MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH
JUNE 162 1971
The City Council convened in regular session in the Council Chambers at 8: 11 and
proceeded with routine business after discussion of the proposed 1971-72 Budget
which began at 7:00 p.m.
Councilmen Scotto, Buxton, Simpson and Mayor Norgard were present.
PLEDGE OF ALLEGIANCE
Councilman Buxton led in the pledge of allegiance.
APPROVAL OF MINUTES
On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unani-
mously carried the minutes of the meeting of June 9, 1971 be approved as sub-
mitted by the Clerk.
REGULAR WARRANTS
On a motion by Councilman Buxton, seconded by Councilman Scotto, it was unani-
mously carried Regular Warrants #3901 to #3997 inclusive in the total amount of
$65,065.58 be approved and ordered paid.
RESOLUTION NO. 71-46
ABANDONMENT OF ALLEYS
The City Attorney read Resolution No. 71-46 which was authorized for adoption
by the Council at the previous meeting. Subject area has been properly posted
and published as required by law prior to the public hearing.
RESOLUTION NO. 71-47 RE
AFFIRMING BELIEF IN THE
CONCEPT OF FREEDOM OF RELIGION
On a motion by Mayor Norgard, seconded by Councilman Scotto, it was carried by
the following roll call vote Resolution No. 71-47 be adopted and the Mayor and
Clerk be authorized to sign same, "Resolution Of The City Council Of The City
Of Ukiah Affirming Its Belief In The Concept Of Freedom Of Religion And The
Free Expression Thereof".
AYES: Councilmen Scotto, Buxton, Simpson, and Mayor Norgard.
NOES: None
ABSENT: None.
City Manager requested the news media to announce that those wishing to present
the invocation prior to the Council meeting to check with the City Clerk on
Monday prior to the meeting and request to be put on the agenda.
AWARD OF BID FOR CONSTRUCTION
OF LIBRARY BUILDING TO JOHN
WAGNER CONSTRUCTION, INC.
The City Manager reviewed the tabulation of bids received for the construction
of the Mendocino County Free Library System Headquarters building as follows:
Bidder Lunp Sum Bid
Brady Constructors & Crane of Ukiah, J.V. $3192988.00
John Wagner Construction, Inc. Ukiah $3572500.00
R. Todd Construction Company, Santa Rosa $3632267.00
The necessary information and documents required to be part of each bid has been
checked. The bid from Brady Constructors & Crane of Ukiah was found to be un-
acceptable inasmuch as the bid bond was not signed by the surety. City Attorney
Opinion dated June 16, 1971, regarding eligibility of said bid was read and set
forth therein reasons why the bid from Brady Constructors and Crane of Ukiah,
J.V. could not be considered. City Manager stated the bid from John Wager Con-
struction, Inc. was within the Architect's estimate and the federal grant and
recommended the bid be awarded to John Wagner Construction, Inc. as the lowest
responsible bid received.
On a motion by Councilman Scotto, seconded by Councilman Buxton, it was unani-
mously carried to accept the bid of John Wagner Construction, Inc. , Ukiah,

in the amount of $357,500 as recommended for construction of the Mendocino
County Free Library System Headquarters Building.
CONSIDERATION OF TENTATIVE MAP
(WESTWOOD ACRES SUBD. UNIT #3)
City Manager reported the tentative map of subject subdivision was originally
considered by the Planning Commission in August 1970 at which time 24 lots were
proposed to be developed. At that time there was public objection to the develop-
ment as proposed and as a result the map was withdrawn by the developer September
17, 1970. It was revised at a later date by reducing the number of proposed lots
to 12. In the opinion of the Planning Commission, subject map now constitutes an
acceptable plan. The minutes of the Planning Commission dated April 17th,
May 6th, and May 20, 1971 were read which recommended approval of said subject
map subject to certain restrictions. After discussion of the problem of drainage,
the steep grade of the lots, and the use of septic systems in eight of the lots,
Council action was postponed to allow time for the Council to view the area with
the City Engineer.
COUNCILMAN BUXTON WAS EXCUSED AT THIS POINT - 9:03 P.M.
PARKING VIOLATION FINES
City Manager reported in accordance with Council instruction on cost figures for
the parking enforcement program which information will be distributed to the
Council. It has been determined the cost of collection of a $1.00 fine amounts
to $1.61. The Downtown Merchants Association has been contacted for their
opinion. The Downtown Merchants Association has been contacted for their opinion,
but no formal opinion can be obtained until their meeting the 2nd Tuesday in
July. The City Attorney will attend said meeting to clarify mis-information
and mis-interpretation in regard to the parking violation fines. City Manager
gave a detailed report of the Parking District, and how it operates and stressed
that all revenue generated is used only for operation and debt service. City
Manager recommended no specific action until formal action of the Downtown Mer-
chants. The matter will be back for Council consideration after said meeting.
AWARD CSF B$D FOR "HANDLE-TALKIE"
RADIOS TO GENERAL ELECTRIC
City Manager reviewed the bids received for the "handie-talkie" radios for which
federal grant was authorized under separate Council action:

City Manager stated both bids comply with specifications and recommended the bid
be awarded to the low bidder, General Electric Corporation.
On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unani-
mously carried to award the bid for five "Handie-Talkie" radios and required as
equipment to General Electric Corporation in the total amount of $3,762.75 as
recommended.
DEDICATION CEREMONY FOR DOG POUND
City Manager reported he and Councilman Scotto attended the dedication ceremony
of the dog pound. The County will have total responsibility for said operation
on July 1st.
MEET AND CONFER SESSIONS
City Manager reported he will be meeting with union representatives and employee
group representatives tomorrow to receive their initial requests. Joint agree-
ment should be reached prior to July 1st.

LEASE OF AIRPORT PROPERTY
Mr. Jerry Chain was in the audience to ask what action had been taken on the
application for lease of airport property. City Manager stated the matter
has not been resolved inasmuch as there is a difference of opinion with regard
to the rental rate.
COUNCILMAN SCOTTO
Councilman Scotto asked the possibility of annexation in the vicinity of Ford
Road. Said annexation would not likely be successful due to lack of interest
of property owners.
City Manager reported he noted the newspaper account this date of the Board
of Supervisors meeting indicating the Board agreed to construct a steel beam,
wood deck bridge over Orr Creek to reestablish traffic on this county road.
COUNCILMAN SIMPSON
Councilman Simpson asked the status of the numbering system and was advised we
are awaiting additional information from Mr. Ed Carpenter as to the total effect
the proposed system will have on the City.
Councilman Simpson asked the City Attorney to have information on Tippler's
tax legislation, federal funds available under HUD and if said funds would be
available without traffic element. City Manager stated these matters will be
discussed in the budget hearings.
MAYOR NORGARD
Mayor Norgard reported he continues to have problems with the dogs in the
neighborhood. City Manager reported the poundmaster does work on an irregular
basis in the evenings to take care of situations such as this. The matter
will be check again.
ADJOURNMENT
Mayor Norgard declared the meeting adjourned at 9:40 p.m. after which the
Council reconvened in closed personnel session.
