HomeMy WebLinkAboutMin 02-10-71 f" MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH FEBRUARY 10, 1971 The City Council convened in adjourned regular session in the Council Chambers at 7:06 p.m. , with Councilmen Scotto, Buxton, Simpson, and Mayor Norgard present. Councilman Henderson was absent. APPROVAL OF MINUTES On a motion by Councilman Buxton, seconded by Councilman Simpson, it was unani- mously carried the minutes of the meeting of February 3, 1971 be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unani- mously carried Payroll Warrants #4442 to #4596 inclusive for the period of January 16th through January 31, 1971, be approved in the total amount of $49,698.08. SPECIAL WARRANTS On a motion by Councilman Buxton, seconded by Councilman Scotto, it was unani- mously carried Special Warrants #3286 to #3333 and #3336 to #3342 inclusive in the total amount of $14,965.34 be approved and ordered paid. APPROVAL OF CLAIM FOR DAMAGES (HARRY I. WOODLAND) City Attorney reviewed the claim for damages in the amount of $77.35 filed by AAA California State Automobile Association for Harry I. Woodland, Clearlake Park. Claimant alleges damage to the rear end of his automobile by a police vehicle at the time claimant was stopped at a stop sign. City Attorney recom- mended payment to claimant in the amount of $77.35. On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unani- mously carried to approve claim for damages by Harry I. Woodland as recommended by the City Attorney. CLAIM FOR DAMAGES —s (CHARMIAN J. RHODES) City Attorney reported receipt of Application For Leave To Present Late Claims by Attorney Thomas J. Boyle on behalf of Claimant, Charmian J. Rhodes. The City was not prejudiced by failure to present said claim within the 100-day period specified by Section 911.2 of the Government Code. Claimant alleges personal injuries resulting from failure of a vehicle to stop at a stop sign which was not properly maintained by the City. City Attorney recommended the Application For Leave To Present Late Claim be accepted and the claim for damages be denied. On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unani- mously carried to accept the late claim and deny the claim for damages by Charmian J. Rhodes in the amount of $1,708.58 for medical expenses, wage loss and property damage and $15,000 for general damages. AWARD OF BIDS FOR 300 KVA TRANSFORMER TO INDUSTRIAL ELECTRIC SERVICE CO. City Manager reviewed the tabulation of bids received for subject bids as follows: Maydwell & Hartzell, Inc. $2,560.00 Westinghouse Electric Supply Co. 23,217.00 Industrial Electric Service Co. 031.0 Consolidated Electrical Distributors 2,522.00 Alternate 25632.96 National Electric Supply Co. 29031.00 City Manager noted the bids received in identical amounts and recommended the bid be awarded to Industrial Electric Supply Company on the basis of favorable past experience with the firm. MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH FEBRUARY 10, 1971 - PAGE 2 On a motion by Councilman Scotto, seconded by Councilman Buxton, it was unani- mously carried to award the bid for 300 KVA padmount transformer to Industrial Electric Service Company in the amount of $2,031.00. F.A.A. FLIGHT SERVICE STATION BUILDING PROJECT City Manager reported F.A.A. representatives have advised of their desire to change the development program of subject project. The intent at this time is to construct a facility containing 2900 square feet and after occupancy to demolish the present building. Minor changes in the plans are required by F.A.A. after which a revised cost estimate will be prepared, financing will be checked on the new basis and the matter will be brought back for Council consideration. RESOLUTION NO. 71-25 GRANTING PARKING LOT REQUIREMENT EXEMPTION (GUY CHICK) City Manager read a letter from Mr. Guy Chick, Chick's House of Spirits, re- questing exemption from parking lot requirements to ease the flow of traffic in the parking lot located at School and Stephenson Streets. Mr. Chick re- viewed a plot plan of subject property which requested a reduction to six spaces from the required ten. Councilman Simpson requested the Planning Commission be advised of requests of this nature in the future even though the code sets forth this to be a decision solely for the Council. On a motion by Councilman Buxton, seconded by Councilman Scotto, it was carried by the following roll call vote Resolution No. 71-25 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Granting Parking Lot Require- ment Exemption to Guy Chick". ...r__._ AYES: Councilmen Scotto, Buxton, Simpson, and Mayor Norgard. NOES: None ABSENT: Councilman Henderson PROPOSED CONSOLIDATION OF FAIRS City Manager read a letter for Council consideration to be presented at the public hearing in Santa Rosa concerning consolidation of Mendocino and Lake County Fairs at Lakeport. Mr. Scotty Turner, Fairgrounds Manager, was present in the audience and stated he would attend the hearing and present statements and letters from various organizations opposed to the proposed consolidation and would present the statement from the Council if this were the desire of the Council. On a motion by Councilman Simpson, seconded by Councilman Buxton, it was unani- mously carried to submit the letter of opposition to the elimination of the fair in Ukiah read by the City Manager for presentation at the public hearing February 11, 1971, in Santa Rosa. TRIMELONI PROPERTY City Manager reported the bid for the Trimeloni property was made February 8, 1971, as authorized by the Council at the last meeting. The result of said bid is not available at this time. LIBRARY BIDS REJECTED i City Manager reported information received this date indicates the award of bids at this time for the library construction would eliminate the City' s grant for the proposed buildings. The problem results from changes in the grant application procedure. At the present time it appears that the grant money is increased to $179,000 from the original $150,000. City Manager recommended all bids be re- jected and a call for bids be made at a later date. On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unani- mously carried to reject all bids for construction of the library building. a MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH FEBRUARY 10, 1971 - PAGE 3 COUNCILMAN SIMPSON Councilman Simpson suggested that, in the future, the Planning Commission be advised of requests for exemptions to parking requirements. City Manager stated the ordinance could be revised in this regard and the Council agreed to the proposed revision. Councilman Simpson reported an article in the current Ford Magazine contains an article dealing with garbage at dump site and how the land can be utilized and encouraged the Council to read it. City Manager reported, for Council in- formation, the dump site is now in very good condition. CITIZEN INQUIRY Mr. Wayne Shelton, Mendocino Drive, inquired who he should talk with regarding placement of a stop light at Ford Road and State Street. He was advised to contact the County Director of Public Works since this area is in the County. AT 7:54 P.M. THE COUNCIL ADJOURNED AND RECONVENED AT THE HIGH SCHOOL AUDITORIUM AT 8: 10 P.M. PUBLIC HEARING FOR TAXI PERMIT City Manager reported this as being the time and place set for public hearing for applications received for taxi permit to operate a taxi service in the City. Applications have been received from Larry H. Whetstone and Victor H. Jones and both meet requirements set forth in the Ukiah City Code for said permit. Council consideration is for either or both applicants to possess the single permit with- in the City. It was made clear that only one taxi license exists and that the action of the Council does not infer that two companies may operate. On a motion by Councilman Scotto, seconded by Councilman Buxton, it was unani- mously carried to approve both applications for taxi permit to operate a taxi service within the City. -- -� DISCUSSION OF GARBAGE DISPOSAL CONTRACT Attorney Bob Fowler, representing those protesting the garbage disposal contract, addressed the Council and stated the issue is the compulsory nature of the ordinance; that the majority of the people do not want compulsory garbage collec- tion and asked, if this were proven to the Council, what action the Council would take. Mayor Norgard stated his observation is that those who object to the com- pulsory feature are not a majority and anything to the contrary would have to be demonstrated. Attorney Fowler asked what the penalty would be for non-payment of the garbage rate. City Attorney stated non-payment could result in a special assessment against the property owner and that in one California city non-compliance with the compulsory ordinance is a jail sentence. Attorney Fowler then asked why the compulsory feature was imposed on domestic accounts and not the commercial accounts. City Manager explained the commercial rates were left to be negotiated because the general standards of volume and types of outage were not the same as the domestic accounts. Attorney Fowler stated it could be demonstrated to the Council that a majority of the people are opposed to the mandatory rate and that he is of the opini6n the Council agrees other things can be done; if not, other steps can be taken. Mayor Norgard opened the meeting for questions and comments from the floor. A number of the questions were not relevant. Mayor Norgard stated further questions and discussions beyond this point would only be repetitious.
