HomeMy WebLinkAboutmin 1975-03-05 MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH MARCH 5, 1975 - PAGE 1 The City Council convened in regular session in the Council Chambers at 8: 00 p.m. with Councilmen Weinkauf, Norgard, Wood, Simpson and Mayor Pearson present. INVOCATION AND PLEDGE OF ALLEGIANCE The Reverend Dr. Elmer Schmitt led in the invocation and Council- man Weinkauf led in the Pledge of Allegiance. APPROVAL OF MINUTES On a motion by Councilman Wood, seconded by Councilman Simpson, it was unanimously carried the minutes of the regular meeting of February 19, 1975, be approved as corrected. PAYROLL WARRANTS On a motion by Councilman Weinkauf , seconded by Councilman Norgard it was unanimously carried Payroll Warrants #436 to #612 inclusive for the period of January 26, 1975, to February 8, 1975, inclusive in the total amount of $68, 190. 80 be approved. GENERAL WARRANTS On a motion by Councilman Wood, seconded by Councilman Simpson it was unanimously carried General Warrants #616 to #645 inclusive in the total amount of $42, 061. 33 be approved and ordered paid. PROCLAMATION-NATIONAL TRANSPORTATION WEEK Mayor Pearson read subject proclamation and declared the week of May 11 through 17 , 1975, as National Transportation Week and urged citizens of this city to become aware of and appreciate the capabilities of our nation' s transportation system and the role it plays in our daily lives. PROCLAMATION-GIRL SCOUT WEEK Mayor Pearson read subject proclamation and declared the week of March 9 through 15, 1975, as National Girl Scout Week. INTRODUCTION OF ORDINANCE NO. 667 PURCHASING REVISION City Manager reported subject ordinance is recommended to tighten certain regulations and to reflect inflationary changes and changes in state law regarding purchasing procedures. Council requested clarification of several sections throughout the proposed ordinance. Prior to adoption of subject ordinance, points of Council discussion will be clarified. On a motion by Councilman Wood, seconded by Councilman Norgard, it was carried by the following roll call vote to introduce by title Ordinance No. 667, "An Ordinance Of The City Of Ukiah Providing For The Purchase And Sale Of Supplies And Equipment And Repealing Chapter 6 Of Division 1 Of The Ukiah City Code" . - - AYES: Councilmen Weinkauf, Norgard, Wood, Simpson, Mayor Pearson NOES: None absent: None CLAIM FOR DAMAGES DENIED (JAMES & DOROTHY CAGLE) City Attorney reported subject claim was filed after Claimant suffered a sewage back-up into his home. Due to the extent of the damage and the early knowledge of the problem, the insurance carrier was contacted and an investigator has been on the scene. It was recommended the claim be rejected and referred to the insur- ance carrier. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH MARCH 5, 1975 - PAGE 2 On a motion by Councilman Simpson, seconded by Councilman Norgard it was unanimously carried the claim for damages filed by James and Dorothy Cagle be denied and referred to the insurance carrier. VARIANCE APPLICATION NO. 75-33 THEATRE MANAGEMENT, INC. Subject application is a request for variance from off-street parking requirements as prescribed by Section 9165 of the Municipal Code. Subject property is located on the corner of South State and West Mill Streets. Planning Commission findings dated February 26, 1975, recommended granting said application. There was no one present in the audience who spoke in opposition or in favor of subject application. Council action is set forth in the following resolution. RESOLUTION NO. 75-54 GRANTING VARIANCE TO THEATRE MANAGEMENT, INC. On a motion by Councilman Simpson, seconded by Councilman Norgard it was unanimously carried Resolution No. 75-54 be adopted and the Mayor and Clerk be authorized to sign same, "Resolution Granting Variance To Theatre Management, Inc. " BID AWARD FOR TURF AERATOR TO TORO PACIFIC DISTRIBUTING City Manager reported only one bid was received for subject equipment. The bid was over the engineer' s estimate, but the total budgeted for equipment has not been encumbered, therefore it was recommended the bid be awarded to the sole bidder. On a motion by Councilman Simpson, seconded by Councilman Wood it was unanimously carried the bid for the turf aerator be awarded to Toro Pacific Distributing in the total amount of $3381. 40. PROGRESS REPORT ON SIDEWALK CONSTRUCTION PROGRAM City Manager reported the sidewalk program is progressing on schedule. A full crew is on the job. At the present time crews are working at Yokayo School and will be moving on to Dora. Calls have come into City Hall requesting work to be done in various areas of town. A map indicating priority areas according to the main arteries of traffic throughout the city was reviewed. City Manager reported it appears that the first priority area will be completed and work will be completed in a major portion of the second priority section prior to the end of the allotted time for completion of the total project. City Manager requested Council opinion of subject priority areas by amending or approving said map. Council indicated a need for better service to interested parties calling into City Hall for information on subject matter as well as publicity from the news media. On a motion by Councilman Simpson, seconded by Councilman Norgard it ] was unanimously carried to adopt the map showing priority areas for the sidewalk construction project as reviewed by the City Manager. AWARD OF BID FOR SIDEWALK MATERIALS TO FORD GRAVEL & REDWOOD VALLEY GRAVEL PRODUCTS Citv Manager review, xedwoo d Valley Gra Alternate Bid: MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH MARCH 5, 1975 - PAGE 3 On a motion by Councilman Norgard, seconded by Councilman Simpson it was unanimously carried to award the bid for sidewalk materials to Ford Gravel Company for mixed concrete @ $29. 10 cu. yd&$20 hr,standby & to Redwood Valley Gravel Products for 3/4" maximum, aggregate base @ $3 . 18 per ton and $3. 55 per ton for fine aggregate. REQUEST & AUTHORIZATION TO CALL FOR BIDS FOR A.C. SURFACINGS ON PERKINS ST. �+ On a motion by Councilman Norgard, seconded by Councilman Weinkauf it was unanimously carried to authorize the Clerk to call for bids for asphalt concrete surfacings on West Perkins between Dora and Highland, bids to be received prior to 2 : 00 p.m. March 25, 1975. APPROVAL OF LEASE PURCHASE AGREEMENT FOR BURROUGHS MINI-COMPUTER (SAVINGS BK. ) City Manager reported subject equipment has been delivered and is in operation. Each bank has been solicited concerning subject agree- ment. The Savings Bank was the low bidder and it was recommended the City enter into the lease purchase agreement with said bank. On a motion by Councilman Norgard, seconded by Councilman Wood it was unanimously carried to enter into a lease purchase agreement with the Savings Bank of Mendocino County for the Burroughs Mini- Computer as recommended by the City Manager. PUBLIC HEARING SET FOR HOUSING & COMMUNITY DEVELOPMENT ACT APPLICATION On a motion by Councilman Wood, seconded by Councilman Simpson, it was unanimously carried to set April 2, 1975 as the public hearing m date to consider the application to Housing and Urban Development for federal funds under the Housing and Community Development Act of 1974 including the Housing Assistance Plan. NCPA AGREEMENT FOR PARTICIPATION IN THE ELECTRIC POWER DEVELOPMENT FUND City Manager reported the final draft of subject agreement has been received. Its provisions were reviewed briefly by the City Manager and will be on the next agenda for further discussion. Councilman Norgard stressed the importance of the NCPA and its accomplishments to date and its potential for the future. The City should move ahead with other member cities. WRITTEN COMMUNICATION: CITY OF ARCATA PROPOSED PASSENGER RAILROAD SERVICE The City of Arcata has requested Council endorsement of a proposed railroad passenger service on the north coast from Marin County to Humboldt County. Council expressed a difference of opinion re- garding subject request. Mayor Pearson and Councilman Weinkauf in- dicated disapproval based primarily on the fact that the Council had previously voted on regular passenger service, the proposed service will be non stop with one charge regardless of destination, the potential affect on the Skunk operation, and the requirement that - the passenger sign a waiver in case of accident. On a motion by Councilman Wood, seconded by Councilman Simpson, it was carried by the following roll call vote to support the City of Arcata' s request for the reestablishment of a passenger rail service for the north coast. AYES: Councilmen Norgard, Wood, Simpson. NOES: Councilman Weinkauf and Mayor Pearson ABSENT: None MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH MARCH 5, 1975 - PAGE 4 APPROVAL TO PURCHASE FLUORIDATION EQUIPMENT Council had been provided with a letter from Dr. Holtzer, County Health Officer, urging Council consideration to fluoridate its water supply. City Manager reported funds to purchase equipment had been provided in the previous years budget and carried over to the current budget. The current estimate of cost is $39, 000. City Manager re- ported it would be appropriate to discuss whether or not to drop the matter or to proceed with the project. Councilman Norgard stated in his opinion, purchasing subject equipment would be money well spent and Council would be doing the people a favor to proceed with this project. He stated certain cities in the Bay Area have elected to fluoridate the water supply and cited San Francisco particularly as a city that has statistics indicating 40% to 50% reduction in cavities since fluoridation of the water supply. Councilman Simpson was of the opinion that the people should have the right to make the decision. On a motion by Councilman Wood, seconded by Councilman Norgard it was carried by the following roll call vote to purchase the equipment necessary to fluoridate the city' s water supply. AYES: Councilmen Weinkauf , Norgard, Wood, Mayor Pearson. NOES: Councilman Simpson ABSENT: None OPPOSITION TO SB275 LABOR RELATIONS MEASURE Subject bill grants public employees the right to strike and makes mandatory compulsory and binding arbitration. Written communication from the City of Lynwood urged opposition to subject bill. The passage of subject bill would take vital decision making power out of the hands of locally elected officials and pass those dicisions to non- elective persons who are not responsible to the public and constitutes a definite infringement and pre-emption of local government' s authority to responsibly deal with public employees salaries, fringe benefits and working conditions. On a motion by Councilman Norgard, seconded by Councilman Simpson it was carried by the following roll call vote to join the City of Lynwood in opposing SB275. AYES: Councilmen Norgard, Wood, Simpson, Mayor Pearson NOES: Councilman Weinkauf ABSENT: None SUPPORT TO SB15 (PRESERVATION OF AGRICULTURAL LANDS) Councilman Norgard referred to a Legislative bulletin from the League of California Cities regarding AB15 and how it pertains to the preserva- tion of agricultural lands. He stated Council action on the General Plan confirms the intent of this bill and recommended that the Council take action on subject matter. On a motion by Councilman Norgard, seconded by Councilman Simpson it was carried by the following roll call vote to go on record with the League of California Cities supporting AB15. AYES:Councilmen Norgard, Wood, Simpson, Mayor Pearson. NOES: Councilman Weinkauf RESOLU'_T'ION NO. 75-55 TO STREAMLINE ABSENT: None ENVIRONMENTAL CONTROLS UNDER THE FOREST PRACTICE ACT On a motion by Councilman Norgard, seconded by Councilman Simpson it was carried by a majority voice vote to adopt Resolution No. 75-55 and the Mayor and Clerk be authorized to sign same, "Resolution Of The City Council Of The City Of Ukiah Urging State Officials To Streamline Environmental Controls Under The Forest Practice Act" . PAUL TROUETTE Paul Trouette asked the amount of the allocation toward the sidewalk material cost and the length of time it will take for the project. City Manager advised the allocation is $100, 000 and we will .exhaust the manhours before the money is exhausted. MINUTES OF THE MEETING OF THE CITY COUNCIL OF THE CITY OF UKIAH MARCH 5, 1975 - PAGES ADJOURNMENT Mayor Pearson adjourned the meeting at 9: 30 p.m. to reconvene in Closed Executive Session. MINUTES - CLOSED EXECUTIVE SESSION FOLLOWING REGULAR COUNCIL MEETING OF MARCH 5, 1975 The City Council met in closed session to evaluate a settlement offer in the lawsuit of Ruelle v. City of Ukiah, et al. The settlement offer involved the exchange of parcels of land of less than 1/2 acre and in return the suit would be dismissed and a waiver of future damages would be signed by the plaintiffs.
