HomeMy WebLinkAboutMin 10-06-71 a Y � r MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH OCTOBER 6. 1971 The City Council of the City of Ukiah convened in regular session at 8:08 p.m. with Councilmen Scotto, Simpson, Pearson and Mayor Norgard present. Councilman Buxton was absent. PLEDGE OF ALLEGIANCE Councilman Scotto led in the pledge of allegiance. APPROVAL OF MINUTES On a motion by Councilman Simpson, seconded by Councilman Pearson, it was unanimously carried the minutes of the regular meeting of September 15, 1971, be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Scotto, seconded by Councilman Pearson, it was unani- mously carried Payroll Warrants #1001 to #1129 inclusive for the period of September 1st to 15, 1971, inclusive in the total amount of $48,739.97 and Payroll Warrants #1130 to #1282 inclusive for the period of September 16th to 30, 1971, inclusive in the total amount of $49,223.63 be approved. COUNCILMAN BUXTON ARRIVED AT THIS POINT - 8:09 P.M. GENERAL WARRANTS On a motion by Councilman Pearson, seconded by Councilman Scotto, it was unani- mously carried General Warrants #4492 to #4516 inclusive in the amount of $98,723.93 be approved and ordered paid. Councilman Buxton asked if the warrant to the Public Employees Retirement System included one months contributions and received an affirmative answer. On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unanimously carried Special Warrant #4491 in the amount of $311.70 be approved and ordered paid. PUBLIC HEARING ZONE CHANGE APPLICATION NO. 71-24 (E. PERKINS ST. TO E. GOBBI & FROM NWPRR TO ORCHARD AVENUE) The City Attorney reported this as being the date and time set for considera- tion of Zone Change Application No. 71-24 initiated by the Planning Commission to change zones in the area bounded by East Perkins Street, Orchard Avenue, East Gobbi Street and the Northwestern Pacific Railroad excepting the major portion of Orchard Village Subdivision. Affidavits of Publication of the required legal notice of the hearing as well as Affidavits of Posting were placed on file. Memorandum of transmittal from the Planning Commission dated July 20, 1971, was read recommending approval of subject application. A map showing the present zoning and the proposed zoning of subject area was reviewed. Public hearing was declared open at 8:19 p.m. The following persons present in the audience spoke on subject matter: Larkin Younce, 775 South State Street ,_ Jack Pearson, 300 E. Gobbi George S. Singley, 100 Orchard Avenue There were no objections to the proposed zone change. Questions regarding the effect the proposed change would have on each of the above named persons were answered. Public hearing was closed at 8:37 p.m. On a motion by Councilman Simpson, seconded by Councilman Scotto, it was carried by the following roll call vote the City Attorney be directed to prepare an amending ordinance in accordance with Zone Change Application No. 71-24 as recommended by the Planning Commission. AYES: Councilmen Scotto, Buxton, Simpson, and Mayor Norgard. NOES: None ABSENT: None Councilman Pearson withdrew due to a conflict of interest. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH OCTOBER 6, 1971 - PAGE 2 AWARD OF BID FOR CONSTRUCTION OF F.A.A. FLIGHT SERVICE STATION TO PAGE CONSTRUCTION, NOVATO Since the September 15, 1971 meeting at which time bids for subject construction were reviewed, F.A.A. officials have advised of their approval of the low bid received from Page Construction,Novato. A letter indicating the formal approval and containing an agreement to enter into a 10 year ammortization program is in transit. Inasmuch as the 30 day period allowed for award of the bid will lapse prior to the next meeting, the City Manager recommended the bid be awarded to Page Construction, Novato subject to receipt of formal approval by F.A.A. On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unani mously carried to accept the bid of Page Construction, Novato, in the total amount of $93,980, subject to formal approval by F.A.A. in accordance with the verbal committment. The City Manager stated he was pleased to see the government take the shorter ammortization to save the additional interest that would result from a 15 year term program. It was recommended the bid call be 2:00 p.m. October 26, 1971. REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR SERVICE TRUCK PUBLIC WORKS DEPARTMENT City Manager reviewed specifications for subject replacement vehicle and re- quested authorization to call for bids for October 26, 1971, 2:00 p.m. On a motion by Councilman Buxton, seconded by Councilman Scotto, it was unani- mously carried the Clerk be authorized to call for bids for minimum 10,000 pound GVW rated service truck, bids to be received prior to 2:00 p.m. , October 26, 1971. REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR FIVE POOL VEHICLES City Manager reviewed specifications for subject vehicles and requested authorization to call for bids October 26, 19712 2:00 p.m. Four units are replacement vehicles; one additional unit for warehouse use. It was noted that subject units will be from the series of compact cars available from four .w"' local bidders. Experience of other cities in the use of the compact cars resulted in satisfactory reports. Councilman Simpson questioned the safety and life expectance of the compact units. On a motion by Councilman Buxton, seconded by Councilman Scotto, it was carried by the following roll call vote the Clerk be authorized to call for bids for five pool vehicles as recommended by the City Manager, bids be received prior to 2:00 p.m. , October 26, 1971. AYES: Councilmen Scotto, Buxton, Pearson, and Mayor Norgard. NOES: Councilman Simpson ABSENT: None. REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR RADIO EQUIPMENT FOR FIRE DEPARTMENT City Manager reviewed specifications for 1 FM base station, multi-channel, 1 FM two way mobil radio and related radio equipment and requested authoriza- tion to call for bids for October 26, 19712 2:00 p.m. City Manager reported all fire department radio equipment will eventually be replaced and the successful bidder for subject equipment will gain an advantage for future bids. On a motion by Councilman Scotto, seconded by Councilman Buxton, it was unanimously carried the Clerk be authorized to call for bids for radio equip- ment as recommended by the City Manager, bids to be received prior to 2:00 p.m. October 26, 1971. REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR ONE 167 KVA & TWO 75 KVA PAD-MOUNTED TRANSFORMERS City Manager reviewed subject specifications for subject transformers and requested authorization to call for bids for October 26, 1971, 2:00 p.m. On a motion by Councilman Simpson, seconded by Councilman Scotto, it was unanimously carried the Clerk be authorized to call for bids for transformers as recommended by the City Manager, bids to be received prior to 2:00 p.m. , October 26, 1971. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH OCTOBER 6, 1971 - PAGE 4 DISCUSSION OF REQUEST FROM SCHOOL DISTR.iCT RE POLICE SERVICE AT HIGH SCHOOL FUNCTIONS City Manager reported he had talked with Mr. W. 0. Murphy, Superintendent of the Ukiah Unified School District regarding subject matter. A letter dated October 4, 1971, from Mr. Murphy was read requesting increased police coverage at athletic events and expressing concern because of possible liability resulting from security guards hired by the district to provide crowd control functions which, in their opinion, should be provided by the City. The City Manager stated the Police Department is responsible for traffic control and trouble incidents that may occur at any public event, but it is Council policy for any service beyond this to be paid for by the agency requiring the service. The following persons were present and spoke regarding the matter. Their statements are set forth below: Mr. Bill Tully, Ukiah High School Mr. Bill Broaddus, Ukiah High School Mr. Charles Bell, Board of Education 1) The request is a question of responsibility. The subject is crowds of people. The line of responsibility for control should go to the pro- fessionals. Police force from two separate organizations for the same event is not right. 2) The major concern is that no officer is assigned to cover the event during its entire duration. The police officer has, on occasions, left the assignment at the stadium to cover an incident elsewhere. Exit from the stadium considered to be an emergency need. Having one off duty officer attend school functions where large crowds are in a confined area considered W» to be an obligation of the city. 3) Of the opinion the high school students themselves are responsible for no incidents to date which is not the case in other schools. 4) Cannot hire off duty officers - have to hire reserves. 5) The proposal would be to ask the Police Chief how many officers would be needed for an estimated number of spectators. 6) EXpense is not the only concern. Responsibility of control of discipline is of concern. 7) High school games were moved to the stadium because of pressure from a committee for night games. Various members of the Council made the following statements and raised the following questions: 1) Football games are not limited to students. The entire community participates. What obligation does the city have to protect the needs of the City. It was pointed out that the city is not obligated to perform this function automatically. 2) It was suggested that a committee be appointed to review the matter. It was pointed out that the city is following a policy set by the Council, that this request is beyond the level of police service that our department furnishes. 3) If the high school contracts for police protection, who do they hire? The school district hired security guards from a private agency the last few months of the school year. 4) It appears that money is not the key - manpower is the key. 5) Why does the police department not cooperate? 6) Is there city responsibility on city property? f MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH OCTOBER 6, 1971 - PAGE S City Manager asked if a formula were devised for a given number of policemen _ for a high school event and the City indicated one would be required, would the school district be willing to pay for that one? Their answer was that they could not answer for the board. City Managerrecommended the City Attorney and the District Attorney meet to determine who is legally responsible in such a situation. Councilman Simpson stated this would not allow time for a decision prior to the Friday night football game. Councilman Buxton stated he was of the opinion the Council is responsible to the citizens. Council agreed the matter to be worked out as suggested by the City Manager and that proper coverage at the Friday night game be guaranteed. City Manager requested it be understood that the matter is totally different to that proposed in the letter from the Superintendent of the school district. REPORT OF LEAGUE OF CALIFORNIA CITIES CONFERENCE The City Manager reported the League meeting was attended by Mayor Norgard, and Councilmen Pearson and Scotto. The three day meeting was highlighted by representatives of both parties - Congressman Wilbur Mills, Senator Hubert H. Humphrey, Mayor John Lindsay of New York, Mayor Alioto of San Francisco, Casper Weinberger, Deputy Director of the Office of Management and Budget in the White House, Vice-President Agnew and Governor Ronald Reagan. The meeting covered the following points: 1) Revenue sharing programs were discussed. Method for making it work is disputed. 2) A series of resolutions were adopted at the business sessions a portion of which was reviewed by the City Manager. Council will be furnished with details regarding said resolutions at a later date. 3) A problem developed in voting at the business session. Effective immed- iately, each city shall delegate a voting delegate and some means will be devised to make sure each city gets one vote and no more. 4) Police and Fire Department sessions were attended by the City Manager. Councilman Pearson stated the question came up as to the correct title for a female member of a Council. In the opinion of the League, a female member of a Council is to be called "Councilman" since it is a position being filled. Councilman Pearson suggested that a representative from the Planning Commission and Recreation and Parks Commission attend the League meeting next year. Councilman Pearson stated she was impressed with her first League meeting and that a great deal can be gained from such meetings. WAGE-PRICE FREEZE City Manager reported the request for exemption from the Executive Order for wages has been denied. The letter of denial from Mr. Ralph D. Burns, Regional Director of the federal program was read. A memorandum will go to employees this week to advise each one of the efforts made and action taken. TELEVISION PROGRAM The City Manager reported he and Councilman Pearson appeared on a one hour television show September 22. Questions were asked by television personnel and the audience was requested to call in for answers to questions. One call was a complaint about a trucking firm on Cherry Street. The matter has been checked. The trucking firm is operating in a properly zoned area and there is no violation. COUNCILMAN SIMPSON - LAFCO MEETING Councilman Simpson reported attending the LAFCO meeting. The York Ranch annexation to Willow County WAter District was discussed. The County has developed excellent maps which may be of interest to the city. SB920 was discussed. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH OCTOBER 6, 1971 - PAGE 6 COUNCILMAN SIMPSON Councilman Simpson reported a citizen called to state he was happy to see the work being done on Oak Street. Councilman Simpson asked if a pedestrian crosswalk could be painted on Dora Street at Holden. Councilman Simpson asked the City Attorney the law as it pertains to entrapment (radar control behind trees) . MAYOR NORGARD Mayor Norgard referred to dogs running loose within the city and stated we are not getting the service as set forth in the agreement with the County. The City Manager will check into the matter. Mayor Norgard asked the possibility of the Traffic Committee discussing a truck route in relationship to our city streets. Mayor Norgard reported the downtown merchants seem to be happy about the parking available to their customers with the parking available to them in the parking district. Some want to increase the parking available. Information in this regard is being compiled at the present time. 1970 CENSUS City Manager reported he plans for an allocation in the next budget to pay the federal government to run the base figure in an official federal census count. ADJOURNMENT There being no further regular business, Mayor Norgard declared the meeting adjourned at 11:20 after which the Council reconvened in closed personnel session. Mayor ATTEST: City Clerk
