HomeMy WebLinkAboutmin 09-06-72 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH SEPTEMBER 6, 1972 The City Council convened in regular session in the Council Chambers at 8:02 p.m. with Councilmen Weinkauf, Norgard, Simpson, Pearson and Mayor Buxton present. City Manager Lyell C. Cash was absent. City Manager pro tempore A. S. Kruth was present. INVOCATION & PLEDGE OF ALLEGIANCE The invocation was given by the Reverend Mr. Ferrier and Councilman Norgard led in the pledge of allegiance. APPROVAL OF MINUTES On a motion by Councilman Pearson, seconded by Councilman Weinkauf, it was unani- mously carried the minutes of the meeting of August 16, 1972, be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Norgard, seconded by Councilman Weinkauf, it was unani- mously carried Payroll Warrants #1723 to #1867 inclusive for the period of August 1, 1972, to August 15, 1972, inclusive be approved in the total amount of $57,494.05. SPECIAL WARRANTS On a motion by Councilman Pearson, seconded by Councilman Simpson, it was unani- mously carried Special Warrants #384 to #418 inclusive, in the total amount of $57,815.82 be approved and ordered paid. PUBLIC HEARING ZONE CHANGE APPLICATION NO. 73-2 (VERN PARDUCCI) _ Public hearing was declared open at 8:05 p.m. on subject application by Vern Parducci for Pomeroy-Nipper to rezone property located at 700 E. Gobbi Street from R-1 Single Family Residential to R-3 Multiple Family Residential. Affi- davits of Publication of the required legal notice of the hearing as well as Affidavits of Posting and Mailing were placed on file. Planning Commission Findings of Fact dated August 10, 1972 recommending approval of subject application was read. Plot plan of the area was reviewed. Subject area, if approved for zone change, will be used to construct and develop a mobile home park as requested in Use Permit Application No. 73-3 granted by the Planning Commission contingent upon the granting of subject application. The City Attorney pointed out the pending request is a permitted use controlled by specific conditions. There was no one present in the audience to express opposition to the granting of subject application. Mr. Don Whittemore, Pomeroy-Nipper and Mr. Vern Parducci were present and spoke on behalf of the application. Concern was expressed regarding problems which result as each development of this nature materializes, ie (1) the degree of ground density, (2) the drainage problem, (3) water runoff which adds additional burden to property owners down- stream. Mr. Parducci stated the plan for the area in question would allow adequate open space for recreational facilities within the mobile home park so that undue demands would not be placed on the city park located in close proximity to the area. City Manager pro tempore enumerated costs which will be borne by the developer if subject application is approved. It was agreed that the correction of the overall drainage problem as well as the water run-off problem which eventually reaches the County should be a combined city-county project and that said correction could begin in this area. The City Manager pro tempore was instructed to discuss the problem and possible solutions with the County. * fir: MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH SEPTEMBER 6, 1972 - PAGE 2 On a motion by Councilman Simpson, seconded by Councilman Norgard, it was unani- mously carried to close the public hearing on subject application at 8:55 p.m. On a motion by Councilman Simpson, seconded by Councilman Pearson it was carried by the following roll call vote to instruct the City Attorney to prepare an amending ordinance in accordance with Zone Change Application No. 73-2 by Vern Parducci as recommended by the Planning Commission. AYES: Councilmen Weinkauf, Norgard, Simpson, Pearson, and Mayor Buxton. NOES: None ABSENT: None. PUBLIC HEARING ZONE CHANGE APPLICATION NO. 73-4 (DIVERSIFIED SHOPPING CENTERS) Public hearing was declared open at 9:00 p.m. on subject application by Diversified Shopping Centers for Pomeroy-Nipper to rezone parcels located on the northwest corner of Gobbi Street and U.S. Highway 101 from R-3, Multiple Family Residential, and R-1, Single Family Residential, to C.N. , Neighborhood Commercial, for the purpose of constructing and developing a shopping center. Affidavits of Publication of the required legal notice of the hearing as well as Affidavits of Posting and Mailing were placed on file. Planning Commission Findings of Fact dated August 10, 1972, recommending approval of subject application was read. A letter dated August 29, 1972, from Mrs. Betty Austin, Santa Fe Springs, Califor- nia, a joint tenant owner of property located at 599 Plum Drive, was read by the City Attorney. Said letter expressed opposition to the granting of the application. There was no one present in the audience to express opposition. Mr. Wes Bentley, representing Diversified Shopping Centers, was present in the audience to give a brief history of the company, to present an artist's rendering of the proposed development, and to give a report of the principal businesses negotiating for occupancy in the proposed center. The City Attorney read Section 9167 of the Ukiah City Code pertaining to archi- tectural controls and from the zoning ordinance regarding uses allowed and uses permitted in C-N zones. Mr. Don Whittemore, Pomeroy-Nipper spoke in behalf of the application. Mr. Brooks, who operates a business in a shopping center in another section of the city spoke in favor of the application and stated he welcomed the competition the center would bring to the city. Council discussed the matter of increased traffic on Orchard Avenue if the proposed complex develops and questioned the ability of the street at its present width to accomodate said increase. City Manager pro tem stated the question of the adequate width of Orchard Avenue depends on how the accesses are worked out. He also stated that if no parking is allowed on the east side of Orchard, this could also alleviate the traffic problem. Mr. Whittemore stated, in his opinion, the width of the street would be adequate with the 10' his company has given, the no parking on the east side of said street, and the off-street parking which will be provided within the center. Council discussed the importance of and determined that the C-N zone should be continued from Gobbi 'Jtreet to Perkins Street on the west side of the freeway. On a motion by Councilman Pearson, seconded by Councilman Simpson it was unani- mously carried to close the public hearing on subject application at 9:50 p.m . On a motion by Councilman Pearson, seconded by Councilman Simpson it was carried by the following roll call vote to instruct the City Attorney to prepare an amending ordinance in accordance with Zone Change Application No. 73-4 by Diver- sified Shopping Centers as recommended by the Planning Commission. UNDERWOOD) On a motion by Councilman Simpson, seconded by Councilman Pearson, it was unani- mously carried the Golf Professional Concession Agreement between the City and Paul R. Underwood be approved and the Mayor and Clerk be authorized to sign same. MENDOCINO COUNTY CHAMBER OF COMMERCE CONTRACT APPROVED On a motion by Councilman Norgard, seconded by Councilman Simpson, it was unani- mously carried the "Agreement For Advertising" be approved and the Mayor and Clerk be authorized to sign same. APPROVAL OF LAND LEASE AGREEMENT AIRPORT PROPERTY (CITY EMPLOYEES CREDIT UNION) On a motion by Councilman Simpson, seconded by Councilman Weinkauf, it was unani- mously carried the "Land Lease Agreement Airport Property; City of Ukiah Employees Credit Union" be approved and the Mayor and Clerk be authorized to sign same. APPROVAL OF REQUEST FOR SUPPORT �j0 HOST FIREMEN'S CONFERENCE IN 1979 Mr. Johnny Dodds, from the Ukiah Fire Department, requested Council support for subject conference to be held in Ukiah in 1976 to coincide with the City's centennial year. The request was for $1000 per year for four years, or a total of $4000. On a motion by Councilman Simpson, seconded by Councilman Norgard, it was unani- mously carried to approve the request from the Fire Department for support in a total amount of $4000 subject to permission being granted by the California I! State Firemen's Association for the conference to be held in Ukiah in 1976 and the City Attorney be directed to draft the appropriate document expressing to said association Council support for Ukiah to be the host city in 1976. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH SEPTEMBER 6, 1972 - PAGE 6 REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR POLICE RADIO EQUIPMENT (CALIFORNIA COUNCIL ON CRIMINAL JUSTICE) City Manager reviewed subject specifications which had been changed to meet objections raised by manufacturers who will bid the equipment and as had been directed by the Council at the regular meeting of July 18, 1972. The bid call was recommended for 2:00 p.m. , October 3, 1972. On a motion by Councilman Pearson, seconded by Councilman Weinkauf, it was unanimously carried the Clerk be authorized to call for bids for police radio equipment, bids to be received prior to 2:00 p.m. October 3, 1972. REPORT & RECOMMENDATION RE SANITARY LANDFILL OPERATION City Manager reviewed the current status of the sanitary landfill operation. The D-8 caterpillar operating at the site at the present time is on a 90 day lease committment from Berglund Tractor Company, Willits at a cost of $4347.93 per month. Further discussion with the company regarding a longer term arrangement for the city to own the equipment resulted in a proposal which was reviewed in detail by the City Manager pro tempore. Said proposal would include a five year lease arrangement whereby the City could purchase the equipment at the end of the five year period ofr $1.00. During the lease arrangement, Berglund Tractor Company would be responsible for on site maintenance and lubrication at a cost of $2597.48 per month. The breakdown of cost per hour, excluding operator and fuel, would amount to $10.71. City Manager pro tempore recommended the present arrangement with Berglund Tractor be converted to the proposal enumerated above at the end of the current 90 day committment. Councilman Norgard expressed opposition to the proposal. He stated that he was of the opinion that an arrangement could be worked out whereby Berglund Tractor could be called for major breakdowns and City personnel could take care of routine maintenance and lubrication. He asked why consideration should not be given to outright purchase of the equipment. Council determined that the matter will be held over until the next meeting. In the meantime Council will study the proposal and the City Manager pro tem will present to the Council an evaluation of city personnel performing the minimum maintenance and lubrication and the merits of an outright purchase of said equipment. REQUEST FOR POLICE SERVICES AT FOOTBALL GAMES City Manager pro tem reviewed the present Council policy regarding police service for special events and subject request and the possibility of working the provision for said service into the current school district recreational agreement. Council determined that the present policy will be maintained. The City is obligated to handle the traffic situation on city streets but it is the responsibility of each agency conducting special functions to provide or bear the expense of police pro- tection within the function. CORRESPONDENCE: DATES TO REMEMBER 1) Invitation from Ukiah Elks Lodge for dinner meeting September 13th to extend to the Council appreciation of the outstanding and important tasks performed in this area. 2) Invitation extended from the City of Rohnert Park to visit their new facilities. 3) Employees' Annual Picnic and Barbeque will be held at the Municipal Park, Thursday, September 21st, 6:00 p.m. 4) Annual League of California Cities meeting in Anaheim October 15-18. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH SEPTEMBER 6, 1972 - PAGE 7 PROCLAMATION - "WORLD LITERACY DAY IN UKIAH" Mayor Buxton read a Proclamation and declared Friday, September 8, 1972, to be observed as World Literacy Day in Ukiah, and commended the Ukiah Literacy Council for their work in training tutors to teach adults to read and write. COUNCILMAN WEINKAUF Councilman Weinkauf requested Council consensus regarding starting Council meetings at 7:30 p.m. and did not receive a favorable response. COUNCILMAN NORCARD Councilman Norgard reported he had attended a meeting this week of the Hospital Utilization Committee. Recent legislation prohibits the hospital facility being used for anything other than public use. COUNCILMAN SIMPSON Councilman Simpson requested the Traffic Committee consider placing a 4-way stop at the Maple-Hazel Avenue and Dora-Hazel Avenue intersections. Councilman Simpson reported the South Ukiah Little League team has been presented with a trophy recognizing the team as the Northern California Little League Champs. Said trophy was given by Mr. Cisco, Palace Hotel. Councilman Simpson read the names of the team members and the manager and coach. It was requested that the trophy remain at City Hall and hang in the Council Chambers. COUNCILMAN PEARSON Councilman Pearson reported receipt of a complaint prior to the meeting concerning lumber which has been stacked for a long period of time on Barnes Street between Perkins and Standley. MAYOR BUXTON Mayor Buxton asked the status of the proposed Gobbi Street paving at the railroad crossing. City Manager pro tem gave a current status of the project. Mayor Buxton reported the meeting of the Solid Waste Management Committee scheduled for tomorrow has been postponed. Council will be advised of the change of date.
