HomeMy WebLinkAboutMin 08-11-71 MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH AUGUST 11, 1971 The City Council of the City of Ukiah convened in regular session at 8:11 p.m. with Councilmen Simpson, Pearson, and Mayor Norgard present. Councilmen Scotto and Buxton were absent. PLEDGE OF ALLEGIANCE Councilman Simpson led in the pledge of allegiance. j APPROVAL OF MINUTES On a motion by Councilman Simpson, seconded by Councilman Pearson, it was unani- mously carried the minutes of the meeting of August 4, 1971, be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Simpson, seconded by Councilman Pearson, it was unani- mously carried Payroll Warrants #1167 to #1311 inclusive for the period of July 16th to July 31, 1971, inclusive, be approved in the total amount of $512232.28. SPECIAL WARRANTS On a motion by Councilman Pearson, seconded by Councilman Simpson, it was unani- mously carried Special Warrants #4237 to #4245 inclusive in the amount of $2216.32 be approved and ordered paid. PROJECT ASSIGNMENT TO AIRPORT AND RECREATION AND PARKS COMMISSION Mayor Norgard welcomed members of subject commissions to the meeting and the _..-,. following members were introduced: Airport Commission: Felix Thornhill Richard Rea John Todd Roy Seward William Carter Elmer Harmon Recreation & Parks: Charles Myers Ed Walsh Ben Foster Joe Mayfield Dave Strong The memorandum dated August 3, 1971 requesting commission study to develop a long range capital improvement program which had previously been mailed to the Commisssion members was read by the City Manager. COUNCILMAN BUXTON ARRIVED AT THIS POINT - 8:19 P.M. City Manager stated the suggestions of projects contained in said memorandum were general guidelines to follow and stressed the fact that the commissions were not limited to these specifically. They were urged to confer with citizens groups and the League offices to assist with suggestions of proposed projects. The Planning Commission will be the coordinating agency and the Council will work closely with this commission after the 90 day period allowed for completion of the study. The following persons spoke and asked pertinent questions: Walter Eversole, Ben Foster, Felix Thornhill and Charles Myers. The Council stated their thinking on subject matter and expressed their appreciation of representation of each commission. MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH AUGUST 11, 1971 - PAGE 2 ANNUAL BARBEQUE An invitation was extended to commission members and their families to attend the annual barbeque which will be held in September. Specific information in this regard will be forwarded to each member at a later date. CITY ATTORNEY REPORTS CURRENT LEGISLATION SB 325 removes prohibition of sales tax on gasoline. The bill will possibly be acted upon in September and the possibility of its passage is good. AB 1098 - Retirement benefits for policemen and firemen - mandatory retirement at age 60. Has been approved by the Assembly. Cost to cities will be forty million dollars per year. SB 1083 - Bikes - free bike parking at public parking lots - one for every 25 cars and not less than 10 to each public parking lot. AB 2116 - Disclosure of Assets was approved by the Assembly but died in committee at the Senate. AB 813 - Annexation law revision bill withdrawn. This law is in dire need of revision. AB 1375 - Revision of Subdivision Map Act withdrawn. Also in dire need of revision. Current issue of local newspaper stated rate increase by telephone company is proposed. A 7.5% increase in rates has recently been granted. The current proposed rate increase is to offset the cost of the current salary and wage -- benefit program. REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR F.A.A. FLIGHT SERVICE STATION The City Manager reviewed the specifications for construction of the F. A. A. Flight Service Station at the Municipal Airport. All work to date is in full compliance with F.A.A. requirements and the City Manager recommended the bid call be September 14th at 2:00 p.m. On a motion by Councilman Simpson, seconded by Councilman Buxton it was unani- mously carried the Clerk be authorized to call for bids for the F.A.A. Flight Service Station, bids to be received prior to 2:00 p.m. September 14, 1971. REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR A.C. SURFACINGS ON STREETS AND ON AIRPORT PROPERTY The City Manager reviewed the specifications for asphalt concrete surfacings on Highland Drive and Highland Court, North Oak, Ford, Redwood Avenue, North Bush, Airport Parking Lot, and Planeport Site and recommended bid call be August 31, .1971, 2:00 p.m. On a motion by Councilman Pearson, seconded by Councilman Buxton, it was unani- mously carried the Clerk be authorized to call for bids for asphalt concrete surfacings as recommended by the City Manager, bids to be received prior to 2:00 p.m. , August 31, 1971. REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR CONSTRUCTION OF OPEN HANGAR STORAGE FACILITIES The City Manager reviewed the specifications for construction of open hangar storage facilities and recommended bid call be August 31st, 2:00 p.m. On a motion by Councilman Simpson, seconded by Councilman Pearson, it was unani- mously carried the Clerk be authorized to call for bids for construction of open hangar storage facilities, bids to be received prior to 2:00 p.m. , August 31, 1971. MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH AUGUST 11, 1971 - PAGE 3 REQUEST TO WAIVE CARNIVAL & CIRCUS LICENSE FEE DENIED City Manager read a letter from Butler Amusements protesting payment of subject fee. City Manager reported the ordinance pertaining to subject matter sets forth a requirement for payment of $100 per day and has no provision for waiving same. The City Attorney stated the $100per day license fee for circuses has been in effect for ten years and for carnivals, the same fee has been in effect since 1948. Mr. Scotty Turner, Manager of the 12th District Agricultural Fairgrounds and Mr. Earl Fullerton were present in the audience to speak in favor of the proposed fee waiver. Mr. Turner named the cities in California who have waived or reduced the fee and asked for Council consideration of such a waiver or reduction stating reasons which, in his opinion, justified the request. The Council expressed a difference of opinion on the matter. A suggestion was made to work out a reciprocal agreement with the Fair Board to possibly work out a reduced fee. The economic impact the carnival and fair has on the community was expressed as an important factor in considering waiver. It was also pointed out the Carnival is operating to make money and when they leave town their money goes with them. Even though police reserves are used and are not paid by the city, there are expenses incurred by the city in policing the general area. On a motion by Councilman Buxton, seconded by Councilman Simpson, it was unani- mously carried to deny the request for waiver of carnival and circus fee of $100 per day and an effort made to work out a basis for future licensing re- quirements. REDWOOD EMPIRE LIONS CLUB REQUEST TO WAIVE FEE DENIED City Manager reported a letter received from the Redwood Empire Lions Club of Ukiah has requested waiver of the fee for a circus the club is sponsoring. I Action taken by the Council on the above motion denies this request. DRAINAGE EASEMENT - EUNICE Z. MCGIMSEY ET AL (STANDLEY AVE.) The City Manager reported the Agreement and Grant of Easement for the right to construct a storm drain from Standley Avenue at Highland north to Gibson Creek has been executed by the property owners. This project, which will correct the flooding problem that occurs in this area on Standley Street, was approved in the 1970-71 budget. The agreement provides for a payment of $200 for the easement and it was recommended the Council consider approval of same. On a motion by Councilman Simpson, seconded by Councilman Buxton, it was unani- mously carried to approve the Agreement And Grant Of Easement between the City and Eunice Z. Odbert et al and authorize the Mayor and Clerk to sign same. MEETING IN FORT BRAGG TO DISCUSS SB920 City Manager reported the County Administrator has invited tyle Council to attend subject meeting August 12th and 13th. Subject bill was reported in detail by the City Manager at the previous meeting. There will be a panel discussion moderated by the County Administrator with a question and answer period. The Cit Manager referred to co City g pies of the Comprehensive Plan For Criminal Justice report which had been distributed to the Council and stated the committee to be formed with the passage of SB 920 is in direct conflict to this agency. It' It appears that planning has been asigned to two autonomous agencies. r MINUTES OF THE MEETING OF THE COUNCIL OF THE CITY OF UKIAH AUGUST 11, 1971 - PAGE 4 COUNCILMAN BUXTON Councilman Buxton referred to above mentioned Comprehensive Plan For Criminal Justice report and asked what would be the cost to put out such a report, and was referred to a page in the report listing those involved in its compilation. COUNCILMAN SIMPSON Councilman Simpson asked if the work at State and Gobbi included the installation of the traffic signals. City Engineer stated work now in progress is the telephone company and the city will be putting in ducts for electrical conduit in the same trench at a later date. Councilman Simpson asked about proposed REgional Park and the City Manager stated he had not talked with the County Administrator regarding the matter but will have a report at the next meeting. Councilman Simpson inquired about the numbering system information and stated the report from Mr. CArpenter has not been forthcoming. MAYOR NORGARD Mayor Norgard stated he is glad to see the call for bids for work on the airport. VISITORS COMPLIMENT UKIAH Glenn Ericksen, Ukiah Daily Journal, reported the newspaper received a letter from the Sacramento Raiders who recently participated in a tournament in Ukiah compli- menting the city for the efforts put forth in making their stay here a pleasant one. RECREATION & PARKS COMMISSIONER CARL DAUBENECK RESIGNS City Manager reported receipt of a letter of resignation from Mr. Carl Daubeneck. A conflict in meetings necessitated the resignation. The Council will be consider- ing an appointment fo fill the vacancy.
