The City Council convened in regular session in the Council Chambers at
8: 04 p.m. with Councilmen Weinkauf, Wood, Simpson, Mayor Pearson
present. Councilman Norgard was absent.
INVOCATION & PLEDGE OF ALLEGIANCE
The Reverend Dr. Elmer Schmitt led in the invocation and Councilman
Wood led in the Pledge of Allegiance.
APPROVAL OF MINUTES
On a motion by Councilman Wood, seconded by Councilman Weinkauf
it was unanimously carried the minutes of the regular meeting of
February 5 , 1975, be approved as submitted by the Clerk.
PAYROLL WARRANTS
On a motion by Councilman Weinkauf, seconded by Councilman Simpson
it was unanimously carried Payroll Warrants #302 to #435 inclusive
for the period of January 12th to January 25, 1975, inclusive in the
total amount of $62, 144. 58 be approved.
GENERAL WARRANTS
On a motion by Councilman Simpson, seconded by Councilman Wood, it
was unanimously carried General Warrants #449 to #615 inclusive in
the total amount of $196, 816. 12 be approved and ordered paid.
ADOPTION OF ORDINANCE NO. 666
(ZONE CHANGE APPL. , MASSENGILL & COOK)
On a motion by Councilman Weinkauf , seconded by Councilman Simpson
it was unanimously carried Ordinance No. 666 be adopted and the Mayor
and Clerk be authorized to sign same, "An Ordinance Of The City
Council Of The City Of Ukiah Amending Chapter 2 Division 9 Of The
Ukiah City Code Be Rezoning Property From Existing R-2 Zone To R-3
Zone (Zone Change Application No. 75-26, Doctors Cook And Massengill) "
ADOPTION OF ORDINANCE NO. 663
ESTABLISHING A REDEVELOPMENT AGENCY
City Manager reported subject ordinance had been considered by Council
several times since its introduction December 4 , 1974. A seminar
was also conducted to provide information to the public and answer
questions. Council discussion followed.
Mr. Paul Trouette was present in the audience and asked questions
concerning the cost involved in the proposed agency. Said questions
were answered by City Manager.
On a motion by Councilman Weinkauf ,seconded by Councilman Simpson
it was carried by the following roll call vote Ordinance No. 663 be
adopted and the Mayor and Clerk be authorized to sign same, "An
Ordinance Of The City Council Of The City Of Ukiah Establishing A
Redevelopment Agency" .
AYES: Councilmen Weinkauf, Wood, Simpson, Mayor Pearson
NOES: None
ABSENT: Councilman Norgard

RESOLUTION NO. 75-50 AUTHORIZING
POLICE DESTRUCTION OF CERTAIN AGED RECORDS
On a motion by Councilman Wood, seconded by Councilman Simpson
it was unanimously carried Resolution No. 75-50 be adopted and the
Mayor and Clerk be authorized to sign same, "Resolution Of The City
Council Of The City Of Ukiah Authorizing The Police Destruction Of
Certain Aged Records" .

RESOLUTION NO. 75-51 APPROVING.
ANNEXATION (LOW GAP COUNTY COMPLEX)
On a motion by Councilman Simpson, seconded by Councilman Weinkauf
it was unanimously carried Resolution No. 75-51 be adopted and the
Mayor and Clerk be authorized to sign same, "Resolution Approving The
Annexation To The City Of Ukiah Of Certain Uninhabited Territory
Designed "Annexation No. 74-7 ' (Low Gap County Complex Annexation) " .
RESOLUTION NO. 75-52 AUTHORIZING
SIGNATURE TO FEDERAL HIGHWAY
FUND USE MASTER AGREEMENT
On a motion by Councilman Wood, seconded by Councilman Simpson it
was unanimously carried Resolution No. 75-52 be adopted and the
Mayor and Clerk be authorized to sign same, "Resolution Of The City
Council Of The City Of Ukiah Authorizing Signature To Federal
Highway Fund Use Master Agreement" .
AWARD OF BID FOR OLD LIBRARY
BUILDING TO JACK COX & ASSOCIATES
City Attorney reported the minimum bid of $25, 000 is based on an
appraisal of the property by Howell/Wolf Appraisal Services, The
tabulation of bids received was reviewed and it was recommended
the sale be awarded to Jack Cox and Associates.

Joe Foutz and Francis Sanchez 26, 050. 00
On a motion by Councilman Wood, seconded by Councilman Weinkauf it
was unanimously carried the bid of Jack Cox and Associates be accepted
in the amount of $31, 875. 00 for the Carnegie Library building and lot.
REVIEW OF ENVIRONMENTAL IMPACT REPORTS
Council had been provided with a memorandum dated February 11, 1975,
from the Planning Director which gave a review of Environmental Impact
Reports. A recent court decision expands the role of the EIR and will
result in preparation of a document similar to an operations manual
rather than a resolution as previously adopted. The appeal procedure,
an area of Council concern, will be spoken to in said manual.
Councilman Wood stated the entire authority to pass on subject reports
has been delegated to the Planning Commission and in his opinion, the
right of appeal should be separate from the entitlement; currently
it is one package. The City Attorney explained that the right of appeal
is contained in the present zoning ordinance; the question of the
adequacy of an EIR could reach the City Council in the form of an appeal
of the Planning Commission' s action on a project. A strict interpre-
tation would give the Planning Commission responsibility for reviewing
EIRs associated with Use Permits and Architectural Review items and
the Council would have responsibility for reviewing EIRs associated
with Zone Changes, Geeneral Plan Amendments and Variances.
�- - On a motion by Councilman Wood, seconded by Councilman Simpson it was
unanimously carried to include appeal right on Environmental Impact
Reports to Council.
REQUEST & AUTHORIZATION TO CALL FOR
BIDS FOR SIDEWALK CONSTRUCTION MATERIALS
On a motion by Councilman Wood, seconded by Councilman Simpson it was
unanimously carried to direct the Clerk to call for bids for materials
for the sidewalk construction program, bids to be received prior to
2: 00 p.m. March 3, 1975.

APPROVAL OF REQUEST" FROX YrRE D"ISTRICT
On a motion by Councilman Wood, seconded by Councilman B-it
was unanimously carried to share in the cost ($556. 00) for a new
map of the Fire District as requested in a letter from the District
dated February 12, 1975.
COUNCILMAN WOOD 1
Councilman Wood referred to Dr. Holtzer' s letter regard ng
fluoridation and was informed subject matter would be on the next
agenda.
ADJOURNMENT
Mayor Pearson adjourned the meeting at 9 : 07 p.m. , after which the
Council reconvened in Personnel Session.
