REQUEST TO WAIVE CARNIVAL & CIRCUS LICENSE FEE DENIED
City Manager read a letter from Butler Amusements protesting payment of subject
fee. City Manager reported the ordinance pertaining to subject matter sets forth
a requirement for payment of $100 per day and has no provision for waiving
same. The City Attorney stated the $100per day license fee for circuses has
been in effect for ten years and for carnivals, the same fee has been in effect
since 1948.
Mr. Scotty Turner, Manager of the 12th District Agricultural Fairgrounds and
Mr. Earl Fullerton were present in the audience to speak in favor of the proposed
fee waiver. Mr. Turner named the cities in California who have waived or reduced
the fee and asked for Council consideration of such a waiver or reduction stating
reasons which, in his opinion, justified the request.
The Council expressed a difference of opinion on the matter. A suggestion was
made to work out a reciprocal agreement with the Fair Board to possibly work
out a reduced fee. The economic impact the carnival and fair has on the
community was expressed as an important factor in considering waiver. It was
also pointed out the Carnival is operating to make money and when they leave
town their money goes with them. Even though police reserves are used and are not
paid by the city, there are expenses incurred by the city in policing the general
area.
On a motion by Councilman Buxton, seconded by Councilman Simpson, it was unani-
mously carried to deny the request for waiver of carnival and circus fee of
$100 per day and an effort made to work out a basis for future licensing re-
quirements.
