HomeMy WebLinkAboutMin 09-15-71 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH SEPTEMBER 15, 1971 The City Council of the City of Ukiah convened in regular session at 8:05 p.m. with Councilmen Scotto, Buxton, Simpson, and Pearson present. City Manager was absent. "FIESTAS PATRIAS" 9 "' (MEXICAN INDEPENDENCE DAY) --�-i Mayor Norgard opened the meeting extending an invitation to the Council to attend the second annual Mexican Fiesta September 18, 1971, at the Fairgrounds Carl Purdy Hall to celebrate "Mexican Independence Day" or as it is tradi- tionally called, "Fiestas Patrias". PLEDGE OF ALLEGIANCE Councilman Simpson led in the pledge of allegiance. APPROVAL OF MINUTES On a motion by Councilman Pearson, seconded by Councilman Buxton, it was unanimously carried the minutes of the regular meeting of August 25, 1971, and of the special meeting of September 8, 1971, be approved as submitted by the Clerk. GARBAGE INITIATIVE PETITION CERTIFICATE OF INSUFFICIENCY Council had been provided with a memorandum dated September 15, 1971, from the City Clerk giving the results of the examination of signatures on subject petition. The Certificate of Insufficiency which had been mailed to Carole Williams, 424 Empire Drive, on this date was read by the City Attorney. Said certificate contained the results of the examination of said petition as follows: 1) Number of signatures submitted 765 2) Number of signatures required for filing (15% of 4013) 602 3) Number of valid signatures needed for petition to qualify 602 4) Number of valid signatures on petition 373 The City Attorney reported a 30 day period of time is allowed to secure additional qualified signatures. TRAFFIC COMMITTEE REPORT City Attorney reported the results of the traffic Committee monthly meeting: 1) An island will be painted on the street where Todd Road, Park Blvd. , and Barnes Street merge to channel the traffic in a correct manner. 2) A stop sign will be placed at the Walnut and Park Blvd. intersection with a limit line to be painted on Park Blvd. 3) Request by Pathfinders for a parade route October 17th granted. 4) Review of junk car removal ordinance. State law changed to authorize cities to establish means whereby junk cars can be removed from private proptery. City Attorney reviewed the procedure set forth in the proposed -- ordinance. 5) Bicycle safety program will be put into effect through the schools. Councilman Simpson explained the manner in which the program will work through cooperation with the schools and the police department. Council discussed the established licensing fee of 60 cents. Councilman Scotto asked for Council consideration of a budget item to allow for those students unable to pay the fee. Mayor Norgatd requested consideration be given to an increased fee for adults who have the more expensive bikes. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH SEPTEMBER 15, 1971 - PAGE 2 CITY ATTORNEY REPORTS - LEGISLATIVE REPORT AB2622 - Provides specified procedures to govern city and county zoning and planning hearings. Said procedures are being followed at the present time by the City Planning Commission with the exception of the requirement for swearing in witnesses and preparation of various transcripts. AB1142 - Amends Section 117 of the Code of Civil Procedure relating to small claims courts. This bill has passed and has been signed by the Governor which raises the monetary limit to be handled by small claims courts from $300 to $500. REQUEST AND AUTHORIZATION TO CALL FOR BIDS FOR DISTRIBUTION CABLE (OAK STREET FEEDER LINE TO NORTH SUBSTATION) Acting City Manager Kruth reviewed specifications for subject bid. The bid call was requested for 2:00 p.m. , October 5, 1971 On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unanimously carried the Clerk be authorized to call for bids for distribution cable to complete the Oak StreetFeeder Line to the North Substation, bids to be received prior to 2:00 p.m. , October 5, 1971. FAIRWAY OAKS SUBDIVISION UNIT #5 ACCEPTANCE OF SUBDIVISION IMPROVEMENTS At this point, Councilman Buxton disqualified himself from participation in the following discussion and action. A memorandum dated September 15, 1971, from the Public Works Department was read stating improvements required under agreement with the City have been constructed according to plans and specifications of the City and recommended the Council accept the improvements as complete and authorize the City Clerk to release security deposits according to provisions of the subdivider's agreement. RESOLUTION NO. 72-19 ACCEPTING IMPROVEMENTS & RELEASING SECURITY FDR FAIRWAY OAKS SUBD. #5 On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unanimously carried Resolution No. 72-19 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Of The City Council of the City of Ukiah Accepting the Improvements in Fairway Oaks Subdivision Unit No. 5 And Releasing Security Therefor". Councilman Buxton resumed his place at this point in the meeting. AWARD OF BID FOR CONSTRUCTION OF OPEN HANGAR STORAGE FACILITIES TO BRADY CONSTRUCTORS & CRANE OF UKIAH Acting City Manager reviewed the tabulation of bids received for the con- struction of open hangar storage facilities as follows: Denny and Gianoli Construction Company, Ukiah $23,089.43 Brady Constructors and Crane of Ukiah $25,160.00 Wagner Construction, Inc. , Ukiah $26,860.00 Cen Cal, Oakland $27,849.00 Page Construction Company, Novato $28,584.00 Christensen and Foster, Santa Rosa $29,971.00 Christensen Construction, Ukiah $31,246.00 Engineer' s Estimate $20,900.00 - MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH SEPTEMBER 15, 1971 - PAGE 3 Acting City Manager read from a portion of the technical specifications per- taining to general construction requirements for subject facilities. The two lowest bidders furnished additional engineering data necessary to assure that City requirements are met. The additional data was reviewed by the Acting City Manager after which he recommended the bid be awarded to Brady Constructors and Crane of Ukiah and the low bid be disqualified because of the need for substantial modification to conform to requirements. Council indicated the possibility of a need to clarify the language in future specifications to eliminate confusion when bids are awarded. The following Council decision was based on the fact that Brady Constructors and Crane of Ukiah's bid proposed a structure to house 14 planes as set forth in the specifications. The low bid, without modification, would house 12 planes. On a motion by Councilman Pearson, seconded by Councilman Scotto it was unanimously carried to award the bid for construction of open hangar storage facilities to Brady Constructors and Crane of Ukiah in the total amount of $252160.00. REPORT OF BIDS FOR F.A.A. BUILDING Acting City Manager reviewed the bids received for subject construction as follows: Page Construction, Novato $932980 Christensen Construction, Ukiah $942945 Todd Construction, Santa Rosa $962856 Brady Constructors and Crane of Ukiah $97,577 M & H Construction, San Jose $972819 James Construction, Santa Rosa $98,900 Wagner Construction, Ukiah $101,284 Recommendation was withheld pending review of financing with F.A.A. officials and discussion with some of the contractors to determine reasons for the high cost per square footage for the proposed construction. PROPOSED RELINQUISHMENT OF TALMAGE ROAD A letter from the City Manager to the Division of Highways concerning subject matter was reviewed. Said communication was submitted in compliance with instructions given at the hearing held in the Courthouse August 31, 1971, and requested that the contents of the communication be included in the trans- script of the hearing as the formal position of the City in relation to the proposed relinquishment. The letter reiterated the previous position of the Council, i.e. this portion of the state highway should remain a state respon- sibility. If the City's position changes, a correction of deficiencies would be necessary. LEAGUE OF CALIFORNIA CITIES CONFERENCE IN SAN FRANCISCO Acting City Manager reminded the Council of the League meeting to be held in San Francisco September 26-29 and read the names of notable persons who will address those attending. FORMER COUNCILMAN HARRY HILTS HONORED Council was reminded of the open house scheduled p to honor former Councilman Harry Hilts on his 90th birthday. The celebration will be at the Upper Lake Methodist Church September 18th. COUNCILMAN SCOTTO Councilman Scotto referred to a resolution received from the North Coast Oppor- tunities Council regarding Mainstream employees and requested that Mainstream employees who have completed a year of satisfactory work with the City be considered as one of the three applicants for the position should a job in which he has been training, becomes vacant. It was the understanding of other Council members that this is the procedure being followed at the present time. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH SEPTEMBER 15, 1971 - PAGE 4 COUNCILMAN BUXTON Councilman Buxton requested consideration be given to turning the sprinklers on automatically every few minutes at the Seminary Parkway. The gathering of youth at this location is creating a problem. Councilman Buxton requested consideration of a budget item to participate in the purchase of a scoreboard at Anton Stadium to be used at football and baseball games. Acting City Manager explained information in this regard came into the City Manager's office this date and could be discussed at the next Council meeting. MAYOR NO RGARD Mayor Norgard commented on the successful barbeque at the park and expressed his appreciation of the work of Frank Hampton. Councilman Simpson suggested each Councilman write a note of thanks to Mr. Hampton and his committee. MR. RAY NOFFI - F.A.A. FLIGHT SERVICE SUPERVISOR Mr. Ray Noffi was present in the audience and expressed his thanks to the Council for projects completed at the airport. He stated there has been a 9.8% increase in the service provided by the flight service station in the past eight- months and all other airports are currently showing decreases.
