MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH
APRIL 28, 1971
The City Council convened in regular session in the Council Chambers at
8:01 p.m. with Councilmen Scotto, Simpson, and Mayor Norgard present.
Councilman Buxton was absent.
APPROVAL OF MINUTES
On a motion by Councilman Simpson, seconded by Councilman Scotto it was
unanimously carried the Minutes of the meeting of April 21, 1971, be
approved as submitted by the Clerk.
SPECIAL WARRANTS
On a motion by Councilman Scotto, seconded by Councilman Simpson, it was
unanimously carried Special Warrants #3744 to #3747 inclusive in the total
amount of $4,087.38 be approved and ordered paid.
PUBLIC HEARING ZONE CHANGE
APPLICATION NO. 71-11 (POMEROY-NIPPER)
Public hearing was declared open by Mayor Norgard at 8:04 p.m. on Zone
Change Application No. 71-11 by Pomeroy-Nipper as amended to establish
C-1 and R-2 zones instead of R-1 zone on parcel bounded on the west by
101 Freeway, on the north by East Perkins Street, on the east by Oak Manor
Drive and on the south by Gibson Creek and the Oak Manor School. Affidavits
of Publication of the required legal notice of the hearing as well as
Affidavits of Posting and Mailing were placed on file. Planning Commission
action and Findings of Fact dated April 1, 1971 were read by the City
Attorney.
Mr. Bob Axt, Architect, representing applicant, was present in the audience
and spoke in behalf of the application.
Allowable uses in a C-1 zone were read by the City Attorney. Council
discussed objections raised when subject matter was heard by the Planning
Commission . There was no one present in the audience to speak in opposi-
tion to the granting of said application.
Public hearing was closed at 8:23 p.m.
On a motion by Councilman Scotto, seconded by Councilman Simpson, it was
unanimously carried the City Attorney be directed to prepare an amending
ordinance in accordance with Zone Change Application No. 71-11 by
Pomeroy-Nipper as amended and recommended by the Planning Commission.
PUBLIC HEARING ZONE CHANGE
APPLICATION NO. 71-13 (GOBBI ST.
WAUGH LA. ANNEX. , FOUTZ ANNEX.)
Public hearing was declared open by Mayor Norgard at 8:25 p.m. on Zone Change
Application No. 71-13. Said application proposes to rezone the existing CM zone
along the south side of East Gobbi Street from the Northwestern Pacific
Railroad easterly to the City Limits, the area within Annexation No. 65-2
(Waugh Lane) , and Annexation No. 71-1 (Foutz) . Affidavits of Publication of the
required legal notice of the hearing as well as Affidavits of Posting and
Mailing were placed on file. Planning Commission recommendation of rezoning ,
_ i zoning and pre-zoning of subject area was read and reviewed as set forth on
a plot plan.
COUNCILMAN BUXTON ARRIVED AT THIS POINT IN THE MEETING - 8:30 P.M.
There was no one present in the audience to speak in opposition to the
proposed zone changes.
Public hearing was closed at 8:36 p.m.
On a motion by Councilman Simpson, seconded by Councilman Scotto, it was
unanimously carried the City Attorney be directed to prepare an amending
ordinance in accordancce with Zone Change Application No. 71-13 as recommended
by the Planning Commission.

PRESENTATION OF EQUIPMENT
BY VOLUNTEER FIREMEN
City Manager reported representatives from the Volunteer Fire Department
were present in the audience to make a presentation to the City. Tom Cooper,
Business Manager for the Volunteer Department made the presentation of one
Scott water vacuum and one Scott Airpack. Demonstration of use of the units
was made by Tim Holliday and Don Gupton. The Council expressed their
appreciation to the Volunteers and the City Manager stated this group has
contributed many benefits to the City and have been a big factor in the City's
excellent fire rating.
ADOPTION OF ORDINANCE NO. 610
ESTABLISHING SPEED LIMIT IN
EXCESS OF 25 MPH
On a motion by Councilman Buxton, seconded by Councilman Simpson, it -was
carried by the following roll call vote Ordinance No. 610 be adopted and the
Mayor and Clerk be authorized to sign same,"An Ordinance Of The City Of Ukiah
Establishing Pursuant To A Traffic And Engineering Study, A Speed Limit In
Excess of Twenty-five (25) Miles Per Hour."

APPROVAL OF SEVENTH AMENDMENT
TO UKIAH VALLEY FIRE PROTECTION
DISTRICT AGREEMENT
On a motion by Councilman Scotto, seconded by Councilman Buxton, it was unani-
mously carried the Seventh Amendment to the Ukiah Valley Fire Protection
District-City of Ukiah Agreement be approved and the Mayor and Clerk be
authorized to sign same.
PROPOSED WORKING AGreement between
city & county for low gap regional park
City Manager read a proposed agreement regarding subject park. Said agreement
set forth a proposal for development of the park by the County under a $75,000
grant approved by the State and maintenance and operation of the facility to be
distributed equally between the City and County. A development plan which has
previously been reviewed by the Council will be updated for subsequent Council
consideration. Council directed the City Manager to continue negotiations with the
the County to develop cost estimates on a comparable basis so an agreement
can be finalized.
PROGRESS REPORT
LIBRARY PROGRAM
City Manager reported documents from the State Library setting up a payment
schedule for the grant money have been received and completed in compliance
with previous Council action. The Architect has not received final approval
from the State, however, upon its receipt the call for bids can be scheduled.
AIRPORT COMMISSION RECOMMENDATION �--,
REGARDING AIRPORT IMPROVEMENTS

City Manager reported the Airport Commission considered a request from
Dr. A. C. McChesney to lease seven acres of airport property on the
northwest portion of the airport at a yearly rate of $350. Commission action
was read from the April 20, 1971, Commission minutes recommending a higher lease
payment than proposed and that such income be earmarked "Airport Income".
City Manager reported the requested rate is lower than other non-airport uses and
and requested authorization for further negotiation. Council determined
that income from the airport continue to be placed in the general fund.
On a motion by Councilman Buxton seconded by Councilman Simpson it was
unanimously carried to authorize further negotiation by the City Manager
for lease of subject property.

WORK STUDY PROGRAM WITH
COUNTY SUPERINTENDENT OF SCHOOLS
City Manager reported City participation with the County Superintendent of
School- in a work study program appeared to be beneficial to the City when
last reported to the Council, however; was not aware of the requirement for
disbursement of $5500 for the City's participation. Council determined the
City's participation in the program could not include a cash advance.
PROPOSED STATEMENT OF POSITION
RE MENDOCINO STATE HOSPITAL
City Manager read a letter addressed to Governor Reagan stating a proposed
position regarding Mendocino State Hospital and asked for Council opinion and
suggestions. Council approved of statements therein and instructed the City
Manager to proceed. The matter has been discussed with the County Administra-
tor who stated it is not in conflict with the position the County has taken.
PROPOSED PURCHASE OF USED ROLLER
City Manager reported there is a $7000 budget allocation for a used roller and
since there is no basis for preparation of specifications for used equipment,
requested Council permission to proceed by contacting various suppliers for
cost estimates. Council authorized the City Manager to accumulate information for
purchase of a used roller for Council decision in two weeks.
COUNCILMAN SCOTTO
Councilman Scotto asked about the cutting of fire control trails in the area
immediately adjacent to the City. The Division of Forestry has advised to
accomplish the work results in insurmountable problems.
COUNCILMAN BUXTON
Councilman Buxton referred to another California city where honda trails had
been contructed on dump property and asked that the possibility be explored for
a similar facility in this area.
COUNCILMAN SIMPSON
Councilman Simpson referred to a block on School Street and stated it is
unsightly with grease and grime. City Manager reported efforts are being
made to have the cars removed on that block during the evening hours so the
street sweeper can take care of this situation.
MAYOR NO RGARD
Mayor Norgard asked the status of the budget. Wednesday, May 5th was set to
bring the Council up to date on the matter.
EMPLOYEE REPRESENTATIVE
TO CIVIL SERVICE BOARD
City Manager reported Mr. Leo Cook was elected to serve on the Civil Service
Board as the employees representative. Mr. Cook replaces Mike McAvoy, resigned.
The election for this appointment was held April 27, 1971.
GRAZING LEASE EXECUTED
City Manager reported Mr. and Mrs. Oliver Harmon have executed the grazing lease
of dump property at the increased amount set at a previous Council meeting.
VINEWOOD PARK
City Manager reported the lawns at Vinewood Park will be planted Monday, May 3rd.
When a good stand of grass appears, dedication of the park can be scheduled
with the Advisory Committee who have been responsible for the planning of the
park.

There being no further regular business, Mayor Norgard declared the meeting
adjourned at 9:48 p.m.
