HomeMy WebLinkAboutmin 11-15-72 MINUTES OF THE REGULAR MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH NOVEMBER 15, 19, 7.2- The 972The City Council convened in regular session in the Council Chambers at 8:30 P.M. with Councilmen Weinka.uf, Norgard, Simpson, and Pearson present. Mayor Buxton was absent. INVOCATION The invocation was given by the Reverend Mr. Elmer Schmitt. MAYOR BUXTON ARRIVED AT THIS POINT IN THE MEETING - 8:05 P.M e PLEDGE OF ALLEGIA1NCE Mayor Buxton led in the Pledge of Allegiance. APPROVAL OF MINUTES On a motion by Councilman .Pearson, seconded by Councilman Weinkauf, it was unani- mously carried minutes of the meeting of November 1, 1972, be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Norgard, seconded by Councilman 79einkau.f, it was unanimously carried payroll Warrants #258 to x#2615 inclusive .for the period of October 16th to October 31, 1972 inclusive be approved in the total amount of X60,211.83. GENERAL WARRANTS On a motion by Councilman Simpson, seconded by Councilman Pearson, it -was unanimously carried General Warrants #724 to #891 inclusive, in the total amount of 7165,796.96 be approved and ordered paid. PROCLAMATION - YOUTH WEEK IN UKIAH l°ayor Buxton read a proclamation declaring the week of November 26th through December 2, 1972, as Youth Week in Ukiah. ADOPTED ORDINACE NO. 62 5/Amending POR'T'ION OF THE CITY CODE BY DREZ ONING AREA IN ZONE CHANGE APPL. NOS. ?3-4) 73-71 73-8 On a motion by Councilman Simpson, seconded by Councilman Weinkauf, it was carried by the following ro4l call vote Ordinance No. 625 be adopted and the Mayor and Clerk be authorized to sign same, "Amending Chapter 2, of Division 9, Of The Ukiah City Code By Rezoning In An Area Bounded On The West By- Orchard Avenue, On the East By State Highway 101, On The South By East Gobbi Street, And On The North By A Line Approximately 200 Feet South Of East Perkins Street (Zone Change Application Nos. 73-4, 73-7, and 73-8)11. NOES: None ABSENT: None RESOLUTION NO. 73-25 TO IMPLEMENT THE ENVIRONT13�TAL QUALITY ACT OF 1970 The City Attorney reviewed recent California State Supreme Court legislation which sets forth a requirement for an Environmental Impact Statement and Report for those private activities which have a significant impact on the environment. `'aid report shall be prepared by the governmental agency subsouent to the filing of the Environmental Impact Statment by applicant after which said report and statement w2i1 be subs-fitted to the Planning Commission for final decision. The Planning Commission has considered subject procedure and recommended its approval for Council con-sideration. City Manager explained the cost of .filing said report T .11 be borne by the applicant and the Planning C ommissio recommendation is that said fee be set at $50 on a temporary basis pending accumtion of experience, of ter which a more realistic fee can be recommended. The following persons were present in the audience to state their obs ections 10 these requirements imposed upon them, to clarify questions pertaining to projects being help up pending implementation of said program, to ;suggest that an outside firm prepare the report so the responsibility falls on someone other than the applicant or taxpayer in the event said report is challenged, and to request the matter have more publicity prior to final Council decision: Mr. Bobby Kennedy, Kennedy Homes, h10 Burkhill Road, Ukiah Mrs. Letha O'Laughlin, 1119 South State, Ukiah i,7r. Jack Capps, Ukiah Realty, 1100 South State, Ukiah ---- iir. Ted Fiebusch, 21)0 Highland Drive, Ukiah. Mayor Buxton voiced his objection to the mandate. Council acknowledged the fact that there is only one course of action concerning the matter. On a motion by Councilman Norgard, seconded by Councilman Simpson, it was carried by the following roll call vote Resolution No. 73-25 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Of The City- Council Of The City Of Ukiah To Implement The EnvironmentalQuality Act of 1970 (Public Resources Code 21000 Et Sed)", AYES: Councilmen Weinkau.f, Norgard, Simpson, Pearson. NOES: Mayor Buxton ABSENT: None On a. .motion by Councilman Pearson, seconded by Councilman Simpson it was unani- mously carried to establish a fee of : 50 for the Environmental Impact Report as recommended by the Planning Commission at the November 9, 1972, meeting. APPROVAL OF AIRPORT SHOP BLDG. NO. 2 LEASE AGREEMENT (MAX E. & MAURICE L. HARTLEY) City Manager subject lease has been reviewed with the Lesses which, if approved, will extend the lease for subject building for a period of five years and increase the monthly rent to ` 160.00 On a motion by Councilman Norgard, seconded by Councilman Person, it was unani- mously carried to approve "Airport Shop Building No. 2 Lease Agreement" and authorize the 1,,layor and Clerk to sign same. 1r. Jack Capps, Ukiah Realty, stated Phase II of the Government Control Act pro- hibited a rental rate increase of more than 2�g and stated the airport shop building rental rate increase :exceeds said 24 . The City Attorney explained there is a. diffrence between a landlord increasing the rent and an increase which is negotiated and agreed to by the Lessee. Mrs. Letha O'Laughlin stated her understanding of said Act was that this restriction does not apply to commercial buildinrrs. 1.1INUTES OF THE MEETING OF THE CITY OF COUNCIL OF THE CITY OF UKIAH NOVEIMBER 15 1972 - PAGE 3 APPROVAL OF AMENDMENT NO. 1 TO LEASE AGRE Ei,JENT & AIRPORT PERMIT (UNDERWOOD FOND-MERCURY) On a motion by Councilman Simpson, seconded by Councilman Pearson it was unani- mously carried to approve "Amendment No. 1 To Lease Agreement And Aitport Permit Between City Of Ukiah And Underwood Ford-Mercury, Inc. Dated July 15, 1970, and the Mayor and Clerk be authorized to sign same. REQUESTED & AUTHORIZATION TO CALL FOR BIDS FOR SERVICE TRUCK Council had, prior to the meeting, reviewed specifications for a 1973 one ton heavy-duty service truck which had been approved in the current budget. City Manager recommended the bid call for 10:00 A.M. December 14, 1972. City 1.11anager stated, after inquiry from Councilman Weinkau.f, the specifications are broad enough in scope to include all makes of trucks of this; required si;Je. On a motion by Councilman Weinka,uf, seconded by Councilman Simpson, it was unanimously carried the Clerk by authorized to call for bids for one service truck as recommended, bids to be recived prior to 10:00 A.Ti., December 14, 1972. DISCUSSION OF REQd- FROi'1 UKIAH VA,'LLY`TEEN CENTER City Manager reported representatives of the Teen Center have requested funds for a Director. The matter has been considered by the recreation and Parks Commission and it is their reco.nmendation to provi r?^ --le Center with ' 000 per month:; for a period of seven months for this purpose. City IT-anager repor ted there is no provision in the current budget for an allocation to the Teem Center. COUNCILMAN PEARSON stated inasmuch as the teen center is used by citizen- From both w the city and the county, in her opinion, it would be well to explore the possibility of forming; a recreational district so the cost could be shared by all who used the facility instead of by only city residents. There was general e Council concurrence on this point. Mrs. Agnes Daugherty and Mrs. Letha O'Laughlin were present in the audience to speak in support of the request. Mrs. Daugherty reported having been to the Council prior to this date to ask for help for the center and she stated at that time Council requested that the organization "prove" itself. She stated her opinion, the roup has proven themselves for three years. In this period of time the project has progressed with voluntary help to the point where property has been purchased, construction is underway, and it had been operating on a self sustaining basis. However. , it cannot continue on this basis without help. Funds for a. Director for seven months would provide this help. The Reverend Mr. Elmer )'chr2itt reiterated the need for leadership and suggested an alternative that the City provide this leadership from City personnel. MLr Bobby Kennedy stated he has contributed to the development, of the center, but that he agreed with Council determination that this should be a. Joint project T,,1 th the County. 1Lr, Dennis Hall, 1301 University Road, Hopland, Youth Services Coordinator for North Coast Opportunities, Inc. , also spoke regarding the project. He stated this kind of facility is sorely needed in this area in order to get funding of any kind there has to be a show of support and cooperation from the governing -- body. i City •-Tanager was directed to confer with the Count n y Administrator and Jchool `superintendent to determine what 4:oint effort could be made to furnish the Teen Center with a means to meet the irugediate needs of the Teen Center, and to report back to the Council at the next meeting. Xrs. City 14anager recommended sub ect resolution, held over from the previous meeting, be adopted. On a motion by Councilman Simpson, seconded by Colinc.ilman Norga.rd, it was unani- mou:ly carried :iecolution No. 73-26 be adopted and the Mayor and Clerk be authorized to sign same, "resolution of. The City Council Of The City Of Ukiah Establishing Greens Fees For The I-iunicipal Gclf Course". Further Council inquiry concerninu a reduced rate for >enior Citizens proposed in said resolution opened the matter for further discussion. Councilman 'Norgard stated his investigation of the matter reveals most :r. Citizens have carts and if said reduction affected more people the matter could be considered reasonable, however, the rates charged at the present time are reasonable. Council concurred with Councilman Norgardts Statments and determined that the reduced fee proposed. for OX. Citi.ens be deleted from the above named resolution. ENVIRONMENTAL IMPACT REPORT 1,1r. Bobby Kennedy stated that Ukiah has spot zoning, that the City has done a good joo in this regard, and that in his opinion the above named report is not designed for our area. 1,"layor Buxton stated this was a point well taken but that we h -re no chore in the matter. CONFERENCE C01,11TTTEE NORTH-COAST OPPORTUNITIES, INC The Reverend i-fir. Elmer Schmitt, in behalf of the above named committee, asked that a. member of the Council be their guest at the North-Coast Action- Conference, December 1,20, 1972, at Blue Lakes Lodge Resot, Upper Lake. _ JACK CAPPS 1Ir. Capps again asked for clarification of the time element involved in getting a building permit after Filing the Environmental Impact Report. OOUNCIU1AN NORGARD Councilman Norgard referred to the Environmental Impact Report and stated that any resolution adopted by the Council states the intent of the Council_ and is a document that can be changed if the Council sees fit to do so. COUNCILMAN SIMPSON Councilman 3impson concurred with Councilman Norgard' s comment. COUNCILMAN PEARSON Councilman Pearson stated the new legislation will stop areas such as Ukiah from getting too large.
