HomeMy WebLinkAboutmin 11-07-73 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH NOVEMBER 7 , 1973 The City Council convened in regular session in the Council Chambers at 8 : 00 p .m. with Councilmen Norgard , Buxton, Pearson, and Mayor Simpson present . Councilman Weinkauf was absent . INVOCATION AND PLEDGE OF ALLEGIANCE The invocation was given by the Reverend Mr . Elmer Schmitt and City Attorney Hays led in the Pledge of Allegiance. APPROVAL OF MINUTES On a motion by Councilman Norgard , seconded by Councilman Pearson it was unanimously carried the minutes of the meeting of October 17 , 1973 , be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Pearson, seconded by Councilman Buxton it was unanimously carried Payroll Warrants #785 to #916 inclusive for the period of October 1st to October 15 , 1973 , inclusive be approved in the total amount of $61 , 426 . 79 . GENERAL WARRANTS On a motion by Councilman Buxton, seconded by Councilman Norgard it was unanimously carried General Warrants #2818 to #2868 inclusive in the total amount of $81 , 269 . 85 be approved and ordered paid . UKIAH RECEIVES PEDESTRIAN SAFETY CITATION A. Mayor Simpson read subject citation which was presented by the California State Automobile Association for the City ' s outstanding pedestrian safety record during 1972 . Ukiah was one of 2 , 087 cities which participated in this year ' s AAA Pedestrian Safety Inventory Program. COUNCILMAN WEINKAUF ARRIVED AT THIS POINT IN THE MEETING - 8 : 03 P .M. PUBLIC HEARING FOR WEED ABATEMENT COSTS Public hearing for subject matter was declared open at 8 : 04 p .m. There was no one present in the audience to speak concerning the unpai weed abatement assessments . Public hearing was declared closed at 8 : 05 p.m. On a motion by Councilman Pearson, seconded by Councilman Norgard , it was unanimously carried to confirm the "Report Of Costs Of Weed Abatement By Director Of Finance" and proceed with the collection. During the discussion, Council determined subject program will begin earlier next year than last and every effort will be made to see that equity exists in seeing that each parcel is cleaned after it is posted . RESOLUTION NO . 74-23 GRANTING VARIANCE TO FLORENCE ZIMMERMAN (761 NORTH PINE STREET) On a motion by Councilman Weinkauf , seconded by Councilman Norgard it was unanimously carried Resolution No . 74-23 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Granting Variance To Florence Zimmerman" . RESOLUTION NO. 74-24 GRANTING VARIANCE TO ROBERT G. TURNER BUSH STREET & WALNUT AVENUE On a motion by Councilman Pearson, seconded by Councilman Weinkauf it was unanimously carried Resolution No . 74-24 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Granting Variance to Robert G. Turner" . MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH NOVEMBER 7 , 1973 - PAGE 2 RESOLUTION NO . 74-25 GRANTING VARIANCE TO DON RICHEY, 152 PARK PLC . On a motion by Councilman Pearson, seconded by Councilman Weinkauf it was unanimously carried Resolution No . 74-25 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution a Granting Variance To Donald R. Ritchey" . RESOLUTION NO . 74-26 APPROVING EXECUTION OF JOINT POWERS AGREEMENT ESTABLISHING NORTHERN CALIF . POWER AGENCY On a motion by Councilman Weinkauf , seconded by Councilman Norgard it was carried by the following roll call vote Resolution No . 74-26 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Of The City Council Of The City Of Ukiah Approving Execution Of Joint Powers Agreement Establishing The Northern California Power Agency" . AYES : Councilmen Weinkauf , Norgard , Buxton, Pearson, Mayor Simpson. NOES : None ABSENT : None RESOLUTION NO . 74-27 AUTHORIZING CCCJ GRANT APPL. (OPERATION I .D . ) On a motion by Councilman Pearson, seconded by Councilman Weinkauf it was unanimously carried Resolution No . 74-27 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Of The City Council Of The City Of Ukiah Authorizing CCCJ Grant Applica- tion (Operation I .D. ) " . PUBLIC HEARING DATE SET FOR OAK MANOR SUBDIVISION NO. 3 On a motion by Councilman Norgard , seconded by Councilman Pearson it was unanimously carried to set November 21, 1973 , as the time for public hearing to consider the amendment of the General Plan of land use for the City of Ukiah to reflect existing zoning of vacant parcel north and west of Oak Manor School (Oak Manor Sub- division No . 3) . NOTICE OF COMPLETION FENCING & PARKING AT AIRPORT On a motion by Councilman Weinkauf , seconded by Councilman Pearson it was unanimously carried to accept the work for fencing and parking at the Municipal Airport as complete and authorize the Clerk to file the Notice of Completion. BID AWARD FOR TWO 4DR. SEDANS TO UNDERWOOD FORD-MERCURY City Manager reviewed the following tabulation of bids for subject vehicles and recommended the bid be awarded to the low bidder , Underwood Ford-Mercury : Unit Price Total Tax Total Cox Motors $39792 . 78 $7585 . 56 $379 . 28 $7964 . 84 Groves Motors 33, 664 . 75 7329 . 50 366 . 48 7695 . 98 Underwood Ford 39652 . 79 7305 . 58 365 . 28 7670. 86 On a motion by Councilman Pearson, seconded by Cound-171Yan Buxton it was unanimously carried to award the bid for two 1974 four door sedans to Underwood Ford-Mercury in the total amount of $7 , 670. 86. MINUTES OF THE MEETING OF THE CITY COUNCIL IF THE CITY OF UKIAH NOVEMBER 7 , 1973 - PAGE 3 REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR A. C . OVERLAYS City Manager reviewed subject specifications for furnishing asphalt concrete overlays on Evans Street , Empire Drive, Mendocino -- Drive, Mendocino Place, South Dora Street , North Dora Street . On a motion by Councilman Pearson, seconded by Councilman Buxton it was unanimously carried the Clerk be authorized to call for bids for asphalt concrete overlays on City streets , bids to be received prior to 2 : 00 p .m. , November 21, 1973 . DISCUSSION OF PROPOSED COUNCIL CHAMBER RELOCATION City Manager reported the Fire Inspector repo t ind ' Ates thQ Council Chamber does not meet Fire code requirements/ bird Ped�lmintcefinot meet the code. Alternative locations for Council and City Commissions to meet has been sought . The most feasible location appears to be the Choral room facility at Mendocino Community College. The possibility has been discussed with the College President Mr . DeVries , who is agreeable to the proposal . City Manager recommended the City Council approve the relocation of City meetings to Mendocino Community College and the City Manager be directed to meet with college repre- sentatives to work out details . Councilman Pearson made a motion to relocate the Council Chambers to Mendocino Community College subject to working out the details with college staff . The motion died for lack of a second . Council was not in total agreement to the proposed move . City Attorney stated that OSHA standards are very specific in this regard and could make compliance mandatory . On a motion by Councilman Norgard , seconded by Councilman Buxton it was carried by a majority voice vote to consider subject matter for another two weeks , at which time the matter will be considered by the Council. APPROVAL OF AIRPORT COMMISSION RECOMMENDATIONS REVISED Council had been provided with subject recommendations set forth in the Airport Commission minutes dated October 16 , 1973 and a memorandum from Assistant City Manager dated October 19 , 1.973 . Said recommenda- tions proposed increased tie-down fees , abandonment of the beacon on top of Spanish Mountain, and revision of the Master Airport Plan to schedule the proposed installation of the Instrument Approach System to 1970-75 instead of 1980-85 . Councilman Norgard expressed opposition to the proposed estimated expenditure of $85 , 000 for sub- ject system. Airport Commissioner Donald DuPuertis was present in the audience and spoke to this subject . He stated that the request is for a change in the priority item in the proposed capital improve- ment program for the Airport . He stated further that an approach system is sorely needed at the airport , however , the ultimate equip- ment as originally proposed is not needed - subject equipment could x F be installed for 10% of the figure originally proposed . On a motion by Councilman Norgard , seconded by Councilman Buxton it was carried by the following roll call vote to approve Airport Commission recommendations as set forth in Minutes dated October 16 , 1973 , as it pertains to increased tie-down fees , abandonment of the beacon, and revision of the Master Airport Plan to the extent that the Instrument Approach System be changed to the 1970-75 time schedule at a cost not to exceed $8 , 000 to $10 , 000 of City funds . AYES : Councilmen Weinkauf , Norgard, Buxton, Pearson, Mayor Simpson . NOES : None ABSENT : None MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH NOVEMBER 7 , 1973 - PAGE 4 RESOLUTION NO. 74-28 ESTABLISHING SPEED ZONES On a motion by Councilman Norgard , seconded by Councilman Weinkauf , it was unanimously carried Resolution No . 74-28 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Of the City Council Of The City Of Ukiah Establishing Speed Zones" . JACK PEARSON Mr . Jack Pearson was present in the audience and suggested that a downtown improvement committee be established to maintain an attractive downtown area and develop a long range plan to update subject area . The matter will be considered at the next meeting . COUNCILMAN PEARSON Councilman Pearson suggested that an ordinance be drafted to regu- late future utility rate increases so that the public will be advised of Council action 30 days prior to a public hearing . COUNCILMAN BUXTON Councilman Buxton stated his approval of the letter going out to all utility accounts regarding the recent rate increase . COUNCILMAN WEINKAUF Councilman Weinkauf stated his approval of the proposed newsletter . Councilman Weinkauf indicated his approval of the blinking yellow light at Low Gap Road and State Street . The City Engineer ex- plained the various corrections made to the light system during the past several months . COUNCILMAN NORGARD Councilman Norgard asked the City Attorney if he had any comments concerning the conflict of interest law. The City Attorney stated he had no comment at this time, but would after he had researched the subject . MAYOR SIMPSON Mayor Simpson stated there is a vacancy to be filled on the Parks and Recreation Commission. Appointment will be made at the next Council meeting . ADJOURNMENT Mayor Simpson adjourned the meeting at 9 : 40 p .m. Mayor ATTEST : City Clerk
