mayor Henderson, declared the meeting adjourned at 10:00 p.m. MAYOR ATTEST: CITY CLERK
