HomeMy WebLinkAboutMin 01-06-71 480 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JANUARY 6. 1971 - PAGE 1 The City Council convened in regular session in the Council Chambers at 8:03 p.m. with Mayor Norgard, Councilmen Scotto, Buxton, Simpson and Henderson present. APPROVAL OF MINUTES On a motion by Councilman Simpson, seconded by Councilman enderson, it was unani- mously carried minutes of the meeting of December 16th and December 30, 1970, be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Henderson, seconded by Councilman Scotto, it was unanimously carried Payroll Warrants #4048 to #4193 inclusive, for the period from December lst to December 15, 1970, be approved in the total amount of $47,877.71. SPECIAL WARRANTS On a motion by Councilman Buxton, seconded by Councilman Simpson, it was unani- mously carried Special Warrants #3142 to #3149 inclusive in the total amount of $9519.77 be approved and ordered paid. Mr. Paul J. Trouette, Jr., 812 W. Church, was present in the audience and requested that he be allowed to examine the Register of Special Warrants. The one question he asked was answered by Councilman Buxton. Councilman Scotto asked Mr. Trouette if he wished to examine the Payroll Warrants and received a negative answer. ORDINANCE NO. 608 ADOPTED (UNDERGROUND FACILITIES IN UNDERGROUND UTILITY DISTRICTS) —T The City Attorney briefly reviewed, for the benefit of the people in the audience, Ordinance No. 608 which had been introduced at a previous Council meeting. Mr. Walter George, Ukiah Warehouse Sales and Mr. Warren Spolini, Foster Freeze asked questions which were answered by the City Manager and City Attorney. On a motion by Councilman Scotto, seconded by Councilman Simpson, it was carried by the following roll call vote Ordinance No. 608 be adopted and the Mayor and Clerk be authorized to sign same, "An Ordinance Of The City Of Ukiah Adding Chapter 3 To Division 4 Of The Ukiah City Code Thereby Establishing Regulations And Procedures For The Removal Of Overhead Utility Facilities And The Installation LY Of Underground Facilities In Undeeground Utility Districts". DENIAL OF CLAIM FOR DAMAGES (JAMES 0. LOGAN, 110 NORTON ST.) The City Attorney reviewed a claim for damages filed by James 0. Logan, 110 Norton Street Apt. #2, in the amount of $65.00. Claimant alleged City crews, while work- ing on Norton Street, splattered liquid road tar on his automobile which resulted in damage to the paint on said vehicle. Correspondence from the Department of Public Works indicated that on the time and day the alleged damage occurred, the City crews were not involved in this type work. The City Attorney recommended the claim be denied. On a motion by Councilman Henderson, seconded by Councilman Scotto, it was unani- mously carried the claim for damages by Mr. James 0. Logan in the amount of $65.00 be denied. CITY ATTORNEY REPORTS The City Attorney reported two memorandums with accompanying information had been distributed to the Council for their information. Said memorandums reviewed 1970 Legislation affecting cities and the handling of claims against the City made pursuant to Government Code Section 910. 484 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JANUARY 6, 1971 - PAGE 2 DISCUSSION OF GARBAGE COLLECTION PROBLEMS For the benefit of those present in the audience, the City Manager reviewed events leading to the award of the garbage contract and the manner in which problems have been handled during the first week of operation by the new owners. The City Manager pointed out specifications which were the basis for the award of the bid contained a procedure for appeal; however, to date his office has received only one written complaint and another written complaint was pre- sented to each Councilmen prior to the meeting. City Manager reported a majority of the verbal complaints have been from commercial accounts and after clarification of the points in question, general satisfaction was expressed. The following persons were present in the audience and spoke to register their complaints to the rate to be charged for their garbage service and for answers to general questions: Paul J. Dyckman, 1063 Alice Avenue Hank Riva, 6591-2 Marshall Paul Hansen, Palace Place, 252 North State Street Earl Tate, A & W Root Beer, 737 South State Keith Trouette, 244 Carleton Drive Roy Seward, 423 Jones David Harrison, 711 Dora Avenue Monte Hill, Medico Drug Company, 200 North State The complainants alleged the commercial rate is exorbitant compared to the rate paid the previous contractor and some stated their intent to haul their own garbage unless an agreement can be reached. Objection to the mandatory domestic rate was expressed. The requirement to place all curbside trash in disposablecontainers was considered by some to be an impractical requirement, particularly during the rainy season. The Contractor stated re-useable con- tainers could be used if said containers are placed curbside. The $2.50 rate permits pickup of only one 30 gallon container in the back of the residence. There was also opposition expressed to the amount of revenue the City will receive from the 25% garbage franchise payments. Dr. Robert Holtzer, County Health Officer was present in the audience and stated it will be required that the dump site meet certain State standards and it was his understanding a portion of the franchise payment will be used for this purpose. The City Manager stated enforcement of the recently enacted anti-burning ordinance will expend a portion of said franchise payment. The City Manager stated charges for the garbage service has not increased in every case. Mr. Clyde Oswell, 1326 South Helen Avenue was present and stated the hospital for which he works will benefit financially from the garbage service time of due to the saving of the/one employee previously used to take care of the burning of trash at the hospital. The Council, City Manager, and City Attorney answered questions directed to them by the complainants. It was stated the rates were set by the Council prior to ,the time the bids were opened and was awarded to Ukiah Solid Waste Dispisal as the best of the four bids received. It was also pointed out that refuse is a community problem and the cost for its removal and disposal must be borne by the residents of the community just as residents of the community bear the cost of police and fire service. Mr. Russell explained he has not had time to contact all of the 700 commercial accoubts and indicated every effort will be made to reach a reasonable agreement with each one. After Council determination, complainants were advised to present their complaint in writing to the City Manager' s office giving both their new and old rate and the volume of garbage their firm generates to determine by prescribed public hearings if the charge is excessive. MAYOR NORGARD DECLARED A RECESS AT THIS POINT IN THE MEETING - 9:55 P.M. COUNCILMEN BUXTON & HENDE RSON WERE EXCUSED AT THIS POINT IN THE MEETING. The following persons were present in the audience representing various service clubs in the City: Alice Woodard, 123 Barbara Street Loretta Challand, 103 Scott Street Deliah Yttreness, 103 Thompson Avenue Each of the above named persons indicated their interest in the discussion regarding the garbage problem and stated they had no complaints with the charge. The Soroptimist Club plans to have a representative at each Council meeting. Jack and Lorraine Pearson, 265 Mendocino Place, were also present in the audience and stated a check of the garbage rates in other cities, indicates the rate being charged in Ukiah in not excessive. CALIFORNIA HIGHWAY COMMISSION APPROVES STATE STREET RELINQUISHMENT AGREEMENT City Manager reported correspondence from the Division of Highways states the California Highway Commission has approved the State Street Relinquishment Agreement. Said relinquishment will become effective upon recordation of Highway Commission Resolution No. R1632. Council will be advised the date of said recordation. This concludes five years of negotiations with the State concerning said relinquishment and represents a gain to the City in the amount of $400,000. The Mayor commended the City Manager for his efforts in accomplish- ing such a saving for the City. F.A.A. REPORT OF INSPECTION OF MUNICIPAL AIRPORT The Federal Aviation Administration has advised the periodic compliance inspection of the Ukiah Municipal Airport was made and it has been determined the City is in compliance with the terms of the various agreements. REQUEST AND AUTHORIZATION TO CALL FOR BIDS FOR ABS PLASTIC CONDUIT FOR DIRECT BURIAL City Manager reviewed specifications for ABS plastic conduit with couplings for direct burial and recommended the bid call be January 19, 1971, at 2:00 p.m. On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unanimously carried the Clerk be authorized to call for bids for plastic conduit -�� as reviewed by the City Manager, bids to be received prior to January 19, 1971, at 2:00 p.m. REQUEST AND AUTHORIZATION TO CALL FOR BIDS FOR BRUSH AND WOOD CHIPPER City Manager reviewed specifications for 16" brush and wood chipper and recommended the bid call be January 26, 1971, at 2:00 p.m. On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unanimously carried the Clerk be authorized to call for bids for a 16" brush and wood chipper as reviewed by the City Manager, bids to be received prior to January 26, 1971, 2:00 p.m. 486 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JANUARY 6, 1971 - PAGE 4 DISCUSSION OF PUBLIC HEARING RE POSSIBLE CONSOLIDATION OF FAIRS City Manager read correspondence from the Secretary-Manager of the 12th District Agricultural Association calling attention to a notice of public hearing concerning possible consolidation of fairs - (Ukiah, Boonville, Lake County) - at Lakeport. Council expressed concern with this possibility and . indicated their intention to delegate a spokesman to be present at the hearing February 11, 1971 in Santa Rosa. The required statistical information necessary for presentation at the hearing will be presented at the next meeting. CORRESPONDENCE RE NAMING CHILDREN'S ROOM AT NEW LIBRARY BUILDING City Manager reported Friends of the Ukiah-Mendocino Library have requested the Board of Supervisors consider naming the Children' s Room of the new Library the Frieda Winter Room. Correspondence from the Board of Supervisors indicated there was no objection to naming the room as requested. EMPLOYEES' CREDIT UNION ANNUAL DINNER City Manager reported Councilmen and their wives are invited to be guests at the City of Ukiah Employees' Credit Union Annual Dinner January 15, 1971, Fairgrounds Home Economics Building, 7:80 p.m. City Manager took reservations. EXISTING VACANCIES ON COMMISSIONS A Personnel Session will be held at the next meeting to consider filling existing vacancies on various commissions. LEAGUE MEETING IN NAPA City Manager advised the Redwood Empire Division League of California Cities Quarterly Meeting will be held in Napa January 23, 1971, and details of said meeting have been mailed to each Councilman. CORRECTION OF REGISTER OF DEMANDS & WARRANTS APPROVED On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unani- mously carried to correct an error in the Register of Demands and Warrants as follows: APPROVED DECEMBER 16, 1970 CORRECTED AMOUNTS General W. #3074 $357.00 Sewer $357.00 General W. #3043 36.95 General 35.45 Spec. Gas Tax #3043 53.99 Spec. Gas Tax 55.49 $447.94 $447.94 PERSONNEL SESSION City Manager requested a five minute personnel session at the conclusion of the meeting. COUNCILMAN SCOTTO Councilman Scotto requested clarification concerning Council rejecting any or all bids. Said clarification was made by the City Attorney. COUNCILMAN SIMPSON Councilman Simpson inquired regarding the anti-burning ordinance and its enforcement. City Manager stated the intent is to gain the help of the citizens to phase out burning within the City. Inspection is underway at this time by the Fire Department. The intent is to begin the program with warnings and if necessary, follow up with citations. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH JANUARY 6, 1971 - PAGE 5 MAYOR NORGARD Mayor Norgard stated he and the City Manager were interviewed on television recently reporting the City's accomplishments during 1970. He reported he is of the opinion the Council should continue to make efforts to improve the community. The outline of the 1970 accomplishments were distributed to each Councilman.
