HomeMy WebLinkAboutmin 1974-05-29 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH MAY 29, 1974 - PAGE 1 The City Council convened in special session at the Veterans Memorial Building, Seminary Avenue and Oak Street at 8 : 11 p.m. with Councilmen Weinkauf , Wood, and Mayor Pearson present. Councilmen Norgard and Simpson were absent. INVOCATION AND PLEDGE OF ALLEGIANCE The invoation was led by the Reverend Mr. Elmer Schmitt and the Pledge of Allegiance was led by Councilman Wood. PUBLIC HEARING - PRELIMINARY GENERAL PLAN AND DRAFT ENVIRONMENTAL IMPACT REPORT Mayor Pearson reported this as being the time and place for considera- tion of the "Preliminary General Plan, Ukiah, California" and the "Draft Environmental Impact Report, Ukiah General Plan" . Public hearing was opened at 8 : 12 p.m. Carol Walker, Lampman and Associates stated the technical study of the plan began approximately one year ago and reflects the work of the General Plan Citizens Advisory Committee and the thinking of the Planning Commission. The General Plan consists of nine mandatory elements and a number of permissable elements. Said plan is required by state law, and if not adopted, will impose strict penalties. A map of the overall area in subject plan showed a comprehensive plan which stretches from above Lake Mendocino in the north to just below Boonville Road in the south, and from ridge to ridge on the east and west. It was pointed out that subject map is a flexible one; capable of being changed - a policy plan; not a zoning map. COUNCILMAN SIMPSON ARRIVED AT THIS POINT - 8 : 25 P.M. It was pointed out that zoning must come into conformance with the Plan. Policy statements and individual action programs can be implemented by City staff. There has been no attemptto shut out growth, but to plan in an orderly fashion and to retain prime agricultural land. In summary, Carol Walker recommended that the Council adopt subject pl4p, as the official General Plan document of the City of Ukiah, revi'tw all zoning within the city and rezone to conform to this plan, forward certified copies of the plan to all required agencies, initiate implementation of the various elements, intiate a detail study of the downtown core, and review the plan every two years. The proposal contained in the General Plan pertaining to open space, hillside grazing and non-conforming use. 2. Infringement on property owners rights as a citizen to develop his property as he sees fit. 3. Conflict with the recently adopted County Open Space Element. -- , 4. Implication of the City' s current interest to annex areas con- tiguous to the city limits and lack of interest prior to the areas being fully developed. 5. Danger of inversion tactics. 6. Indications of government controlled land. 7. Bureaucracy creeping into the plan. 8. Twenty acre minimum on open space development a burden on the small property owner. 9. Limitations on 25% slope development for homes. 10. No concern for the social element. 11. No provision for public transportation 12. No classification of length and width of greenbelt around creeks and river. 13 . The citizen has no control. Citizens should know where they stand. A facsimile of subject map should be mailed to every citizen. 14 . A need for more effort to get input from citizens - not enough people coverage of subject plan. 15. Should have looked toward more industry. 16 . Citizens want their own open space - not all for government. 17. Areas of confusion between committee members and staff regarding the intent of certain aspects of the plan. 18. Long term plan should have long term study. 19 . Why involve such a vast area. 20. Not enough open space 21. Inconsistent - opposing ideas 22 . College not mentioned. 23 . No need for central recreation center - let private industry provide it. 24. Growth spreading to the hills - an indication of urban sprawl. 25. Regarding downtown core - how does the city persuade the county to relocate back downtown. 26 . Incompatible to purchase more cemetary land. 27. Proposal to buy land south of Fairgrounds when legislation is active to close fairgrounds throughout the state. 28. Encroachment of government control on free enterprise. 29. Adoption of a general plan .for an area with the terrain of Ukiah takes time; therefore the STate may not penalize the City for further study of subject plan. The following comments made were in support of the General Plan: 1. There is a need for a General Plan. 2. The General Plan Citizens Advisory Committee met over a period of one year, the public was invited to attend all meetings, but few attended. 3. The General Plan should include County area. 4. General Plan has no binding effect on the County unless the County adopts the plan. 5. There should be concern for individual rights but all rights are governed by regulations . 6. The General Plan sets forth the regulations - the delay in getting the regulations set up has already been too long . The only way to preserve property rights is through a General Plan. 7. If rules and regulations are not set forth to insure that the natural resources are not abused and destroyed, the people will take the matter in their hands and the result will be abuse and destruction of the very things we want to maintain. 8. If necessary to move forward at this time, limit action to the area within the city limits.
