HomeMy WebLinkAboutmin 12-06-72 •P � n MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH DECEMBER 6, 1972 - PAGE 1 The City Council convened in regular session in the Council Chambers at 8:00 p.m. with Councilmen Weinkauf, Norgard, Pearson, and Mayor pro tempore Simpson present. Mayor Buxton was absent. PLEDGE OF ALLEGIANCE Councilman Norgard led in the pledge of allegiance. APPROVAL OF MINUTES On a motion by Councilman Norgard, seconded by Councilman Pearson, it was unanimously carried the minutes of the meeting of November 15, 1972, be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Pearson, seconded by Councilman Weinkauf, it was unani- mously carried Payroll Warrants #2616 to #2754 inclusive for the period of November 1st to November 15, 1972, inclusive, be approved in the total amount of $59,129.30. SPECIAL WARRANTS On a motion by Councilman Norgard, seconded by Councilman Pearson, it was unani- mously carried Special Warrants #892 to #912 inclusive, in the total amount of $15,608.97 be approved and ordered paid. INVOCATION The invocation was given by the Reverend Mr. Elmer Schmitt. ORDINANCE NO. 627 INTRODUCED AMENDING CHAPTER 3 OF DIV. 4 OF CODE (UNDERGROUNDING) On a motion by Councilman Norgard, seconded by Councilman Pearson, it was carried by the following roll call vote Ordinance No. 627, "An Ordinance Of The City Of Ukiah Amending Chapter 3 Of Division 4 Of The Ukiah City Code" , be introduced. AYES: Councilmen Weinkauf, Norgard, Pearson, and Mayor pro tem Simpson. NOES: None ABSENT: Mayor Buxton. RESOLUTION NO. 73-27 SUPPORTING SENATE BILL 1261 On a motion by Councilman Pearson, seconded by Councilman Weinkauf, it was unanimously carried Resolution No. 73-27 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Of The Ukiah City Council Supporting Senate Bill 1261". CLAIM FOR DAMAGES DENIED MODERN DISPOSAL SERVICE The City Attorney reviewed subject claim in the amount of $349.72 wherein claimant alleges damage to a garbage truck at the City disposal site. It was recommended the claim be denied and referred to the insurance carrier. On a motion by Councilman Norgard, seconded by Councilman Weinkauf, it was unanimously carried the claim by Marvin E. Bowen, dba Modern Disposal Service in the amount of $349.72 be denied and the matter referred to the insurance carrier. PUBLIC HEARING DATE SET - ZONE CHANGE APPLICATION NO. 73-10 (MARY COX, 620 WILLOW) On a motion by Councilman Weinkauf, seconded by Councilman Pearson, it was unanimously carried to set January 3, 1973, 8:00 p.m. for public hearing for subject Zone Change Application. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH DECEMBER 6, 1972 - PAGE 2 APPROVAL OF VARIANCE APPLICATION NO. 73-5 (CHURCH OF THE NAZARENE) Subject application as considered by the Planning Commission had been reviewed by the Council. The variance request is to permit the construction of a sanctuary addition to the existing church with a ten foot setback along Luce Avenue instead of the normally required twenty foot setback. Planning Commission Resolution No. 73-6 recommending the variance be granted set forth the following stipulations: 1. Standard Conditions Nos. 1 thru 9 contained in the Rules of Practice and Procedure of the Planning Commission on file with the Clerk shall apply in addition to any special conditions set forth below. 2. The special conditions listed below shall apply: a. Stipulation of 18 months to complete construction. b. After plans are developed, they are to be brought back to the Planning Commission for architectural approval of the extension. C. Curb, gutter and sidewalk be extended to the balance of the property frontage on Luce Avenue. d. Only parallel parking to be permitted on street frontages. Present perpendicular parking on Luce Street to be discontinued. It was noted that the Environmental Impact Report would not have to be filed because of the recent signing of AB 889. Said bill postpones this requirement for 121 days from December 5, 1972. The Reverend Mr. Dale Livingston, Pastor of the Church of the Nazarene was present in the audience to speak in favor of the granting of the application, reviewed the proposal, and answered questions presented by the Council. There was no one present in the audience to speak in opposition to the granting of said application. The following resolution sets forth Council action on subject application. RESOLUTION NO. 73-28 GRANTING VARIANCE TO CHURCH OF THE NAZARENE On a motion by Councilman Norgard, seconded by Councilman Weinkauf, it was carried by the following roll call vote Resolution No. 73-28 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Granting Variance To Church of The Nazarene". AYES: Councilman Weinkauf, Norgard, Pearson, and Mayor pro tem Simpson. NOES: None ABSENT: Mayor Buxton REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR FIRE HOUSE DOORS Council had been provided with copies of the specifications for doors for the fire house, the cost of which is set forth in the current budget. On a motion by Councilman Pearson, seconded by Councilman Weinkauf, it was carried by the following roll call vote the Clerk be authorized to call for bids for fire house doors, bids to be received prior to 10:00 a.m. , December 26, 1972. AYES: Councilmen Weinkauf, Norgard, Pearson, and Mayor pro tem Simpson. NOES: None ABSENT: Mayor Buxton REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR FIRE DEPARTMENT RADIO EQUIPMENT Council had been provided with subject specifications recommending the bid call for December 26th, 10:00 a.m. On a motion by Councilman Norgard, seconded by Councilman Pearson, it was unani- mously carried the Clerk be authorized to call for bids for radio equipment for the Fire Department, bids to be received prior to 10:00 a.m. , December 26, 1972. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH DECEMBER 6, 1972 - PAGE 3 REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR ELECTRIC SYSTEM TELEMETERING EQUIPMENT Subject equipment is a budgeted item in the current budget in the amount of $25,000. Council had been provided with copies of the specifications for review. Maurice Roper, in the absence of the Director of Public Works, reviewed some of the technical information set forth in the specifications. On a motion by Councilman Pearson, seconded by Councilman Weinkauf, it was unanimously carried the Clerk be authorized to call for bids for electric system telemetering equipment, bids to be received prior to10:00 a.m. January 9, 1973. GIDEON BIBLE PRESENTED TO LYELL C. CASH The Reverend Mr. Elmer Schmitt invited the Council to attend the Presbyterian Church December 7th at 6:30 a.m. at which time a Gideon Bible will be presented to former City Manager Lyell C. Cash. AWARD OF BIDS FOR POLICE VEHICLES TO COX MOTORS City Manager reviewed the tabulation of bids received for subject vehicles and recommended the bid be awarded as circled below: 4-1973 (4 Vehicles) (1 Vehicle) Sedans Bucket Seats Radio Total Ukiah Mtr. Sales $14,263.72 $348.80 $49.30 4 661.82 Cox Motors $13,950.92 $324.00 49.3014 324.22 Underwood Ford Mercury $14,792.00 No Bid No Bid 14,79 Groves Motors Did not follow bid procedures 'Does not include options On a motion by Councilman Norgard, seconded by Councilman Pearson, it was carried by the following roll call vote the bid for police vehicles (4) be awarded to Cox Motors in the total amount of $14,324.22 AYES: Councilmen Weinkauf, Norgard, Pearson, and Mayor pro tem Simpson. NOES: None ABSENT: Mayor Buxton. COUNCILMAN NORGARD Councilman Norgard stated he has received too many complaints recently concerning the number of dogs on the streets. It appears the City is not receiving the same service at the present time that the City received prior to the County assuming the responsibility for the animal control program. The City Manager will contact the County regarding the problem. Councilman Norgard reported the railroad crossing at Perkins Street is very rough and suggested railway personnel be consulted to see if it can be repaired. The City Manager will see what can be done about the problem. COUNCILMAN PEARSON Councilman Pearson referred to the long period of time the railroad stops and blocks the Gobbi Street area and asked if a limit of time could be placed for such stoppages since this could be a real hazard in case of fire on the i east side of town. Councilman Simpson suggested that the Fire Department have a copy of the railroad schedule so they will know which intersection to the east side of town is open when the railroad is stopped here. The City Manager will work with the railroad company in this regard too. ADJOURNMENT The meeting was adjourned at 8:39 p.m. , after which the Council reconvened in Closed Executive Session.
