FEBRUARY 2, 1972
The City Council of the City of Ukiah convened in regular session at 8:05 p.m.
with Councilmen Scotto, Simpson, Pearson, and Mayor Norgard present. Councilman
Buxton was absent.
INVOCATION & PLEDGE OF ALLEGIANCE
The invocation was given by The Reverend Mr. Cornish Jones and Councilman Scotto
led in the pledge of allegiance.
APPROVAL OF MINUTES
On a motion by Councilman Pearson, seconded by Councilman Simpson, it was unani-
mously carried minutes of the regular meeting of January 19, 1972, be approved
as submitted by the Clerk.
PAYROLL WARRANTS
On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unanimously
carried Payroll Warrants #2310 to #2438 inclusive for the period of January 1st
to January 15, 1972, inclusive, be approved in the total amount of $50,994.95.
GENERAL WARRANTS
On a motion by Councilman Simpson, seconded by Councilman Pearson, it was unani-
mously carried General Warrants #5128 to #5185 inclusive, in the total amount
of $16,436.37 be approved and ordered paid.
WATSON TAX LIMITATION INITIATIVE
CONSTITUTIONAL AMENDMENT
The City Attorney gave a detailed report of the provisions of subject initiative.
The required number of signatures have been secured and it appears there will be
sufficient valid signatures for the initiative to qualify for the June ballot.
In the event it passes, it will become effective immediately. The bill, if
enacted, proposes to bring about property tax relief, but in fact will result
in only a tax shift, not meaningful reform. The increase would come in the
areas where it could least affor�l.to be absorbed. This is another bill which
appears to be against the home rule type of government. The three sources used
by the City Attorney in giving this report are available to the Council for their
review.
LEGISLATIVE REPORT
City Attorney reported League bulletins indicate the major emphasis this legisla-
tive session is on school financing, shoreline controls and another push for
tippler's tax or increase in liquor license fees. There is also a shifting of
costs from the state to the cities for fingerprint costs and fees charged to
file annexation maps with the State. The elements for the required general plan
for cities are increasing at such a rate that it is impossible for the cities
to keep their plan current.
CLAIM FOR DAMAGES DENIED
(CORA FISCHE R, 221 NORTON ST.)
City Attorney reviewed subject claim wherein claimant alleged low voltage
situation caused damage to refrigerator and freezer. It was recommended the
claim be denied.
On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unani-
mously carried subject claim in the amount of $119.00 be denied as recommended.

REQUEST & AUTHORIZATION TO CALL
FOR BIDS FOR POWER POLES
City Manager reviewed specifications for thirty power poles of various
lengths and recommended the bid call be 2:00 p.m. , February 16th.
On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unani- -7
mously carried the Clerk be authorized to call for bids for subject power
poles, bids to be received prior to 2:00 p.m. February 16, 1972.
ASSIGNMENT OF CAPITAL IMPROVEMENT
PROGRAM TO PLANNING COMMISSION
Reports from the Airport and Recreation and Parks Commission setting forth
their recommendations for the capital improvement program and recommended
projects from the City Manager's office had been reviewed by the Council.
Prior to being frowarded to the Planning Commission for recommendation, Council
stressed the importance of the flexibility of the program and the need for the
Planning Commission to be innovative in their thinking and not be limited
to only the projects proposed. Consideration should be given to the use of ideas
that may generate from citizens, individually or collectively. It was
pointed out that financing will be one of the major problems in this type
program but this should not be a controlling factor in the determination of
existing needs. Councilman Scotto asked if it was planned to use consultants and
was advised that it was not considered necessary or advisable at this time.
On a motion by Councilman Pearson, seconded by Councilman Simpson, it was
unanimously carried to forward the Airport and Recreation and Parks Commission
reports along with Council recommended projects to the Planning Commission
for their study and review to be used as a basis for a city wide coordinated
capital improvement program.
RESOLUTION NO. 72-29 COUNTY-WIDE
STUDY FOR SOLID WASTE DISPOSAL
City Manager reported a committee has been working on a plan for county wide
disposal of solid waste. Increased restrictions make it necessary to develop
a plan for joint effort to reduce cost. The County has made the contact for
federal financing for a solid wasts management plan and has submitted a resolution
for Council consideration which will designate the County of Mendocino as
the agency for solid waste planning. The adoption of the resolution does
not preclude the city adopting any internal programs or procedures that may
be necessary.
On a motion by Councilman Scotto, seconded by Councilman Simpson, it was
carried by the following roll call vote Resolution No. 72-29 be adopted and
the Mayor and Clerk be authorized to sign same, "Resolution Of The City Council
Of The City Of Ukiah Designating The County Of Mendocino, Acting Through The
Comprehensive Solid Waste Management Committee As The Agency For Solid Waste
Planning For The City Of Ukiah".

ABSENT: Councilman Buxton
LIBRARY PROJECT
The death of Mr. John Wagner, Contractor for the library, has posed questions
regarding the Contractor's license and the resulting protection to the city.
The Contractor's attorney has been contacted and it has been determined
the law provides for continued operation to completion of the project.
City Manager reviewed the library financing as compared to estimated costs.
It appears that the total cost of the project will be below the original
estimate.

OF LEAGUE OF CALIFORNIA CITIES
City Manager gave a report of subject meeting attended by he, Councilman
Pearson, Mayor Norgard and the City Attorney. There was a need expressed for more
city participation and improved probram content. There was also a discussion
of pending legislation and cost of city liability insurance.
PROCLAMATION - "CABLE TV WEEK"
City Manager read subject proclamation and Mayor Norgard declared the period of
February 13 through February 19, 1972, as Cable TV Week, recognizing the
contributions and growth of the cable television industry.
COUNCILMAN BUXTON TO REPRESENT COUNCIL
AT CHAMBER OF COMMERCE MEETINGS
City Manager read a letter from the Chamber of Commerce indicating their revised
bylaws authorizes a Council member to be added to the Board with full membership
and voting rights and requested the Council appoint a representative. Councilman
Buxton was appointed as the Council's representative at said board meetings.
PROPOSED JOINT POWERS AGREEMENT
CREATING PLANNING AGENCY
City Manager reported discussions have been held with the County Administrator
regarding the regional planning and development commission and the possible
inclusion of Sonoma County with the four other counties in the region. A
joint powers agreement is proposed to create said commission. Council will be
advised when more factual information is available.
COUNCILMAN SCOTTO
Councilman Scotto asked the status of the memorandum of agreement with the union
as it pertains to health insurance. City Manager reported a meeting is scheduled
February 3rd with the union to discuss the matter.
COUNCILMAN PEARSON
Councilman Pearson expressed her thanks to the Volunteer Fire Department for
the Council invitation to attend the spaghetti dinner at the fire house this
date.
COUNCILMAN SIMPSON
Councilman Simpson referred to a building being torn down on Low Gap Road
and the possible hazard that could develop. City Engineer will contact the
out of town owner to determine a time schedule for its continued demolition.
AME RI CAN FIELD SERVICE STUDENT
The City Engineer, A. S. Kruth, introduced Steven Page from Sydney, Australia
who was visiting in his home. Steven stated he has been spending the current
school year in Walnut Creek under subject program and is in Ukiah during the
mid-year student exchange program. He expressed his appreciation for the
opportunity to visit Ukiah and meet the friendly citizens.
MAYOR NO RGA RD
Mayor Norgard reported the dinner served by the Volunteer Firemen this date
was the kick-off dinner for the Fireman's Ball next month. Tickets to said
ball were mailed this week.

ACCEPTANCE OF AUDIT REPORT
City Manager reported receipt of a letter of clarification of the public audit
as it pertains to points heretofore discussed and recommended acceptance of
the report as revised.
On a motion by Councilman Scotto, seconded by Councilman Simpson, it was unani-
mously carried to accept the audit report as revised of John R. McKean, CPA.
ADJOURNMENT
Mayor Norgard adjourned the meeting at 9:52 p.m. after which the Council
reconvened in closed personnel session.
