HomeMy WebLinkAboutMin 12-02-70 4 713 MINUTES OF THE MEETING OP THE CITY COUNCIL OF THE CITY OF UKIAH DECEMBER 2, 1970 The City Council convened in regular session in the Council Chambers at 8:00 p.m. with Mayor Norgard, Councilmen Scotto, Simpson, and Henderson present. Councilman Buxton was absent. APPROVEL OF MINUTES On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unanimously carried the minutes of the meeting of November 18, 1970, be approved as submitted by the Clerk. SPECIAL WARRANTS On a motion by Councilman Henderson, seconded by Councilman Simpson, it was unani- mously carried Special Warrants #3000 to #3008 inclusive in the total amount of $7528.69 be approved and ordered paid. PAYROLL WARRANTS On a motion by Councilman Simpson, seconded by Councilman Henderson, it was unani- mously carried Payroll Warrants #3654 to #3802 inclusive for the period from November 1st to November 161 1970, be approved in the total amount of $45,951.91. ADOPTION OF ORDINANCE NO. 607 PROHIBITING OPEN OUTDOOR FIRES On a motion by Councilman Scotto, seconded by Councilman Henderson, it was carried by the following roll call vote Ordinance No. 607 be adopted and the Mayor and Clerk be authorized to sign same, "Ordinance Of The City Of Ukiah Amending Chapter 3 of Division 6 Of The Ukiah City Code and Further Prohibiting Oren Outdoor Fires By Adding Chapter 8 To Division 6 Of The Ukiah City Code". AYES: Councilmen Scotto, Simpson, Henderson, and Mayor Norgard NOES: None ABSENT: Councilman Buxton. ADOPTION OF ORDINANCE NO. 606 ESTABLISHING METHOD FOR COLLECTION OF GARBAGE COLLECTION CHARGES There was general Council discussion regarding subject ordinance. The City Manager answered questions raised by Mr. Ira Brannon who was present in the audience to inquire about the purpose of the ordinance. On a motion by Councilman Scotto, seconded by Councilman Simpson, it was carried by the following roll call vote Ordinance No. 606 be adopted and the Mayor and Clerk be authorized to sign same, "Ordinance Of The City Of Ukiah Adding, And Amending Sections Of Chapter 5, Division 5 Of The Ukiah City Code11. AYES: Councilmen Scotto, Simpson, Henderson, and Mayor Norgard. NOES: None ABSENT: Councilman Buxton PROPOSED UNDERGROUNDING ORDINANCE The City Attorney distributed for Council consideration a proposed undergrounding ordinance for the orderly placing of overhead wires and appurtenances. Said ---. ordinance is an enabling ordinance setting forth a means for establishing an Underground Utility District. Subject ordinance will be given further consideration in two weeks. CONSIDERATION OF PETITION REGARDING MALICIOUS MISCHIEF AND VANDALISM (SEMINARY AVENUE ARES) City Manager reported copies of a petition from various business firms along or near Seminary Avenue and a memorandum from the City Manager's office dated December 1, 1970, had been previously distributed to the Council. A second petition was submitted to the City Manager prior to the meeting and was read in full. Both petitions set forth complaints regarding malicious mischief and vandalism to their places of business with accompanying photographs. Both petitions cited four possible solutions to the problem for consideration by the Council. Mr. George Kuck and Mr. Walt Woodard were present in the audience to substantiate statements 474 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH DECEMBER 2 1970 - PAGE 2 made in the petition and state their personal experience regarding said damage. On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unani- mously carried to direct the City Attorney to prepare an ordinance to be adopted as an emergency measure prohibiting public use of the park area located on Seminary Avenue for consideration at the next meeting. COUNCILMAN HENDERSON WAS EXCUSED AT THIS POINT IN THE MEETING - 8:44 P.M. DISCUSSION REGARDING PROPOSED BAN OF NON-RETURNABLE BOTTLES City Manager reported action taken by the League of California Cities and cities in other areas to reduce waste material by banning non-returnable bottles and cans used for carbonated beverages. A resolution in this regard adopted by the City of Modesto was reviewed by the City Manager and set forth a recommendation that banning of such containers should be done on a state wide basis. Council con- sensus indicated no opposition to taking action at an appropriate time and directed the City Manager to keep the Council advised in this regard. NOTICE OF COMPLETION (ORCHARD, CLAY & MASON STREETS A memorandum from the City Engineer dated November 30, 1970, was reviewed stating the contractor, Parnum Paving, Inc. has completed all work required under the contract for asphalt concrete surfacings on Orchard, Clay, and Mason Streets. The City Manager recommended the work be accepted as complete and the Clerk be authorized to file the required Notice of Completion. On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unanimously carried asphalt concrete surfa cings on Orchard, Clay and Mason Streets be accepted as complete and the City Clerk be authorized to file the required Notice of Com- pletion. OAK MANOR SUBD. UNIT 2A ACCEPTANCE OF IMPROVEMENTS A memorandum was read from the Director of Public Works dated December 2, 19702 advising that all required improvements have been completed in Oak Manor Sub- division, Unit 2A and recommended acceptance of same on behalf of the City by the City Council. On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unanimously carried the City Council accept the improvements as complete in Oak Manor Subdivision Unit 2A. PROPOSED BUDGET RECOMMENDATIONS The Council was provided with a memorandum from the City Manager and a list of recommended items and projects to be deleted from the budget to provide funds to finance the salary and fringe benefit program approved by the Council. After general discussion, Council determined to schedule discussion of the proposed recommendations Wednesday, December 9, 1970, at 7:00 p.m. CHAMBER OF COMMERCE BUDGET Representatives of the Chamber of Commerce were present in the audience for the purpose of determining Council decision of their budget request. Council agreed to make an advance to the Chamber to serve until decision of their budget could be made. Mr. Jim Kelly, Chamber of Commerce President, stated a week delay would not impose an undue hardship and agreed to wait for Council decision until that time. COUNCILMAN BUXTON The City Manager advised the Council that Councilman Buxton's absence was due to a death in the family. 4 71 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH DECEMBER 2, 1970 - PAGE 3 INVITATION TO COUNCIL City Manager reported the Councilmen and their wives were invited to the Golden Gate Bridge Board meeting at the House of Garner, 6:30 p.m. , December 3, 1970. CONGRESS FOR COMMUNITY PROGRESS Mr. Marshall Leve was present in the audience and advised the Council the tentative date for the Congress for Community Progress is December 17, 1970, 3: 30 pm at the High School. Each Councilman was invited to attend. MAYOR NO RGA RD Mayor Norgard requested Pacific Telephone be contacted to see when direct dialing will be introduced in Ukiah. The City Manager will make the contact. Mayor Norgard asked of progress made concerning purchase of park property east of town and was advised an answer should be available by the next meeting. Mayor Norgard inquired about the library schedule and was advised the Architect stated the December 15th schedule for bid call will be met. ADJOURNMENT There being no further regular business, Mayor Norgard declared the meeting adjourned at 9: 27 p.m. to meet again December 9, 1970, at 7:00 p.m. MAYOR ATTEST: CITY CLERK
