HomeMy WebLinkAboutMin 11-04-70 465 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH NOVEMBER 4, 1970 The City Council convened in regular session in the Council Chambers at 8:00 p.m. with Mayor Norgard, Councilmen Scotto, Buxton, Simpson, and Henderson present. APPROVAL OF MINUTES On a motion by Councilman Scotto, seconded by Councilman Buxton, it was unani- mously carried the minutes of the meeting of October 21, 1970, be approved as submitted by the Clerk. SPECIAL WARRANTS On a motion by Councilman Buxton, seconded by Councilman Henderson, it was unani- mously carried Special Warrants #2882 to #2888 inclusive in the total amount of $1,054.11 be approved and ordered paid. WEED ABATEMENT PUBLIC HEARING City Manager reported this as being the time and place set for weed abatement hearing continued from the September 16, 1970 meeting. Mayor Norgard declared the public hearing open at 8:03 p.m. It was reported said hearing is conducted pursuant to Section 39576 of the Government Code and in accordance with said code the City Engineer has kept an accounting of abatement costs where work was done by the City. There was no one present in the audience to express an objection to said costs. The public hearing was declared closed at 8:04 p.m. On a motion by Councilman Henderson, seconded by Councilman Simpson, it was unani- mously carried to confirm the "Report Of Costs Of Weed Abatement By Director Of Public Works" dated September 11, 1970. PROPOSED STATE STREET RELINQUISHMENT City Manager reported the Division of Highways has requested postponement of consideration of the proposed agreement for improvements to State Street in return for City acceptance of relinquishment. The matter has been held up by the State due to a legal technicality and will be brought to the Council for their consideration at a subsequent meeting. CITY ATTORNEY REPORT The City Attorney reported the following items will be brought to the Council in the near future for their consideration: 1) Burning Ordinance to become effective 1-1-70. 2) Zoning Ordinance regarding Waugh Lane property. 3) Review of expired leases. 4) A written legislative report highlighting legislations that directly effects the City. AWARD OF BID FOR REFUSE COLLECTION TO JAMES RUSSELL AND PHILLIP WARD City Manager reported the check of references of the higher bidder for the refuse collection contract has resulted in favorable information. The bidder' s work for governmental installations has been handled in a satisfactory manner. City Manager recommended said bid be awarded to Russell and Ward for a franchise payment to the City in the amount of 25% of the gross revenue. - Two of the bidders, Mr. Tom Walters, Santa Rosa; and Mr. Marvin Bowen, Ukiah, were present in the audience to ask Council consideration of their bid. Each stated the high bidder lacked experience in house to house refuse pickup and dump site management. In their opinion, without strict and accurate accounting methods and good business practices such a large franchise payment could result in an inade- quate margin of profit for the bidder. 466 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH NOVEMBER 4, 1970 - PAGE 2 Mr. Russell stated his experience was adequate in both areas questioned by the aforementioned bidders and with a degree in accounting, he was aware of the im- portance of his margin of profit. Councilman Scotto stated he was of the opinion it is important to make bid awards to local firms, if possible. On a motion by Councilman Buxton, seconded by Councilman Henderson, it was carried by the following roll call vote the refuse collection contract be awarded to the - x high bidder James Russell and Phillip Ward, Potter Valley, in the amount of 25% of the gross revenue. AYES : Councilmen Buxton, Simpson, Henderson, and Mayor Norgard. NOES: Councilman Scotto ABSENT: None. APPEAL BY MRS. ROSE CURTIS VARIANCE APPLICATION NO. 71-1 City Manager reported Mrs. Rose Curtis, 577 Clara Avenue, who was granted a variance to operate a rest home was present in the audience to ask Council con- sideration of an appeal for relief from one condition relating to said variance. The matter had been considered by the Planning Commission and their original position was maintained. City Manager reported recent legislation relates dir- ectly to this type operation and that portion of AB 2406, effective November 23, 1970, was read. Said legislation considers rest homes a residential use and therefore permitted without a variance after the aforementioned date. City Manager stated in view of said legislation, this is a moot question and no Council action is necessary. Council agreed. NOTICE OF COMPLETION (CLAY STREET) A memorandum from the City Engineer dated October 30, 1970, was reviewed stating the Contractor, Christensen Construction has completed all work required under the contract for concrete curbs, gutters, sidewalks, etc. on the above named street. The City Manager recommended the work be accepted as complete and the Clerk be authorized to file the required Notice of Completion. On a motion by Councilman Scotto, seconded by Councilman Buxton, it was unani- mously carried concrete curbs, gutters, sidewalks, etc. on Clay Street between State Street and Oak Street be accepted as complete and the City Clerk be authorized to file the required Notice of Completion. SALARY & FRINGE BENEFIT ADJUSTMENTS City Manager reported meeting with the union representative this date to discuss the proposal presented to the Council October 14, 1970, setting forth results of and the impasse reached in the meet and confer sessions. A memorandum dated 11-4-70 was distributed to the Council setting forth recom- mendations effecting management employees and employees privy to confidential information. Said recommendations will be considered at the November 18, 1970, meeting. Said discussions this date resulted in agreement which modified this original proposal to this extent: 1) Point No. 2 of original recommendation - Life Insurance increased from $2,000 to $3,000. 2) Point No. 7 of the original recommendation - Completion of the position classification study no later than June 30, 1971. 3) Point No. 13 of the original recommendations pertaining to Fire Depart- ment personnel - Fire Department personnel provided with coveralls in- stead of smocks. 467 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH NOVEMBER 4, 1970 - PAGE 3 4) The point which resulted in an impasse in the original recommendation was the amount of the proposed salary increase effective 1-1-71. Mr. E. M. Ba,latti, who was present in the audience, stated he had been appointed spokesman for the Operating Engineers Local Union No. 3 due to his experience in public employee groups. Mr. Russell Swanson had, in original correspondence with the City Manager, been appointed as said representative. Mr. Swanson was present in the audience and agreed to the spokesman assignment. A general Council discussion followed which clarified for the Council various points set forth in the proposal. Under Point No. 12 of the original recom- mendation it was determined that the career incentive program shall be afforded to all employees. On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unani- mously carried to approve the salary and fringe benefit adjustments resulting from meet and confer sessions with Operating Engineers Local Union No. 3 as set forth in memorandum dated October 13, 1970, and modified this date. CORRESPONDENCE RE PROPOSED LEASE FOR FLIGHT SERVICE STATION City Manager reported FAA has advised they concur with the suggestion that execution of the lease of subject station be held up until an accurate cost figure is developed. CORRESPONDENCE RE LIBRARY GRANT City Manager reported State Librarian's office has advised that money for library construction has been released for the current and the next fiscal year. The City is eligible for a percentage of this allocation, however, there is no assurance that more than the $95,000 which has been approved will be received. Application will be submitted for maximum amount. o� MENDOCINO COUNTY PROPERTY TAXES City Manager distributed to the Council a current tabulation of City owned property subject to County taxes. The increased taxes of the dump site property will necessitate negotiations with the County for their use of the dump. COUNCILMAN SCOTTO Councilman Scotto asked for a report of progress made on Vinewood Park. City Engineer gave a tentative schedule of plans for the park, including the tenta- tive date for seeding of the area. Councilman Scotto asked about library construction progress and City Manager advised he would be meeting with the Architect regarding a progress report. The City Attorney is working on the contract document to accompany the bid call. COUNCILMAN SIMPSON Councilman Simpson statedinterest in the feasibility of reclamation of glass, paper, and aluminum. Councilman Simpson, Council representative to LAFCO, gave a report of said meeting he recently attended. MAYOR NORGARD Mayor Norgard reported that all citizens should be informed of the new rules and regulations regarding garbage collection. The information will be printed and distributed to each customer. Mayor reported he enjoyed the League meeting he recently attend in San Diego. 468 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH NOVEMBER 4, 1970 - PAGE 4 ADJOURNMENT There being no further regular business, Mayor Norgard declared the meeting adjourned at 9: 13 p.m. , to meet again November 18, 1970.
