HomeMy WebLinkAboutMin 10-14-70 57 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH OCTOBER 14, 1970 The City Council of the City of Ukiah convened in regular session in the Council Chambers at 8:04 p.m, with Mayor Norgard, Councilmen Scotto, Buxton, Simpson, and Henderson present. APPROVAL OF MINUTES On a motion by Councilman Henderson, seconded by Councilman Scotto, it was unanimously carried the minutes of the meeting of October 7, 1970, be approved as submitted by the Clerk. i SPECIAL WARRANTS On a motion by Councilman Buxton, seconded by Councilman Henderson, it was unanimously carried Special Warrants #2739 to #2747 inclusive in the amount of $8,615.95 be approved and ordered paid. APPROVAL OF GRANT & DEDICATION OF PUBLIC UTILITY EASEMENT (ROBERT L. & ETHEL HUMPHREY) The City Attorney presented for Council consideration Grant and Dedication of Public Utility Easement executed by Robert L. and Ethel Humphrey to permit City to do essential work connected with drainage of street water and recommended said easement be approved. On a motion by Councilman Buxton, seconded by Councilman Simpson, it was unani- mously carried the Grant and Dedication of Public Utility Easement between the City and Robert L. Humphrey and Ethel Humphrey be approved and the Mayor and City Clerk be authorized to sign same. COMMITTEE REPORT COUNCIL-COMMISSION RELATIONS - - City Manager distributed to the Council a committee report regarding relation- ship between each commission appointed by the Council and the Council. The report which was read in full by the City Manager set forth a proposal whereby each commission would present current and long range programs to the Council through a coordinating commission rather than individually. Said coordinating commission was determined to be the Planning Commission. Commission representa- tives could meet with the Council regarding any recommendations which effect their proposal. Councilmen Henderson and Simpson, members of the committee spoke regarding said report. Council will give the report further consideration at the next meeting. INTRODUCTION OF ORDINANCE NO. 605 (GARBAGE, RUBBISH, & OTHER REFUSE) City Attorney distributed to the Council a proposed ordinance incorporating changes required to comply with specifications for garbage disposal contract. Council briefly reviewed the proposed ordinance prior to its reading and adoption at the next meeting. On a motion by Councilman Scotto, seconded by Councilman Buxton, it was unani- mously carried to introduce Ordinance No. 605, "Ordinance Of The City Of Ukiah Adding, Amending, And Repealing Sections Of Chapter 5, Division 5, Of The Ukiah City Code", and to waive the reading of same. PROPOSAL FROM DIVISION OF HIGHWAYS RE STATE STREET RELINQUISHMENT City Manager reported details of the position taken by the City at the time the Division of Highways proposed to relinquish State Street to the City after completion of the freeway. The ten items of protest made at the hearing before the State Highway Commission were reviewed by the City Manager. Discussions have been held for five years and based on the original discussions, the State agreed to make improvements in the amount of $30,000 to bring said street to acceptable City standards. Correction of critical deficiencies by the Division of Highways now totals $235,000. City Manager recommended the matter be reviewed in detail at the November 4, 1970, meeting with representatives of the Division of High- ways. A current legal opinion will be available at that time. LEAGUE OF CALIFORNIA CITIES CONFERENCE City Manager reminded the Council of the League meeting October 25-th - 28th and reported reservations will be confirmed at the next meeting. DISCUSSION WITH REPRESENTATIVES OF OPERATING ENGINEERS LOCAL UNION NO. 3 City Manager read a report of the current positions on employee salaries and fringe benefits which was the result of six months of discussions with re- presentatives of Operating Engineers Local Union No. 3. Copies of Resolution no. 70-6 appointing the Employee Relations Officer were included with the report which had been previously distributed to the Council. The points of agreement resulting from the meet and confer sessions were: 1) Lincoln's Birthday, Admission Day, and Columbus Day be reestablished as City holidays and after 7-1-71 the holiday schedule set forth in the Government Code be followed. 2) Increase employee life insurance at City expense from $2,000 to $5,000. 3) Retirement benefits to be reviewed in depth by a committee consisting of union representatives, employee representatives, and Employee Relations Officer to develop an understanding of available options and to establish a mutually agreeable basis for future recommendation. Study to be com- pleted at the earliest practical time. 4) Employees assigned to "standby" duty shall receive pay at the rate of two hours per day straight time and pay at time and one half for all time worked in increments of one (1) hour in excess of their regular work day. 5) Any employee properly and formally assigned to perform the dut:bs of a higher pay classification for a full day or more shall receive pay at the rate of the higher classification. 6) Employees required to work in increments of four (4) consecutive hours outside their normal work day shall be furnished with one meal for each four hours worked if not furnished by other sources. 7) Position classification study to be completed as soon as practical after January 1, 1971. The study may be conducted as originally planned or by contract if agreeable. 8) Replacement at City expense of eyeglasses and job required equipment damaged or destroyed while on duty to be considered on the merits of each individual case. 9) Three calendar weeks annual vacation to be granted to each classified employee after five years of classified service. Employees who have com- pleted 14 years of classified service during 1970 calendar year will be granted 16 work days annually after completion of 15 years of service and employees currently being granted 16 days will remain on same basis. 10) Employees not on standby, if called bakc to work after regular working hours will be paid at time and one half in increments of one hour. 11) City will make payroll deduction of union dues once each month when fur- nished by the union with an acceptable authorization signed by the employee prior to the 15th of the month during which deducation is to be made for the following month dues. 12) A career incentive program to be established for sworn police personnel providing a 2k/. salary increase for qualifying for and being granted a P.O.S.T. Intermediate Certificate plus an additional 2Y/. for qualifying for and being granted a P.O.S.T. Advanced Certificate. Similar recogni- tion to be considered if and when acceptable vocational training programs are developed for other vacations. 13) Police uniform allowance to be increased for sworn uniformed personnel from $10.00 to $20.00 per month. City Manager reported the State Government Code requires that, subject to estab- lishing an appropriate unit, city governments are mandated to meet and confer in good faith. The City has adopted a recognition procedure and a majority of the employees have determined Operating Engineers Local Union No. 3 to be their representatives to meet and confer. The law also states this does not deny individuals or groups from being heard. Mayor Norgard complimented the City Manager on his actions with the union re- presentatives and stated it was his hope that the Council proceed in such an orderly manner. The Mayor recognized union representatives present in the audience and stated Council would consider their presentation; however, a decision would be made at a subsequent meeting. Mr. E. M. Balatti, spokesman for the Union, indicated general agreement with the report submitted by the City Manager. However, he requested clasification of the Firemen's work week and stated he was of the opinion it would be a part of this report. Mr. Balatti also referred to Item No. 7 of said report and stated the Union's reason for pulling off of the position classification study and the expense involved in having a private agency complete it was to include the proposed 2Y/. increase January 1, 1971. There was a difference of opinion in that portion of the City Manager's report pertaining to the impasse and the amount of drop in employee life insurance proposed by the Union to substantiate for the additional salary increase effective January 1, 1971. City Manager indicated his willingness to include clarification of firemen's work week in the list of points of agreement. Mr. Balatti reported that in the event agreement cannot be reached, he would recommend a state mediation service which is available at no cost to either party. Mr. Balatti stated this service maintains a neutral position and will work until agreement is reached. Councilman Scotto stated his opposition to the use of such a service. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH OCTOBER 14, 1970 - PAGE 4 Council discussed various aspects of the presentation and inquired as to the date for completion of salary recommendations for employees not a part of this report. City Manager indicated this portion of the report could possibly be prepared for presentation next week. After discussion, Council determined salary recommendations for all employees will be discussed November 4, 1970. APPROVAL OF REQUEST FROM DOWNTOWN MERCHANTS ASSOC. City Manager reported the Downtown Merchants Association has again requested permission to cover parking meters in the downtown area prior to Christmas. City Manager recommended authorization to cover 246 parking meters December 10th to December 24, 1970, inclusive at a rate of 25�, per day per meter for a total of $738.00 as per the request. On a motion by Councilman Scotto, seconded by Councilman Buxton, it was unani- mously carried to grant the request by the Downtown Merchants Association as recommended by the City Manager. DOG POUND AGREEMENT City Manager reviewed the changes proposed in the dog pound agreement which had been previously approved by the Board of Supervisors and submitted to the Council for consideration at the previous meeting. A sketch of the area proposed to be leased to the County for construction of said facility was re- viewed by the City Manager. A metes and bounds description of the site has been prepared and a formal lease of said area will be prepared relating to the dog pound agreement. City Manager was directed to refer said agreement to the Board of Supervisors for their consideration and subsequent consideration by the Council. LIBRARY CONSULTANT AGREEMENT REINSTATED City Manager reported he has conferred with the Library Consultant and State officials and it appears services of a Library Consultant are required to avoid jeopardizing the grant money available for the library construction pro- ject. The Consultant has indicated his willingness to complete the additional work on the terms of the original agreement. The City Manager recommended the contract with the Library Consultant be reinstated for an approximate fee of $1,500 to $2,000 but within the 1% fee contained in the agreement. On a motion by Councilman Simpson, seconded by Councilman Buxton, it was unani- mously carried to reinstate the agreement with the Library Consultant as recom- mended by the City Manager. PATHFINDER PARADE City Manager reminded Council of the Pathfinder Parade Sunday, 2:00 p.m. Mayor pro tem Henderson and the City Manager will ride in the parade. PERSONNEL SESSION City Manager requested a 5 minute personnel session at the conclusion of the regular meeting. CITY ATTORNEY City Attorney requested feedback to him with regard to Council review of re.,._.. Ordinance No. 605. CITY COUNCIL City Council briefly discussed the need for their consideration of downtown renewal and general improvement to the City. 461.
