Said Opinion dated July 7, 1971, stated theCouncil cannot set a maximum limit of any business in the city. Restrictions can be placed only through zoning as it relates to traffic congestion and safety and would have to be done pre- -- spectively, not retroactively. Mr. Theral Litel was present in the audience and offered copies of the Santa Rosa and Petaluma ordinances relating to subject matter. Said ordinance had been obtained by the City Attorney and were referred to in the Opinion. The Planning Commission has recently granted a use permit for the operation of another gasoline service station and at that meeting, there were few who spoke in opposition to granting of said use permit.
