JULY 72 1971
The City Council of the City of Ukiah convened in regular session at 8:05 p.m.
with Councilmen Scotto, Simpson, Pearson, and Mayor Norgard present. Council-
man Buxton was sent.
PLEDGE OF ALLEGIANCE
Councilman Pearson led in the pledge of allegiance.
PUBLIC HEARING RE ABANDONMENT OF
ALLEYS (CLARA, FORD, MYRON, SIDNIE)

Public hearing was declared opened at 8:07 p.m. regarding proposed abandonment
of alleys bounded by Clara, Ford, Myron, and Sidnie Streets as set forth in
Resolution No. 71-46. Affidavits of Posting and Publications were placed on
file. A map of subject area was reviewed.
Mr. James L. Wilsey, 477 Ford Street was present in the audience and spoke in
favor of the proposed abandonment.
Public hearing was declared closed at 8:11 p.m.
After discussion, Council determined the required work to effect abandonment of
subject alleys shall proceed.
RESOLUTION NO. 72-2 ORDERING VACATION OF
CERTAIN ALLEYS (CLARA, FORD, MYRON, SIDNIE)
On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unani-
mously carried Resolution No. 72-2 be adopted and the Mayor and Clerk be author-
ized to sign same, "Resolution Of The City Council Of The City Of Ukiah Ordering
The Vacation Of Certain Alleys (Alleys Bounded By Clara, Ford, Myron and Sidnie
Streets)".
APPROVAL OF MINUTES
On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unani-
mously carried the minutes of the meeting of June 23rd, June 30th and July 6,
1971, be approved as submitted by the Clerk.
SPECIAL WARRANTS
On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unani-
mously carried Special Warrants #4005 to #4024 inclusive in the amount of $375.00
and #4025 to #4030 inclusive in the amount of $1,453.69 be approved and ordered
paid.
PAYROLL WARRANTS
On a motion by Councilman Pearson, seconded by Councilman Scotto, it was unani-
mously carried Payroll Warrants #5877 to #6000 inclusive and #1000 to #1024 in-
clusive for the period of June 16th through June 30, 1971, be approved in the
total amount of $50,391.86.
ADOPTION OF ORDINANCE NO. 615
REZONING PORTION OF R-1 TO R-3
(ZONE CHANGE APPL. FILE NO. 71-21)
On a motion by Councilman Scotto, seconded by Councilman Simpson, it was carried
by the following roll call vote Ordinance No. 615 be adopted and the Mayor and
Clerk be authorized to sign same, "Amending Chapter 2, Of Division 9 Of The Ukiah
City Code By Rezoning A Portion Of R-1 Zone To R-3 Zone (Zone Change Application
File No. 71-21)".
AYES: Councilmen Scotto, Simpson, Pearson, and Mayor Norgard.
NOES: None
ABSENT: Councilman Buxton.

OPINION RE LIMITATIONS ON
GASOLINE SERVICE STATIONS
As directed at a previous meeting, the City Attorney had prepared an Opinion
regarding suggested limitations on gasoline service stations within the City.
Said Opinion dated July 7, 1971, stated theCouncil cannot set a maximum limit
of any business in the city. Restrictions can be placed only through zoning
as it relates to traffic congestion and safety and would have to be done pre-
-- spectively, not retroactively.
Mr. Theral Litel was present in the audience and offered copies of the Santa
Rosa and Petaluma ordinances relating to subject matter. Said ordinance had
been obtained by the City Attorney and were referred to in the Opinion.
The Planning Commission has recently granted a use permit for the operation of
another gasoline service station and at that meeting, there were few who spoke
in opposition to granting of said use permit. It was noted that most of the
increase in service stations in the past ten years has been outside the City.
Council determined the City Attorney Opinion should be forwarded to the Plan-
ning Commission for their study and recommendation.
CONSIDERATION OF TENTATIVE MAP
WESTWOOD ACRES SUBD. UNIT NO. 3
Further consideration of subject subdivision was postponed until a representa-
tive of the Subdivider could be present. In the meantime, the City Engineer
will tour the area with the Council.
NOTICE OF COMPLETION
ASPHALT CONCRETE SURFACINGS
(PARNUM PAVING INC.)
R A memorandum from the City Engineer dated June 29, 1971, was reviewed stating
the Contractor, Parnum Paving, Inc. , has completed the work required under
their contract for asphalt concrete surfacing. The City Manager recommended
the work be accepted as complete and the Clerk be authorized to file the re-
quired Notice of Completion.
On a motion by Councilman Scotto, secounded by Councilman Simpson, it was unani-
mously carried asphalt concrete surfacings on Gibson, Park Place, Park Court,
Leslie, Magnolia, Helen, and South School be accepted as complete and the City
Clerk be authorized to file the required Notice of Completion.
APPROVAL OF VARIANCE APPLICATION NO. 71-25
WASHINGTON SQUARE SUBD. (CHARLES MAGOWAN)
Subject application to permit a reduction in setback requirements from 20 feet
to 17 feet in connection with Washington Square Subdivision, plot plan, Minutes
of the Planning Commission dated July 1, 1971, were reviewed. Said reduction
will provide for off street parking for multiple units planned in said subdivi-
sion, and is in compliance with other business on Washington. Planning Commission
Resolution No. 72-1 recommended approval of the variance subject to the following
stipulations:
1) Standard Conditions 1 through 9.
2) The special conditions listed below shall apply
a) That no driveways are to be permitted on Washington Street from
Lots 1 and 8.
b) No building projections, such as porches, etc. , be nearer than 14' of
property line.
On a motion by Councilman Scotto, seconded by CouncilmanSimpson, it was unanimously
carried to direct the City Attorney to prepare a resolution granting subject
variance to Charles MaGowan as recommended by the Planning Commission.

AWARD OF BID RECEIVED FOR CONSTRUCTION
OF NORTH STATE & EVANS ST. SEWER POSTPONED
City Manager reported a bid from Lin Ford was the only bid received for con-
struction of the North State and Evans Street sewer and reviewed the following
tabulation:

City Manager reported the work proposed on Evans Street is inside the city and
the work proposed on North State Street is outside the city and part of the
Sanitation District. The recommendation by the City Manager was for no action
until Sanitation District Board consideration next week. The specifications
provide for acceptance of either or both portions set forth above. The matter
will be considered at the next meeting.
FINAL FISCAL YEAR REPORT
FROM BUILDING DEPARTMENT
City Manager reported total building permit valuation for the fiscal year amounts
to $221462110. This amount ties in closely with the estimate made in the budget.
REDWOOD EMPIRE LEAGUE
OF CALIF. CITIES
City Manager reported the meeting of the Redwood Empire League of California
Cities will be held in Eureka, July 24, 1971.
LEAGUE OF CALIFORNIA CITIES CONFERENCE
City Manager reported subject conference will be held in San Francisco September
26-29. To assure adequate accomodations, reservations should be made early. -
LIBRARY BUILDING CONSTRUCTION STOPPED
The City Manager reported construction of the library building has stopped due
to a carpenter's strike.
COUNCILMAN SCOTTO
Councilman Scotto expressed the need for a pedestrian walk at the library site
along Main Street. The matter will be taken care of.
COUNCILMAN SIMPSON
Councilman Simpson asked about the smoke to the east of town during the past

week. City Manager explained there were two fires in the area and a controlled
burn got out of control We are not aware of any property damage.
ADJOURNMENT
Mayor Norgard declared the meeting adjourned at 8:58 p.m. after which the
Council reconvened in Closed Personnel Session.
