HomeMy WebLinkAboutMin 01-13-71 488 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH JANUARY 13., 1971 - PAGE 1 The City Council convened in regular session in the Council Chambers at 8:04 p.m. with Mayor Norgard, Councilmen Scotto, Buxton, Simpson and Henderson present. APPROVAL OF MINUTES On a motion by Councilman Simpson, , seconded by Councilman Scotto, it was unanimously carried minutes of the meeting of January 5, 1971, be approved as submitted by the Clerk. SPECIAL WARRANTS On a motion by Councilman Henderson, seconded by Councilman Buxton, it was unanimously carried Special Warrants #3150 to #3158 inclusive in the total amount of $7,083. 19 be approved and ordered paid. PAYROLL WARRANTS On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unanimously carried Payroll Warrants #4194 to #4321 inclusive, for the period from December 16th to December 30, 1970, be approved in the total amount of* $47, 632.18. NOTICE OF RECORDATION - RELINQUISHMENT OF STATE STREET TO THE CITY The City Attorney reported the notice of recordation of the agreement for relin- quishment of State Street has been received. State Street now officially belongs to the City. Correction of deficiencies, at State expense, will proceed from this point. The City Engineer reported signalization of State Street is underway. For the benefit of those in the audience, the City Manager gave a brief history of the project which led to said relinquishment. The Mayor stated that during five years of negotiations, the City has realized a great deal of financial benefit and again expressed his thanks to the City Manager for the results of his negotiations on behalf of the City. PROPOSED FOUTZ ANNEXATION The City Attorney reported the Local Agency Formation Commission has reviewed the proposed Foutz annexation and after receipt of their official report, preparation of a report for Council consideration will be made. REPORT OF BIDS RECEIVED FOR LIBRARY BUILDING The City Manager reviewed the tabulation of bids for construction of the librsry building as follows: Bidder Base Price Alternate #1 Christensen and Foster, Santa Rosa $3382700.00 $13900.00 Fostmeier Construction Co. , Rohnert Park 3012000.00 12900.00 E. City Manager recommended the award of bids be considered at the next meeting to allow time for necessary investigation and review. REQUEST AND AUTHORIZATION TO CALL FOR PROPOSALS FOR ANNUAL PUBLIC AUDIT The City Manager reviewed the specifications for the public audit and requested the bid call to be on a one and three year basis. It was recommended said bid call be February 2, 1971, at 2:00 p.m. A 484 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH JANUARY 13, 1971 - PAGE 2 On a motion by Councilman Scotto, seconded by Councilman Buxton, it was unanimously carried the Clerk be authorized to call for proposals for the annual public audit on a one and three year basis, bids to be received prior to 2:00 p.m. February 2, 1971. NOTICE OF COMPLETION-VINEWOOD W� PARK RESTROOM FACILITIES A memorandum from the City Engineer dated January 13, 1971, was reviewed stating the Contractor, Wagner Construction, Inc., has completed all work required under the contract for construction of restroom facilities at Vinewood Park. The City Manager recommended the work be accepted as complete and the City Clerk be authorized to file the required Notice of Completion. On a motion by Councilman Buxton, seconded by Councilman Henderson, it was unanimously carried the restroom facilities at Vinewood Park be accepted as complete and the City Clerk be authorized to file the required Notice of Completion. APPOINTMENT OF FIRE CHIEF (DAVID K. DONOHUE, PACIFICA) City Manager reported Mr. David K. Donohue, Pacifica, California, has been appointed Fire Chief and will report for duty February 1, 1971. He reviewed the News Release which had been prepared for the press and radio. PROCLAMATION - SOROPTIMIST WEEK The City Manager read a Proclamation and the Mayor declared the week of January 18-24, 1971, as Soroptimist Week and urged all citizens of our community to give full consideration to the future services of the Soroptimist Club of Ukiah to observe the founding of Soroptimists and to commemorate such founding by the celebration of their 50th Anniversary Golden Jubilee. REMINDER - ANNUAL CREDIT UNION DINNER The City Manager reminded the Council of the annual City of Ukiah Employees' Credit Union Dunner, January 15th at the Fairgrounds. 12th DISTRICT AGRICULTURAL FAIRGROUNDS PROPOSED CONSOLIDATION City Manager reported he had discussed the proposed consolidation of fairs with the Fairgrounds Manager. Facts for presentation at the hearing should be ready for Council consideration next week. FURTHER DISCUSSION OF GARBAGE COLLECTION PROBLEMS The garbage collection discussion was not an agenda item but there were those present in the uadience who indicated an interest in further discussion of said problem. Mr. Jack Pearson, Mayflower Transit Agency, 300 East Gobbi, was present in the audience and stated cities in surrounding areas had also recently had rate increases and stated he has no complaint with the rate he is charged for the service he receives. The City Manager gave the following general information for the benefit of those present in the audience: 1) Complete details of the garbage collection problem will again be publicized to clarify various points of expressed concern. 2) Tabulation of dates when Council discussion of garbage collection was pub- licized in the local and Santa Rosa newspapers. 3) Tabulation of dates when garbage collection was publicized by agenda and discussed at Council meetings open to the public. 4) Explanation of the procedure set forth in the specifications and ordinance by which a garbage collection complaint may be handled. 490 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH JANUARY 13, 1971 - PAGE 3 The following persons were present in the audience and asked various questions of the Council, City Manager, and City Attorney pertaining to their particular situation: R. Newbrough, 1388 Berkeley Way Earl Stephens, Evans Street Mrs. Ruth McConnell, 669 Marshall Pete Onori, 1000 Maple Tom Roberts, Reliance Service, 145 Wabash Questions from the above named persons resulted in the following explanations: 1) Mandatory feature of the service does not apply to commercial City Attorney explained the commercial accounts were exempt from the mandatory feature since, in the majority of cases, they would be paying the mandatory domestic rate. 2) Apartment houses qualify as a commercial account if all containers are picked up at a central location and billed as one account. 3) An account is delinquent after 90 days. In the event of non-payment the amount will be recorded as a lien against the property owner. 4) The owner of an unoccupied house will not be charged for the service. 5) The mandatory feature of the service is not unique or excessive. It was imposed to maintain a cleaner city and to make it possible for the non- burning ordinance to be enforced. Garbage collection service falls in the same category as police and fire service - it is a community service the citizens pay for even though said service is never used. 6) The City is in charge of the operation of the dump site and must meet Federal, State, and County standards to assure continued operation. 7) The current rate will still be in effect five years hence. Copies of the Contractor' s statement and the list of commercial rates charged were examined by the Council. Certain discrepancies were noted in each. Necessary corrections will be made. COUNCILMAN SCOTTO Councilman Scotto asked the status of the FAA building. City Engineer explained we are awaiting determination by FAA regarding the relocation of offices in said building. Councilman Scotto asked what effect the County's anti-burning ordinance would have on the City' s anti-burning ordinance. The City Attorney reported it would have no effect. COUNCILMAN BUXTON Councilman Buxton stated he was happy to see those present at the Council meeting to indicate their interest in what is going on. COUNCILMAN SIMPSON Councilman Simpson inquired about the status of the recycling information which had been brought up at a previous meeting. City Manager reported he had no further information at this time. MAYOR NO RGA RD Mayor Norgard stated it was a pleasure to have those present in the audience. ADJOURNMENT Mayor Norgard adjourned the meeting at 9:59 p.m. after which the Council reconvened in Personnel Session. Mayor ATTEST: City Clerk 491 ADDENDUM TO MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH JANUARY 13, 1971 RECOMMENDATION TO BOARD OF SUPERVISORS APPOINTMENT TO COUNTY LIBRARY ADVISORY COMMITTEE The Council reconvened in public session and unanimously voted to recommend Miss Shiela Brooks for appointment by the Board of Supervisors to the Mendocino County Library Advisory Committee.
