HomeMy WebLinkAboutMin 08-19-70 436 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH AUGUST 19, 1970 The City Council of the City of Ukiah convened in regular session in the Council Chambers at 8:02 p.m. with Mayor Norgard, Councilmen Scotto, Simpson and Henderson present. Councilman Buxton was absent. APPROVAL OF MINUTES On a motion by Councilman Henderson, seconded by Councilman Simpson, it was unanimously carried the minutes of the meeting of August 12, 1970 be approved as submitted by the Deputy Clerk. REGULAR WARRANTS On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unanimously carried Regular Warrants #2472 to #2589 inclusive in the amount of $70,000.53 be approved and ordered paid. PAYROLL WARRANTS On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unanimously carried Payroll Warrants #2802 to #2945 inclusive for the period of August 1 through August 15, 1970, be approved in the total amount of $45,639.19. PUBLIC HEARING ON ABATEMENT OF BUILDING (755 SOUTH STATE & 11.00 NORTH PINE) a) The City Manager reported that the dilapidated building owned by Mrs. Arlyss Bromm at 755 So. State Street has been cleared satisfactorily and complies with the City requirements for abatement. Compliance by Mrs. Bromm terminates the proceedings for abatement. b) Public Hearing in the matter of Kurt G. Schmitz property at 1100 No. Pine Street was continued from the meeting of July 22, 1970. City Manager reported owners had demolished the majority of the fire damaged building but additional work still is required to eliminate the hazard. No one was present in the audience to be heard. The City Manager recom- mended continuation of the hearing for an additional two weeks (Sept. 2, 1970) . On a motion by Councilman Scotto, seconded by Councilman Henderson, it was unanimously carried public hearing on abatement of the dilapidated building located at 1100 No. Pine Street be continued to September 2, 1970 in order to give the owner ample opportunity to complete the necessary cleanup work. RESTROOM CONSTRUCTION FOR VINEWOOD PARK A tabulation of bids received for the Concrete Block Comfort Building at Vinewood Park was reviewed by the City Manager: Russell Hansohn $8,263.00 Nolan Hunt $8.166.00 Christensen Construction $9,639.00 Wagner Construction Co. $72298.00 City of Ukiah Estimate - $72335.00 City Manager recommended the bid be awarded to Wagner Construction, Inc. On a motion by Councilman Henderson, seconded by Councilman Simpson, it was unanimously carried the bid from Wagner Construction Inc. be accepted as recommended. 8: 12 P.M. COUNCILMAN BUXTON ARRIVED AT THIS POINT. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH AUGUST 1$y, 1970 - PAGE 2 CONCRETE WORK ON CLAY STREET The City Manager reviewed the bids received for the Curbs, Gutters, Sidewalks, Driveways, Curb Returns, and Valley Gutters on Clay Street between State Street and Oak Street as follows: Christensen Construction $42859.55 Cloverdale Ready Mix $42962.04 �._ Wagner Construction, Inc. $52250.20 City of Ukiah Estimate $4,799.10 City Manager recommended the bid be awarded to Christensen Construction. On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unani- mously carried the bid from Christensen Construction be accepted as recommended. REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR ELECTRICAL UNDERGROUND CONDUCTOR FOR INSTALLATION AND WARE- HOUSE STOCK On a motion by Councilman Simpson, seconded by Councilman Buxton, it was unani- mously carried the Clerk be authorized to call for bids for Electrical Under- ground Conductor for Installation and Warehouse Stock, bids to be received prior to 2:00 P.M. on September 8, 1970. RESOLUTION NO. 71-7 GRANTING VARIANCE TO VINCENT H. ANGELL On a motion by Councilman Scotto, seconded by Councilman Henderson, it was unani- mously carried Resolution No. 71-7 be adopted and the Mayor and Clerk be author- ized to sign same, "Resolution Granting Variance To Vinvent H. Angell". FURTHER DISCUSSION OF PROPOSED CHANGE IN SPECIFICATION FOR GARBAGE DISPOSAL CONTRACT The City Council reviewed proposed operating changes in specifications for refuse collecting presented by the City Manager. The following recommended changes were made: 1. Section 6-a change from once each week to twice each week 2. Section 7-a change definition of Domestic Service to eliminate "from which a subscriber has engaged contractor'sservice 3. Section 7-b change to twice weekly - include 70 pound weight limit - change location to curbside 4. Section 7-04-b increase domestic rate to $3.00 per month for twice weekly pickup including surplus 4 cubic feet 5. Section 7-04-c change maximums from $1.25 to $3.00 - add section to set maximums for various size bins 6. Section 7-04-i add section to provide all city collection at no charge _._ 7. Section 8 change to provide billing and collecting by City except dump fees. Monthly payment to contractor to deduct a 10% billing and collect- ing charge and any additional amount established as a franchise payment — to city. Councaal discussed each recommendation giving their informal opinions. City Manager reported receiving several phone aid written comments from interested citizens as a result of publicity given by the news media. 438 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH AUGUST 19, 1970 - PAGE 3 Comments from the audience were heard and the following interested parties made statements and suggestions: Martin Boesel - representing the Junior Chamber of Commerce, expressed their opposition to any increase in the present rates. Mr. & Mrs. Walter J. Kaiser - suggested a seasonal service during leaf and tree pruning at which time the customer would pay a reasonable fee forthis extra pickup service. Mrs. Kaiser also suggested that the City look into the possibilities of re-cycling of newspapers and aluminum cans. Dean Devries - In favor of curbside service, compulsory pickup, and City billing. Al Young - Opposes compulsory pickup. Mr. Young expressed his opinion that it should be in the jurisdiction of the Health Depart- ment to enforce backyard cleanup. Burt Banzhaf - Voiced his opinion that twice a week pickup would be a burden to senior citizens. He feels that the charges should be levied by the contractor and billed by the con- tractor as refuse disposal is a private enterprise. No opposition to the curtailing of burning. Mr. & Mrs. Ralph Rains - Against compulsory pickup, curbside service and city billing. Against twice a week pickup. Lynetta Jones - Representing Northcoast Opportunities and Senior citizens. Against increase in rates and curbside pickup. Mr. & Mrs. Frank Zeek - Against curbside pickup, city billing. Public should be billed individually for extra pickup. Expressed concern that containers would be disappearing. Tim O'Brien - Discussed the problems encountered by the Contractor (Reuben Hohnstein) and emphasized the need for complete specifica- tions covering expected performance of the Contractor so that bidders will all be bidding for the same standard of service. Marvin Bowen - Against twice a week pickup. The rate should not be doubled. Against City billing. On a motion by Councilman Scotto, seconded by Councilman Henderson, it was unani- mously carried the subject of Specifications for Refuse Collection Service be continued at the meeting of September 2, 1970. LEAGUE OF CALIFORNIA CITIES SB 941 (Moscone) has been approved by the Senate and sent to the Assembly. This bill provides that cities must compensate all policemen at a rate of not less than one and one-half times the regular rate for all overtime or grant compen- sating time off at a rate of one and one-half hours for each hour of time worked beyond the regular time. Continued opposition is urged by the Leagueto preserve Home Rule in matters pertaining to salaries of City employees. The City of Ukiah opposes and will continue to oppose this bill. 1970 CENSUS City Manager reported that he is still investigating procedures required to challenge preliminary Census. The Bureau of Census will conduct a new census at City expense and reimburse City for its expense if more than a 37. margin of error is found. A recommendation from his office will soon be given to the Council. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH AUGUST 19, 1970 - PAGE 4 LIBRARY CONSTRUCTION FUNDS Library construction funds included in the H.E.W. appropriations were vetoed by the President but it is reported that Congress has overridden the veto. This action will initiate application for balance of grant funds. LOCAL AGENCY FORMATION COMMISSION ..,_ Councilman Simpson reported that he was sworn in as an official member of the L.A.F.C. The Commission is presently hearing arguments concerning the forma- tion of a special services district for the community of Mendocino to solve sewer and water problems.
