HomeMy WebLinkAboutmin 1974-09-18 k' MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH SEPTEMBER 18 , 1974 - PAGE 1 The City Council convened in regular session in the Council Chambers at 8 : 02 p .m. with Councilmen Wood , Simpson, and Mayor Pearson present . Councilmen Weinkauf and Norgard were absent . INVOCATION & PLEDGE OF ALLEGIANCE The inwc ation was given by the Reverend Mr . Elmer Schmitt and Councilman Simpson led in the Pledge of Allegiance . COUNCILMAN WEINKAUF ARRIVED AT THIS POINT IN THE MEETING - 8 : 03 p .m. APPROVAL OF MINUTES On a motion by Councilman Wood , seconded by Councilman Simpson it was unanimously carried the minutes of the regular meeting of September 4, 1974, and the adjourned meeting of September 6 , 19745 be approved as submitted by the Clerk. PAYROLL WARRANTS On a motion by Councilman Simpson, seconded by Councilman Weinkauf it was unanimously carried Payroll Warrants #3945 to #4085 inclusive for the period of August 25th to September 7 , 19745 inclusive in the total amount of $64 , 916 . 84 be approved . GENERAL WARRANTS On a motion by Councilman Weinkauf , seconded by Councilman Simpson it was unanimously carried the General Warrants #4649 to #4769 inclusive in the total amount of $174 ,303 . 15 be approved and ordered paid . PROPOSED SENIOR CITIZEN UTILITY DISCOUNT PUBLIC HEARING Subject matter which is an expression of an idea of Councilman Wood , was before the Council for consideration at this time and was set forth in a resolution which was read in full . City Manager stated the total cost of the proposed utility discount would be approxi- mately $14, 000 the first year . Mayor Pearson declared the public hearing opened at 8 : 06 p .m. There was no one present in the audience to speak either in favor or in opposition to subject matter . The public hearing was declared closed at 8 : 07 p .m. A lengthy Council discussion followed . While the concept was thought by a portion of the Council to be acceptable, the proposal raised questions for Council consideration. Some of the questions were: 1) "Blanket" eligibility regardless of income 2) Would an outright contribution to the Senior Citizens Center be more helpful. 3) Expensive public relations jesture 4) Total cost is too much for the accomplishment 5) Favoring a special group 6) Would a total change in rate structure be a better alternative. 7 ) The proposed reduction would assist only a few, but would place an additional burden on the city. 8) To reduce the rate here and raise it for everyone else would be hard to combat . 9) Special transportation may be more beneficial . Councilman Wood again stated his position concerning subject matter . He stated it is easy to see that something in the future is b tter . than an immediate consideration. He referred to the recent/uijyc rate increase, another in the offing , and stated the $1 . 50 would not give an overall reduction to senior citizens but would hopefully put the senior citizen in the position they were in last May . He spoke to the concern expressed regarding eligibility regardless of income and stated there are those who would be eligible who would not make application. He pointed out the senior citizen is in a group on a fixed income, not in the labor market , and a group to whom $1 . 50 is more significant than to most . Councilman Wood stated subject proposal does not single out a special group for relief - i. e. street improve- ments are made and many senior citizens do not benefit ; the city maintains the golf course for a comparatively small group to use. City Manager referred to the Social Service element of the General Plan which is to be developed and stated subject concept could be locked into the whole program to see where there is a need . On a motion by Councilman Wood, seconded by Councilman Simpson, it was unanimously carried that the subject resolution be referred to City Manager for additional study and possible inclusion in the Social Service Element of the Ukiah General Plan as soon as possible. RESOLUTION NO. 75-26 DECLARING PROPERTY PUBLIC NUISANCE & DIRECTING ABATEMENT At its meeting of August 7 , 1974, the Council adopted Resolution No . 75-10 declaring certain properties public nuisances due to their condition and established this date as the date for public hearing to hear protests regarding this determination. All legal requirements have been met , i. e. posting and notification to property owners by certified mail . Substantial effort has been made for several years to obtain voluntary cooperation by property owners . These efforts have failed . The properties under consideration are: 106 South State, V. H. Angell 280 E. Smith Street, W. P . Kirkpatrick 2-281-15 Cleveland Lane, A. E. Lyons 407 E. Perkins , Alan Coats Mayor Pearson declared the public hearing opened at 8 : 47 p .m . Mr . Angell was present in the audience to speak in opposition to the abatement of his property at 106 South State. He stated he uses the property to store hospital supplies , he did not believe the building to be unsafe, and that it could be repaired . He stated the Building Department had refused to issue a building permit. City Attorney stated the Building Official had told Mr . Angell he would issue a building permit if he would get a structural engineer to certify that the building is a sound structure, but Mr . Angell was unable to obtain the necessary certification. Mr . Angell agreed the statement made by the City Attorney was true . City Manager reviewed the correspondence in subject file which began in 1957 with a survey when problems with the structure first began. Mr. Krikpatrick was present in the audience to express opposition to the abatement of his property. He stated- he did not believe his property to be unsafe, he is using it as a warehouse, and his plans are to cease the use when he sells the property. City Attorney reported the properties at 407 E. Perkins and 2-281-15 Cleveland Lane are absentee owners and there appears to be no problem with the abatement of either one. Public hearing was declared closed at 9 : 10 p .m . On a motion by Councilman Wood , seconded by Councilman Simpson, it was carried by the following roll call vote Resolution No . 75-26 be adopted and the Mayor and Clerk be authorized to sign same, "Reso- lution Of The City Council Of The City Of Ukiah Declaring Property A Public Nuisance And Directing The Director Of PUblic Works Of The City Of Ukiah To Abate Same" . AYES : Councilman Weinkauf , Wood , Simpson, Mayor Pearson NOES : None ABSENT : Councilman NOrgard MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH SEPTEMBER 18, 1974 - PAGE 3 ADOPTION OF ORDINANCE NO. 661 (ZONE CHANGE APPL. NO. 75-2) On a motion by Councilman Wood, seconded by Councilman Simpson it was carried by the following roll call vote to adopt Ordinance No . 661 and the Mayor and Clerk be authorized to sign same, "An Ordinance Of The City Council Of The City Of Ukiah Amending Chapter 2, Division 9 Of The Ukiah City Code By Rezoning Property From Existing M and C-M Zones To C-2 Zone (Zone Change Application No . 75-2, Planning Commission) " . AYES : Councilmen Weinkauf , Wood , Simpson, Mayor Pearson NOES : None ABSENT : Councilman Norgard REJECTION OF 2015 CLUB PROPOSAL TO CANCEL LEASE The 2015 Club, made up of Highway Patrolmen assigned to this area, have maintained a pistol range on property leased from the City at the old sewage treatment plant property . The Club proposes to give the facilities and improvements they have made to the City in return for cancellation of the remaining two years of their lease. It was recommended the bill of sale and lease cancellation be approved . Objections were expressed to the unlimited shooting rights portion of the bill of sale . Council indicated it appears this proposal gives the City all the liabilities and none of the benefits . It was suggested it may be best to let the lease run out, close the range, and relocate outside the city limits with other law enforcement agencies . On a motion by Councilman Wood, seconded by Councilman Weinkauf it was carried by a majority voice vote to reject the offer from the 2015 Club. PUBLIC HEARING DATE CHANGED ELECTRIC RATE INCREASE On a motion by Councilman Wood , seconded by Councilman Simpson it was unanimously carried to change the public hearing date for the electric rate increase to October 23, 1974 . VARIANCE APPLICATION NO. 75-6 A. W. MOUNKES-REAR YARD REDUCTION Planning Commission action on subject matter set forth in Findings dated September 13th were reviewed and recommended approval of subject application. Council action is set forth in the following action. RESOLUTION NO. 75-27 GRANTING VARIANCE TO A. W. MOUNKES , 429 NOKOMIS On a motion by Councilman Simpson, seconded by Councilman Wood it was unanimously carried Resolution No . 75-27 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution GRANTING Variance to A. W. Mounkes" . AWARD OF BID FOR TRANSFORMER TO GRAYBAR ELECTRIC The tabulation of bids received for one 500 KVA pad mount transformer were reviewed as follows : Graybar Electric $3910. 00 Consolidated Elec . $4140 . 00 Maydwell & Hartzell $5975 . 00 On a motion by Councilman Weinkauf , seconded by Councilman Wood it was unanimously carried to award the bid for one 500 KVA pad mount transformer to Graybar Electric in the total amount of $3910. 00 . r MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH SEPTEMBER 18, 1974 - PAGE 4 AWARD OF BID FOR 8" WATER PIPE & MISCL. E. 01 Hair _ _ _ _ _ _ _ _ _ _ _ _ _ Water Works On a motion by Councilman Wood, seconded by Councilman Weinkauf it was unanimously carried the bid for 8" water pipe and miscellaneous fittings be awarded to the firms as circled on the tabulations . REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR LEAF SWEEPER On a motion by Councilman Wood , seconded by Councilman Simpson it was unanimously carried to authorize the Clerk to call . for bids for a portable leaf sweeper , bids to be received prior to October 8, 1974, 2 : 00 p .m. REQUEST FROM DOLPHIN PARENT GROUP The request from the Dolphin group had been considered by the Parks and Recreation Commission at the August 27th meeting at which time it was recommended the request be approved . Subject request was for : 1. Assurance of continued financial support for the 1975 season 2. Use of the pool in September , October and November , 1974. 3 . Need for the pool to be heated as early as January for the high school practive and Dolphin practice. Marilyn Butcher and Judy Williams were present in the audience and spoke concerning the proposal and answered questions posed by the Council. On a motion by Councilman Simpson, seconded by Councilman Weinkauf it was unanimously carried to contribute to the Dolphin Club the amount set forth in the current budget . On a motion by Councilman Wood , seconded by Councilman Simpson ' it was unanimously carried that the City pay maintenance cost of the pool and the Dolphin Club pay for heating the pool for use the months of September, October , November , 1974 , and January 1975 . PROCLAMATION - WHITE CANE DAYS Mayor Pearson read subject Proclamation and declared September 19 , 20, and 21 to be White Cane DAys in Ukiah urged all citizens to join in sharing with the Lions International in their concern for the best sight possible for our neighbors in need , and for friendly help for the blind in need, by giving generously to the Lions White Cane DAys . r 3 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH SEPTEMBER 18 , 1974 = PAGE S COUNCILMAN WOOD downtown Councilman Wood referred to the/urban design study and appointments to the citizens committee and was advised the matter will be discussed in the executive session. Councilman Wood reported work is progressing in the hills beyond Highland Avenue. Grading has been done and drainage channels ", are being diverted . COUNCILMAN SIMPSON Councilman Simpson asked what progress the Police Department is making on slowing vehicles down between midnight and 3 : 00 a .m . on North Oak Street . MAYOR PEARSON Mayor Pearson reported a resolution is being prepared for considera- tion at the League convention which could give more local govern- ment control. ADJOURNMENT Mayor Pearson adjourned the meeting at 10: 10 p .m. , after which the Council reconvened in Executive Session. Mayor ATTEST : City Clerk
