MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH
FEBRUARY 5, 1975 - PAGE 1
The City Council convened in regular session in the Council Chambers
at 8 : 02 p.m. with Councilmen Weinkauf, Wood, and Mayor Pearson present.
Councilmen Norgard and Simpson were absent.
PLEDGE OF ALLEGIANCE
Councilman Weinkauf led in the Pledge of Allegiance.
APPROVAL OF MINUTES
On a motion by Councilman Wood, seconded by Councilman Weinkauf it
was unanimously carried the minutes of the regular meeting of
January 15, 1975, be approved as submitted by the Clerk.
PAYROLL WARRANTS
On a motion by Councilman Weinkauf, seconded by Councilman Wood it
vias unanimously carried Payroll Warrants #139 to #301 inclusive for
the period of December 29, 1974, to January 11, 1975, inclusive in
the total amount of $63, 276. 86 be approved.
GENERAL WARRANTS
On a motion by Councilman Wood, seconded by Councilman Weinkauf it
was unanimously carried General Warrants #381 to #448 inclusive in
the total amount of $57 , 979. 59 be approved and ordered paid.
PUBLIC HEARING-ZONE CHANGE APPLICATION
NO. 75-26 (DRS. MASSENGILL & COOK)
Subject application is a request for a change in zoning from R-2 ,
- Multiple Family District to R-3 , General Multiple Family Distrist
for the southeast corner of South Dora Street and Observatory Avenue.
Affidavits of Publication of the required legal notice of the hear-
ing as well as Affidavits of Posting and Mailing were placed on file.
Planning Commission findings dated January 29, 1975, were read
recommending approval of the proposed zone changes.
Public hearing was opened at 8: 05 p.m. There was no one present
in the audience to oppose or to speak in favor of subject application.
Public hearing was closed at 8 : 06 p.m.
Council action is set forth in the introduction of the ordinance set
forth in the next order of business.
INTRODUCTION OF ORDINANCE NO. 666
AMENDING CODE BY REZONING PROPERTY
(ZONE CHANGE APPLICATION NO. 75-26)
On a motion by Councilman Wood, seconded by Councilman Weinkauf it
was unanimously carried to introduce Ordinance No. 666 by title,
"An Ordinance Of The City Council Of The City Of Ukiah Amending
Chapter 2 Division 9 Of The Ukiah City Code By Rezoning Property
From Existing R-2 Zone To R-3 Zone (Zone Change Application No. 75-26,
Drs. Massengill and Cook) " .
ADOPTION OF ORDINANCE NO. 664
RENUMBERING ORDINANCE NO. 653
On a motion by Councilman Wood, seconded by Councilman Weinkauf it
was unanimously carried Ordinance No. 664 be adopted and the Mayor
and Clerk be authorized to sign same, "An Ordinance Of The City Council
Of The City Of Ukiah Renumbering Ordinance No. 653" .
ADOPTION OF ORDINANCE NO. 665
(ZONE CHANGE APPLICATION NO. 75-23)
On a motion by Councilman Weinkauf, seconded by Councilman Wood it
was unanimously carried Ordinance NO. 665 be adopted and the Mayor
and Clerk be authorized to sign same, "An Ordinance Of The City Council
Of The City Of Ukiah Amending Chapter 2 , Division 9 Of The Ukiah
City Code By Rezoning Property From Existing C-M Zone to M Zone (Zone
Change Application No. 74-23 , Initiated By Planning Commission) " .

RESOLUTION NO. 75-46 AUTHORIZING
EXECUTION OF CETA TITLE II SUBGRANT
On a motion by Councilman Wood, seconded by Councilman Weinkauf
it was unanimously carried Resolution No. 75-46 be adopted and the
Mayor and Clerk be authorized to sign same, "Resolution Of The
City Council Of The City Of Ukiah Authorizing The Execution Of .
A Comprehensive Employment And Training Act Title II Sub-Grant" .
RESOLUTION NO. 75-47 AUTHORIZING
SIGNATURE OF PUBLIC BUS TRANSPORTATION
JOINT POWERS AGREEMENT
On a motion by Councilman Weinkauf , seconded by Councilman Wood
it was unanimously carried Resolution No. 75-47 be adopted and
the Mayor and Clerk be authorized to sign same, "Resolution Of
The City Council Of The City Of Ukiah Authorizing The Signature
Of The Public Bus Transportation - Pilot Program Joint Powers
Agreement" .
CLAIMS FOR DAMAGES DENIED
(BOBBY DEAN SCHULTZ AND
STEPHEN CARAVELLO)
The City Attorney reported Mr. Schultz alleged an adjustment ring
to a manhole cover flipped up causing damage to the right rear
fender and bumper of his pickup. Mr. Caravello alleged a police
car backed into claimant' s vehicle.
On a motion by Councilman Wood, seconded by Councilman Weinkauf
it was unanimously carried the claims for damages by Schultz
and Caravello be denied and referred to the insurance carrier
as recommended by the City Attorney.
AMENDMENT TO SCHOOL DISTRICT AGREEMENT
On a motion by Councilman Weinkauf, seconded by Councilman Wood,
it was unanimously carried to approve "Amendment To Agreement
Between The City Of Ukiah And The Ukiah Unified School District
To Carry OUt A Program Of Community Recreation" and the Mayor and
Clerk be authorized to sign same.
PROGRESS REPORT - HOUSING AND COMMUNITY
DEVELOPMENT ACT PRE-APPLICATION
Mr. Russell Near, Chairman of the Citizens Committee for Community
Development Priorities gave a detailed progress report of said
committee. The committee has determined the programs should address
expanding the water collection and storage facilities for the
city; expand the housing for low income persons, the handicapped
and the elderly; and revitalization of the downtown area. An
estimated cost of each of said programs wasa part of the progress
report. Mr. Near pointed out that these recommendations are
part of a pre application form which must be submitted to the
Department of Housing and Urban Development (HUD) office in San
Francisco prior to March 1. HUD officials met with city staff
and interested citizens January 28 and 29th to review their re-
quirements for application submission.
Council indicated an interest in priorities expressed by the
committee and in the event that the pre-application is approved,
if the city is "locked in" to the projects set forth in the pre-
application. It was explained that the sub-committees of the
citizens committee stipulated priorities which are set forth
in the minutes of said committee. It was pointed out that if the
amount approved is less than that requested, then priorities will
have to be set. It was the understanding from the HUD officials
that the city is not "locked in" to the projects in the pre-
application, i.e. the dollar amounts can be "shuffled" at a
later date. Another report will be given the Council prior to the
final application.

On a motion by Councilman Wood, seconded by Councilman Weinkauf it
was unanimously carried to instruct the City Manager to file the
pre application with HUD for federal funds under the Housing and
Community Development Act of 1974.
PROGRESS REPORT - SIDEWALK PROGRAM
City Manager reported the Board of Supervisors and State Manpower
Office has approved the city' s request for 31 positions under Title
VI of CETA. Funding has been provided for a three month period
beginning March 1, 1975. There are currently approximately 1400
properties (19 miles) in the city lacking sidewalk. It was ex-
plained that the original concept before CETA funds became avail-
able, was outlined in a letter from the Chamber of Commerce to
property owners wherein the city would supply the engineering and
administration costs and interested property owners would bear
labor and material costs. Because of the labor now available and
the time constraint of a March 1, 1975 start up date, City Manager
recommended modification of the original concept with the City con-
tributing materials to eliminate all costs to property owners. To
implement the sidewalk construction program, City Manager recommended
that the Building Official be assigned as project manager for the
period of this assignment at a salary of $1707/month; recruit a
temporary building inspector; appropriate revenue sharing funds
to cover salary, equipment rental and materials cost for 12 miles of
work; and establish a construction priority to high traffic areas.
Councilman Weinkauf was of the opinion some project would have to
be eliminated in order to do this work, and stated, in his opinion,
the property owners should bear some of the cost of the project.
Councilman Wood stated consideration should be given to how high
the sidewalk project should be rated - with the possibility of
giving up another project. City Manager stated this as being an
unusual opportunity that will not occur again.
On a motion by Councilman Wood, seconded by Mayor Pearson, it was
carried by a majority voice vote to approve the sidewalk program
as recommended by the City Manager.
REDEVELOPMENT SEMINAR & RECONSIDERATION
OF REDEVELOPMENT AGENCY ORDINANCE
City Manager reported subject seminar was held February 3rd to
consider the proposed establishment of a redevelopment agency.
Attendance was small. Property owners were concerned about the cost,
however, a majority of those in attendance appeared to be agreeable
to proceed with the project. Councilman Weinkauf and Mayor Pearson
indicated general approval with the establishment of subject agency.
Councilman Wood brought up questions for Council consideration -
(1) If Council accepts the concept of an agency, the scope of the
agency should be discussed in detail; (2) if accepted, can Council
devote the time required;, (3) it appears subject matter is not a
ballot issue; (4) not convinced that the Council should create the
agency.
Mr. Lee Enemark, Book Revue, stated he is in favor of a redevelopment
-- agency. He also stated every survey has pointed out that the primary
problem in a rural community is the possibility of the core of the
downtown area being de-centralized. The business community is behind
a joint city-county-merchants cooperation to revitalize the downtown
area.
Council determined subject decision merits full Council attention so
subject matter will again be discussed at a subsequent meeting.

On a motion by Councilman Weinkauf , seconded by Councilman
Wood it was unanimously carried Resolution No. 75-48 be adopted
and the Mayor and Clerk be authorized to sign same, "Resolution --�

it was unanimously carried to award the bid for power poles

On a motion by Councilman Wood, seconded by Councilman Weinkauf
it was unanimously carried Resolution No. 75-49 be adopted and
the Mayor and Clerk be authorized to sign same, "Resolution Of

Of Real Property (Ornbaun Lot) " .

WRITTEN COMMUNICATION (CHAMBER OF COMMERCE
INDUSTRIAL DEVELOPMENT COMMITTEE)
Mr. Dean DeVries, a member of subject committee reviewed a letter
which had been forwarded to elected officials of the City and
County requesting cooperation in bringing industry to the area.
The committee indicated that in the past progress has been stalemated
which leaves the committee with two choices - to stop trying to
bring industry to Ukiah or to enlist the cooperation of the City
and County. Reference was made particularly to the required
Environmental Impact Reports and the length of time it takes to
gain approval before a proposed industry can finalize its site
plans. City Manager pointed out three instances in the last
year where EIR clearance was secured in 15 days and assured
the committee every effort will be made to continue said cooperation.
COUNCILMAN WEINKAUF
Councilman Weinkauf stated he was glad to see Perkins Street
improvement project beginning.
ADJOURNMENT
Mayor Pearson adjourned the meeting at 9: 46 p.m. after which the
Council reconvened in Litigation and Personnel Session.
